Thanks. -Amy From: Kevin Martin (mailto:kmartin@sandec.com] Sent: Friday, February 12, 2010 1:28 PM To: Chapman, Amy Cc: Karoly, Cyndi Subject: Shiloh Morrisville Existing Fill removal Amy, per our meeting this morning it is my understanding that DWQ will consider the removal of existing unstable fill (that was placed prior to the effective date of the buffer rules) as an exempt activity as long as the stable fill replaced in Zone one on stable slopes of 3:1 or"flatter" if the buffer is reestablished with forest vegetation in accordance with DWQ buffer restoration guidelines and that stable fill replaced in Zone 2 is revegetated with a stable slopes containing grass. We also understand that diffuse flow must be maintained in the buffer once it is reestablished. Even though this is an exempt activity we plan to submit a buffer restoration plan to you for your files prior to commencing removal of the existing fill. In order for the local government to issue a erosion control permit and other necessary approvals, the engineer has informed me that he will need some kind of correspondence from DWQ indicating that they concur with our proposed approach to deal with the removal of the existing unstable fill. Can you please respond to my email with that concurrence? Feel free to reference any of the exhibits I gave you today I am attaching digital copies so you do not have to scan the hard copies).
