Subject: Draft NPDES Permit Renewal
Permit NC0020231
Tar River WRF
Franklin County
Grade IV Biological WPCS
SIC Code 4952
Dear Mr. Franklin:
Enclosed with this letter is a copy of the Draft NPDES permit renewal for your facility. Please
review this draft carefully to ensure thorough understanding of the requirements and conditions it
contains. There are several changes from the existing permit, including the following:
• Per 15A NCAC 08G .0302, the facility class has been changed to Grade IV due to the
nutrient limits in the permit and the rule conditions.
• As the facility class has been updated, monitoring frequencies for pH and dissolved oxygen
have been revised to reflect a Grade IV facility[See A.(1.)].
• Based on NPDES guidance regarding the reduction of monitoring frequencies in NPDES
permits for exceptionally performing facilities, monitoring requirements for CBOD5,NH3-
N, Total Suspended Solids and Fecal Coliform have been reduced to twice per week [See
A.(1.)].
• Based on the Mercury TMDL evaluation showing no annual average mercury
concentration greater than the Water Quality-Based Effluent Limit, the total mercury limit
has been removed from the permit [See A.(1.)]. However, monitoring for mercury using
the low-level test method 1631E shall continue when performing the three Effluent
Pollutant Scans[See A. (6.)]
• Based on the 2012 Statewide Mercury TMDL implementation guidance,Special Condition
A.(8.)Mercury Minimization Plan has been removed from the permit.
• Some of the wording has changed in Special Condition A.(2.), Chronic Toxicity Permit
Limit,please review each paragraph carefully.
• Special Condition A.(3.)has been modified to include the specific three years in which the
Effluent Pollutant Scan shall be performed(2022,2023,and 2024). In addition,at the end
of the Special Condition, 2nd species Toxicity Testing Requirements for municipal permit
renewals per Federal Regulations [40 CFR 122.21(j)(5)] have been added.
• A notation was made concerning the Electronic Reporting Rule—Phase 2 Extension.EPA
is proposing to extend the Phase 2 deadline from December 21, 2020, to December 21,
2025.The current compliance date will be extended if the implementation date is extended
as a fmal regulation change in the federal register.

A. (3.) CALCULATION OF TOTAL NITROGEN AND TOTAL PHOSPHORUS LOADS
[G.S.143-215.1(b)]
(a.)The Permittee shall calculate monthly and annual TN Loads as follows:
(i.) Monthly TN(or TP)Load (lb/mo)=TN (or TP) x TMF x 8.34
where:
TN or TP = the average Total Nitrogen or Total Phosphorus concentration
(mg/L)of the composite samples collected during the month
TMF = the Total Monthly Flow of wastewater discharged during the
month(MG/mo)
8.34 = conversion factor,from (mg/L x MG)to pounds
(ii.) Annual TN (or TP) Load (Ib/yr) =Sum of the 12 Monthly TN(or TP)Loads for the
calendar year
(b.)The Permittee shall report monthly Total Nitrogen and Total Phosphorus results(mg/L and lb/mo)
in the appropriate discharge monitoring report for each month and shall report each calendar year's
results(lb/yr)with the December report for that year.
A. (4.) ANNUAL LIMITS FOR TOTAL NITROGEN OR TOTAL PHOSPHORUS
[15A NCAC 02B .0730]
(a.) Total Nitrogen(TN)and Total Phosphorus(TP)allocations and load limits for NPDES
dischargers in the Tar-Pamlico River basin are annual limits and apply on a calendar year basis.

Load limit in this Permit if:
(i.) the Permittee's annual TN(or TP)Load is less than or equal to the effective limit,or
(ii.) the Permittee is a Co-Permittee Member of a compliance association.
(c.) If the Permittee is not a co-permittee member of a compliance association and the Permittee's
cumulative annual TN(or TP)discharge exceeds the effective TN(or TP)Load limit in this permit
at any point during the calendar year, the Permittee is in violation of its TN(or TP)Load limit for
the remainder of the calendar year, and each day of continuing violation shall constitute a
separate violation.Compliance with annual limits shall be determined separately for each
calendar year, and an exceedance in one year does not carry forward to subsequent years.
Permit NC0020231
