Thanks for contacting me about this proposed change. This is sufficient for our purposes and
does not need a permit modification since (A) the change is outside buffers/wetlands/streams
and (B) the change does not decrease any stormwater treatment.
As long as the engineers feel that the slope is such that headcutting up the ditch will not
be a problem, then I am fine with this change.

Rob,
Project B-3919 (bridge 448 over Austin Creek and bridge 140 over Smith's Creek on SR 2053 -
Jones Dairy Road) project is currentl scheduled to let 12/15/2009. We have already received
the 401 and buffer authorization (#20090336 on 4/23/2009.
The engineers would like to change the material lining a ditch on buffer drawing sheet 9 of
10. Ditch is located in the lower left (south of Smith's Creek east of Jones Dairy Road).
The ditch crosses under a driveway, gets wider, and discharges outside of the buffer. The
hydro engineers would like to replace the rip rap with PSRM (permanent soil reinforcement
matting) and place rip rap at the outlet of ditch (outside of the buffer) for erosion
control. ..Please see the attached pdf. Would you prefer a formal permit modification? Are
,you okay with these changes?
