Express Permit Review Program
Project setting
Jay Horton, acting as agent for Charles and Bettina Meekins, has requested the
attached application be processed under the Express Permit Review Program, for
additions to an existing dwelling. The project site is located in the Olde Towne Subdivision
at 3013 River Lane (off SR 1200) in the City of New Bern on the Trent River in Craven
County, North Carolina.
The site is a ±0.75-acre lot adjacent the Trent River with 122.9' of shoreline. The
site is a fully developed residential lot with a house, bulkhead, pier with a boat house and
an additional uncovered boat lift. Vegetation on the lot consists of lawn grass, landscaping
beds with shrubs and flowers, several hardwoods and pines. The asphalt access road for
the subdivision is located at the back portion of the site and the area beyond the access
road is a large expanse of wooded wetland associated with a creek drainage feature.
The property is bordered on both sides by developed home sites with similar
vegetation including landscaping and ornamental shrubs. Both adjoining properties are
bulkheaded and have piers.
The Trent River in this area is classified SB;Sw,NSW by the Environmental
Management Commission. This section of the river is designated as coastal waters and is
closed to shellfishing.
Project description
The applicant proposes to undertake construction on 3 additions to the existing
house. Proposed additions to the garage and master bedroom are well outside the 75'
Coastal Shoreline Area of Environmental Concern. The third addition proposed by the
applicant is the construction of a ±1,011 ft' terrace and covered porch on the waterward
side of the house of which the majority will be within 75' of the river and ±24 ft2 will be
within 50' of the river and within Zone 2 of the Neuse River Riparian Buffer. The applicant
received a "General MAJOR VARIANCE" (DWQ Project #09-1271) from the Division of
Water Quality on 22 December 2009 for the proposed development (Attached).
Anticipated impacts
The 3 additions proposed to the existing dwelling will disturb ±1,367 ft2 of uplands
and will result in ±1,225.9 ft2 (13.3%) of impervious surface in the Coastal Shoreline AEC
including the existing and proposed development. Overall impervious surface for the site
will be ±7,542.16 ft2 or 23% for the entire site including existing and proposed
development.

within the Coastal Counties as defined by the Coastal Area Management Act with Additional
Conditions
Dear Mr. and Mrs. Meekins:
You have our approval, in accordance with the conditions listed below, to impact approximately
23.97 square feet (ft) of Zone 2 of the protected riparian buffers for the purpose of constructing a
porch on the subject property as described within your application dated November 19, 2009.
This letter shall act as your approval for the use of the "General" Major Variance; From the
Neuse and Tar-Pamlico Riparian Buffer Rules for the Construction of Residential Structures on
Existing Lots within the Coastal Counties as defined by the Coastal Area Management Act with
ADDITIONAL CONDITIONS as approved by the Water Quality Committee (WQC) of the
Environmental Management Commission (EMC) on May 10, 2001. In addition, you should get
any other required federal, state or local permits before you proceed with your project including
(but not limited to) Sediment and Erosion Control and CAMA permits. This approval shall
expire when the variance expires on April 11, 2011 unless the variance is renewed before that
time by the EMC.
This approval is for the purpose and design that you described in your variance request. If you
change your project, you must notify us and you may be required to send us a new request for
approval. If the property is sold, the new owner must be given a copy of this approval and is
thereby responsible for complying with all conditions. This approval requires you to follow the
conditions listed below.

1. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, and any subsequent modifications, the applicant is required to
return the attached certificate of completion to the 401 Oversight/Express Review
Permitting Unit, North Carolina Division of Water Quality, 1650 Mail Service Center,
Raleigh, NC, 27699-1650.
2. Diffuse Flow
All new stormwater drainage shall be directed to vegetated areas as diffuse flow at non-
erosive velocities prior to entering the protected riparian buffers as identified within 15A
NCAC 2B .0233(5). No new ditching or piping of stormwater through the protected
buffers is allowed.
3. Protective Fencing
The outside buffer, wetland or water boundary and along the construction corridor within
these boundaries approved under the authorization shall be clearly marked with orange
warning fencing (or similar high visibility material) for the areas that have been approved
to infringe within the buffer, wetland or water prior to any land disturbing activities to
ensure compliance with 15A NCAC 213 .0233 and 15A NCAC 2H.0500.
If you do not accept any of the conditions of this approval, you may ask for and adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a
hearing, send a written petition that conforms to Chapter 150B of the North Carolina General
Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-
6714. This approval and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under the Neuse River Riparian
Buffer Protection Rules (15A NCAC 213 .0233 (9)(b)). Please call Anthony Scarbraugh of the

The proposed project will consist of a 1011 ft2 covered stone terrace, a 222ft2 master
closet addition and a 150ft2 garage addition.
All proposed additions will be constructed using traditional techniques (stick built).
The stone terrace will be used as an extended season living space allowing the
Meekins' to enjoy their residence in colder months as well as warmer days. Both the
master closet addition and garage addition are being implemented due to the need of
more living space.

The proposed project will consist of a "stone terrace" addition that will be used for entertaining purposes and will only
encroach approx. 23.97ft2 into the zone 2 buffer.
