Subject: 44 kV Transmission Line Rebuild — Duke Energy Carolinas
Pisgah National Forest Section
Project No. 13-0397
McDowell County
Duke Energy proposes to rebuild their 44 kV transmission line that runs through Pisgah National Forest/
Grandfather Ranger District, McDowell County. The preferred alternative is to parallel the existing
transmission line. The DWQ/ARO has no significant additional comments from those given October 29,
2012.
The following concerns may, or will likely, need to be addressed:
NPDES Construction Stormwater Permit NCGO10000 — This permit is issued concurrently with
an approved Erosion and Sedimentation Control plan to control stormwater discharges from
construction activities. If greater than one acre is disturbed, a NCGO 10000 is required. This is
acknowledged in the document (and the DWQ/ARO understands that Duke Energy has received a
Sediment and Erosion Control Plan approval).
2. 401 Water Quality Certification — If a 404 permit is required by the Army Corp of Engineers, a
401 Water Quality Certification is necessary. Depending on the amount of impact to a stream
and/or wetland — written concurrence from this office may be required. Based on information
presented in the document, written concurrence from DWQ may not be necessary.
The Division would recommend coir/natural material matting at surface waters (as opposed to synthetic
matting).

Prescribed Burn — Lost Bear West

The Grandfather Ranger District of the Pisgah National Forest proposes to perform a prescribed burn in
the Lost Bear West area.
The Division of Water Quality has the following concern:
1. The USDA should ensure that all Forestry BMPs are met/maintained after completion of the
prescribed burn, so that sediment due to exposed soils does not enter surface waters.

The Linville Gorge Wilderness area of the Grandfather Ranger District proposes to perform a prescribed
burn in Burke and McDowell Counties.
The Division of Water Quality has the following concern:

Subject: Project Rock Solid - CDBG
Environmental Review Comments
McDowell County
Project Rock Solid is an application for a Community Development Block Grant (CDBG) to renovate the
existing Swift-Galey plant so that Rock -Tenn may move their paperboard recycling plant to the site.
The following concerns may, or will likely, need to be addressed:
1. NPDES Construction Stormwater Permit NCGO10000 —This permit is issued concurrently with
an approved Sediment and Erosion Control plan to control stormwater discharges from
construction activities. If the proposed project will disturb greater than one acre, an NCGO 10000
permit is required.
2. 401 Water Quality Certification — If a 404 permit is required by the Army Corp of Engineers, a
401 Water Quality Certification is necessary. Depending on the amount of impact to a stream
and/or wetland —written concurrence from this office maybe required. The information provided
in the scoping document does not indicate impact to surface waters or wetlands, and appears to
be only building renovation; therefore, a 4041401 would not be required.
3. Wastewater Treatment — McDowell County and/or Rock -Tenn should ensure that the City of
Marion Wastewater Treatment Plant can accommodate wastewater generated at the plant (be it
domestic and/or industrial wastewater).
Industrial Stormwater — Rock -Tenn may be required to apply for a categorical stormwater permit
for paperboard/recycled paper products (NPDES Stormwater Permit NCG050000). Per Chuck
Cranford of this office, it is likely that the facility would qualify for a "no exposure" permit.

Subject: Proposed McDowell Green Energy, LLC Solar Generating Facility
Project No. 11-0253
McDowell County
McDowell Green Energy, LLC proposes to construct a 5 MW Solar Generating Facility (and associated
appurtenances) on the McDowell Technical Community College Campus near I-40 and Highway 226.
The following concerns may, or will likely, need to be addressed:
NPDES Construction Stormwater Permit NCGO10000 — This permit is issued concurrently with
an approved Erosion and Sedimentation Control plan to control stormwater discharges from
construction activities. If the proposed project will disturb greater than one acre, an NCGO 10000
permit is required.
2. 401 Water Quality Certification (WQC) — If a 404 permit is required by the Army Corp of
Engineers, a 401 Water Quality Certification is necessary. Depending on the amount of impacts
to a stream and/or wetland — written concurrence from this office may be required. Stormwater
Best Management practices (also known as post construction stormwater controls) may also be
required with the 401 WQC, depending on the amount of impervious surface impacts.
3. McDowell County/Marion - If they have not done so already, McDowell Green Energy, LLC (or
its consultant), should contact McDowell County (and/or the City of Marion) to ensure
compliance with any local government requirements.

Environmental Scoping Comments
McDowell County
The City of Marion proposes to extend water and sewer lines along Sugar Hill Road between the Marion
City limit and Interstate 40.
The following concerns may, or will likely, need to be addressed:
NPDES Construction Stonnwater Permit NCGO 10000 — This permit is issued concurrently with
an approved Sediment and Erosion Control plan to control stormwater discharges from
construction activities. The proposed project will likely disturb greater than one acre, so an
NCGO10000 permit is required.
401 Water Quality Certification — If a 404 permit is required by the Army Corp of Engineers, a
401 Water Quality Certification is necessary. Depending on the amount of impact to streams
and/or wetlands along the proposed routes — written concurrence from this office may be
required. The DWQ is unsure if jurisdictional waters or wetlands will be impacted by the
proposed routes — this should be confirmed prior to impacts to the site.
The City and/or its consultant should ensure that appropriate permits for the proposed sewer line
extension are obtained from the Division. The City and/or its consultant should also contact the
Division of Environmental Health/Public Water Supply regarding any permit issues pertaining to
water distribution.
4. The Division of Water Quality understands that the City of Marion's wastewater treatment
system has ample capacity for the increase in wastewater from the sewer.
