Marion, NC 28752 Subject: Wastewater Disposal for Single Family Residence Alternatives and Options Dear Mr. Whitson: Enclosed please find a Notice of Intent (NOI) to obtain coverage under General Permit NCG550000. In order for the Division of Water Quality to comply with 15A NCAC 2H .0105 (c) (3), all other wastewater treatment and disposal alternatives must be explored prior to considering a discharge option. As specified in sections 8 and 10 of the NO[ the following criteria must be met: ® A statement of a lack of community sewer availability (municipal or other) for the proposed residence. • A I etter f rom the McDowell County Health Department describing the suitability or non - suitability of the site for all types of wastewater ground adsorption systems including land application such as spray irrigation or drip irrigation. . ® A justification from the applicant that no adjacent or additional property is available for any of the above types of disposal system. This should be both a financial justification and an environmental justification including the above criteria.. In some instances a North Carolina Licensed Soil Scientist may be able to further evaluate a site and provide a statement of suitable site conditions that may then be provided to the local health department for their further consideration. As newly constructed wastewater treatment and disposal systems must include a septic tank, primary and secondary (or re -circulating) sand filters, disinfection, and post aeration apparatus. The proposed applicant may choose to obtain (not required) the services of a North Carolina Licensed Professional Engineer to design and supervise the installation of the subject wastewater treatment system. The submitted application must include plans and specifications for the proposed wastewater treatment system. As the Division of Water Quality considers any form of discharge to be the least desirable option, the Asheville Regional Office will only consider an application that includes all of the above listed materials. Once you have obtained the required statements please contact me at 828-251- 6208 to setup an onsite meeting. Ross Jr., Secretary As part of the North Carolina Ecosystem Enhancement Program's (EEP) effort to update the 1998 Basinwide Wetlands and Riparian Restoration Plan for the Catawba River Basin, EEP Watershed Planners are identifying Targeted Local Watersheds within the Basin. This memo is to solicit your comments and recommendations regarding our Draft picks for Targeted Local Watersheds. Targeted Local Watersheds (TLWs) are 14-digit hydrologic units where restoration projects are likely to be most effective in improving and protecting water quality [and other vital watershed functions such as flood control and aquatic habitat]. At this scale, the EEP can best focus its resources for stream, riparian buffer, and wetlands restoration projects within local watersheds. The basic criteria we use to target these local watersheds are whether they have (a) the need for restoration (e.g., declining or impaired water quality or habitat]; and (b) the opportunity for cost-effective restoration projects [e.g., potential collaboration with local government and/or existing project efforts]. The EEP has in the past held meetings in the Basin to solicit local input on the update of the basin's Watershed Restoration Plan -- including potential TLW selections, revised -goals and objectives, and potential restoration opportunities. Due to budget concerns. we would Rrefer at this time to solicit input in writing and by telephone as opposed to holding meetings. We have enclosed maps and information outlining the first cut of'draft TLWs, and hope in this way to. encourage feedback and ideas from those of you out in the field who might have specific local knowledge to add to the selection process. The EEP is currently compiling and reviewing water quality, land use, and sensitive resource information for the Catawba River Basin including information obtained from public workshops held by the NC Division of Water Quality in September of 2003. Our basic goals are to identify high -priority TLWs within the Catawba River basin and to identify potential candidate sites for wetlands, stream, and riparian buffer restoration projects. Targeted Local Watersheds are also selected on the basis of future restoration need and opportunity within the basin. While the EEP currently has compensatory mitigation payments in the fund for restoration projects within certain areas within the Catawba Basin, we are also identifying areas that will be appropriate for restoration in the event future mitigation needs are incurred in other areas of the basin. It is anticipated that additional information to support the selection of some of these TLWs will be obtained during field visits to certain local watershed sites planned for the next few months. These FINAL selections represent those areas where the ESP's resources for restoration projects will be focused over the next four .years, contingent upon the availability of restoration funds. In addition, the EEP hopes that these local watershed selections can help foster collaborative watershed restoration efforts between government and non-profit ,groups working on restoration activities in the basin. Sandra Holland wants to cause a stink before the asphalt plant slated for her neighbor- hood can. Her problem with the factory is -two -fold. The longtime resident of Sta- cey Hill Road, whose property is right across the creek from the site, worries the operation will smell bad, cause too much noise and dirty air and water in the area. It also bothers Holland that Maymead Materials Inc., a Ten- nessee corporation that oper- ates another asphalt plant in Woodlawn, didn't make a better effort to let the community or the county know about it earlier. The company plans to build on U.S. 70 East before getting an air -quality permit — which is required to open an asphalt factory — from the state. North Carolina law allows companies like Maymead to do some work on such sites before the per- mit comes through, something McDowell commissioners take is sue with. They decided last week to try to stymie the ore--o-H peer construction lay denying s, co iity building permit and the state to Make similar stej. s The pre -permit wort.-nea).1s Maymead must be pretty siire they'll get the OX from the state, said County Manager Chuck Abernathy. Otherwise, they wouldn't.be sinldng money into the project. In other words, no one is concerned about not being able to open, no matter what the public says in required hearings. Companies can grade and (See COMPANY, Page 2) Company (Continued from Page 1) clear, construct access roads, driveways and parking lots, put in pipe work and underground utilities and construct fences or office buildings that won't house anything that could contaminate air and won't include any air -fil- tration systems. Before doing so, they have to inform the public. To fill that requirement, Maymead took out classified ads in The McDowell News, which is how Holland found out about their plans. Holland and her neighbors use well water. A creek runs near the lot where the plant will go — and often floods the field. Her son has asthma, and neighbors also have breathing problems. She thinks a factory plans asp churning out the smelly sub- stance so close by can only hurt them. It won't help property values, either. Those went up after the county's last revaluation. But if residents decide to sell after -the factory goes up, Holland doesn't believe they could get as much for their places as the county says they're worth. One reason she and many of her neighbors bought their property in the first place was because the owner of the field where the factory wants to lo- cate assured them he would not sell.. The residential area, which doesn't. have any zoning to. keep business or industry out, has a big population. Traffic is often heavy — too heavy to accom- modate the trucks that would halt plant go in and out, said Holland — and a sharp curve often causes wrecks. Everyone in her neighbor- hood is concerned, she said, and many are ready to sign a petition to try to keep the business out. In addition to some of Hol- land's worries over the two-lane road and the residential area, commissioners are unhappy that construction would begin before - anyone who lives in the area gets an opportunity to weigh in — and that the law allows it. At a special -called meeting, county commissioners recom- mended asking lawmakers to consider changing the statute that allows construction. to start before the state issues the necessary permits. They also decided not to let Maymead get a county building permit for an for Neb® office building, as well as to en- courage the N.C. The reason for the.inspection was to respond to a anonymous complaint that Genei Industries was dumping cleaning solutions into the Town's wastewater collection system in violation of the Town's sewer use ordinance and the State's Administrative Code 15A NCAC 2H 0.0900. During the inspection Mr. Blalock and I determined the complaint was unfounded and the facility appeared to be compliant at the time of the inspection. Please, note that the contents of the solution tank for the washer should never be dumped to the sewer system. The purpose of the letter is to inform you of the Division of Water Quality's intentions with regards to the Church's Pump and Haul permit. First of all, the Division has not received an application from the. Church, but we understand that they intend to apply. This type of permit is issued for a six (6) month period and is not automatically renewable. Furthermore, this Permit is only issued when a permanent solution is assured. It is our understanding that the East Marion Sewer Project, being developed by the County, has been approved and will be constructed in the near future. I understand the Church has written approval to connect to this sewer, once constructed. Therefore, I foresee no problem issuing the Church a Pump and Haul for their new addition,.with the understanding that the Church connects to the new sewer as soon as possible. During the inspection it was noted land -disturbing activities on your property are responsible for both turbid stream conditions and sediment deposits in Mackey Creek. Accordingly, Mr. Frost collected upstream and downstream water quality samples. The data gathered on site confirms thefollowing violations: 1) stream standard violation for turbidity and 2) stream standard violation for removal of best usage. Item 1: TurbiditV Violation Mackey Creek, a Class C stream, has been impacted by turbidity below the confluence of Laurel Creek by land -disturbing activities. Water Quality samples gathered on August 27, 2002 indicate an increase in turbidity below the land -disturbing activities of >250 Neophelometric Turbidity Units (NTU). The land -disturbing activities have resulted in a stream standard violation. Specifically, 15A NCAC 2B .0211 (3) (k) which states "the turbidity in the receiving water shall not exceed 50 Neophelometric Turbidity Units (NTU) in streams not designated as trout waters..." The activities have resulted in a stream standard violation. Specifically, 15A NCAC 02B .0211 (1) and 15A NCAC 02B .0211 (2), state that the preclusion of best usage, which include, aquatic life propagation, biological integrity (including fishing and fish), wildlife, secondary recreation and agriculture, represent a water quality standard violation. Please note that the above mentioned violations or future violations are subject to the possible assessment of civil penalties of up to $25,000.00 per day, per violation. This office request that you respond with an explanation for these violations, in writing, within ten (10) days of receipt of this Notice. Your response should address the following items: (1) The details regarding when the stream impacts occurred and the extent of the land - disturbing activities. (2) Discuss the above violations and how you intend to achieve compliance. The Division of Water Quality (Division) is in the process of continuing to review the compliance status of this site with the Division of Land Resources. As a part.of this review, a determination of the land disturbance size and the respective compliance with the Division's General Stormwater Permit for construction activities (NCG010000) will be considered. Finally, the Asheville Regional Office of the Division of Water Quality, is considering sending a recommendation for enforcement to the Director of the Division of Water Quality regarding these issues and any future or continued violations that may be encountered. After viewing the stream from his property and the adjacent National Forest Service land, I am extremely concerned about the effects this will have on trout and other species within Mackey Creek. I was unable to view the disturbed land upstream from these properties, but it is pretty apparent that there is a heavy silt load entering the stream. According to our records, there is a naturally reproducing population of brown trout within this portion of Mackey Creek. I am concerned that if this land disturbance is not immediately stabilized, there will be significant negative impacts to brown trout spawning this fall. I know you all have done several site visits yourselves, but I just wanted to let you all know of our concerns. Additionally, it sounds like you all may be having some trouble tracking down the exact property owner that has created this problem. After talking with Mr. Jack Taylor yesterday, it appears that he has records that may help you all out. Mr. Taylor also claims to know the contractor that was responsible for the land disturbance. He asked for you all to give him a call at 828-652-5770 if you need any information regarding these issues. Thanks for your assistance with this matter and please let me know if I can be of any help on this end. This inspection was performed to determine compliance with the North Carolina Sedimentation Pollution Control Act of 1973. The inspection revealed a land -disturbing activity of approximately 7± acres being conducted. It is our understanding that you and/or your firm are responsible for this land -disturbing activity. The purpose of this letter is to inform you that this activity was found to be in violation of the Act, NCGS § 113A-50 to 66, and Title 15A, North Carolina Administrative Code, Chapter 4. -If you feel that you are not responsible for the following violations, please notify this office immediately. 1. Failure to file an acceptable erosion and sedimentation control plan with this office' at least 30 days prior to beginning a land -disturbing activity on a tract comprising more than one acre; failure to secure this office's prior approval of the plan for any land -disturbing prior to beginning the land -disturbing activity. and NCGS § 1 13A-54(d)(4), NCGS § 113A-57(4) and 15A NCAC 4B.0007(c). An erosion control plan for the project has not been submitted to this office. An acceptable erosion and sedimentation control plan must be filed with and approved by this office and implemented on the site sufficient to prevent offsite sedimentation. Pending approval of the plan, temporary measures must be provided immediately to control erosion and prevent sedimentation damage. Any additional land -disturbing activities conducted without an approved erosion and sedimentation control plan will constitute additional violations of the Act. We will notify you following our review of the plan if additional measures are required. 2. Failure on a tract of more than one acre, when more than one acre is uncovered, to install sedimentation and erosion control devices sufficient to retain the sediment generated by the land - disturbing activity within the boundaries of the tract during construction upon and development of the tract. Offsite damage has occurred due to sediment washing into Mackey Creek and a tributary to Mackey Creek. 4. Failure to retain along a lake or natural watercourse a buffer zone of sufficient width to confine visible siltation by natural or artificial means within the 25 percent of that portion of the buffer zone nearest the land -disturbing activity. NCGS § 113A-57(1). Sediment from the site has entered Mackey Creek and a tributary to Mackey Creek traversing the site. To correct these violations, you must prepare and submit for approval an erosion control plan for the site and fully implement that plan upon its approval. In the interim pending approval of the plan, you must immediately provide measures on site sufficient to protect adjacent property and watercourses as there is potential for damage to occur before a plan can be prepared, reviewed, and implemented. After installation, all erosion control measures must be maintained in proper working order until development is complete and the site is completely stabilized. Please be advised that if these violations are not corrected on or before September 27, 2002, the Director, Division of Land Resources, will be requested to take appropriate legal actions against you pursuant to NCGS § 113A-64. That action could be the assessment of a civil penalty and the amount may be up to $ 5000.00 per day for each day of the violation. The penalty may be assessed from the date the violation is detected (NCGS § 113A-61(a) (1). If these violations are corrected within the time period specified for compliance, no further legal action will be pursued. Please be advised that any new land -disturbing activity associated with this project must not begin until the area presently disturbed is brought into compliance with the Act. When corrective actions are complete, you should notify this office so the work can be inspected. You should not assume that the property is in compliance with the Act until we have notified you. Location: On SR1214 (Old Greenlee Road) 100 yards from where Jakes Creek crosses and 100 yards from the confluence of Jakes Creek and the Catawba River. Site: It appeared the car rolled off the tracks separating itself from the running gear and landing on its side. The tanker was laying the middle of SR1214. Blocking the road. Spill: The spill was of approximately 500 gallons (according to Mark Scott of HEPA Environmental — out of Charlotte 800/888-7689). The chemical was a "mild" cleaning compound known as P2O, manufactured by BASF in Spartanburg, SC and was being delivered to Proctor and Gamble. The pH was reported as 7.0. Response: Emergency response was from the McDowell County authorities, LEPC Carroll Hemphill and Norfolk Southern, Gilbert Turner environmental engineer and HEPA Environmental from Charlotte. Cleanup: Containment was complete when I arrived (1130 hrs) ditches were diked and a containment basin was in place below the man head. None of the P2O appears to have reached Jakes Creek. There was some leakage at the man head, that was being caught. N S was repairing the tracks and HEPA was monitoring the leakage. Gilbert Turner informed me by phone that a tanker was being brought in on Sunday to pump the P2O off to and HEPA informed me that the tanker was to be righted via a 70 ton crane. Within. the purview of the Division of Environmental Management are the source and -disposal of the groundwater used as a heat source for these units. The construction -of wells as a source of water, for geothermal Beat pumps is gov- erned by the Well Construction Standards set forth in the North -Carolina Adminis- trative Code 15-ACAC c., The Source we(ti -for a..geothormal heat pullip must 'meet the same requirements as any other water supply well constructed in North *Carolina.. The disposal of discharge water, from a geothermal heat pump may be accomplished by two viable alternatives, discharge i n;to a surface water body or a recharge well. Since the installation and operation of any recharge well increases Vje potential for adverse impact on groundwaters, options using other means -of disposal are pre- ferred, The,di.scharge from a geothermal heat pump, does not constitute the discharge of pollutants as defined by the statutes re'Iating to the issuance of discharge permits (GS 143-215.1). The no NPDCS-Permit will be,required for su.ch a discharge to the -surface waters of the State. Should the discharge of these waters be via.' a storm sewer system, the agency responsible for the system may require authoriza- tion prior -to initiation of the flow.. kinder unusual circumstances where no other option is available, the discharge may 4e directed into a sanitary sewer system, but only by written authorization from ;the agency responsible for the;.system prior to initiation of the flow. -Under no circumstances should the discharge of these waters be into a septic tank system.
