REGAN Secretary BRIAN WRENN Acting Director Corrine Wilson, PE Hazen and Sawyer 4011 Westchase Blvd, Suite 500 Raleigh, NC 27607 NORTH CAROLINA Environmental Quality August 11, 2020 Subject: Request for Additional Information Stormwater Permit No. SW5200702 Snow Hill Road Pump Station Durham County Dear Ms. Wilson: The Division of Energy, Mineral and Land Resources (DEMLR), received a Stormwater Management Permit Application for the subject project on July 13, 2020. A review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: The Falls Lake Nutrient Strategy requires stormwater systems to be designed to control and treat at a minimum the runoff generated from all surfaces in the project area by one inch of rainfall [ 15A NCAC 02B .0277(4)(e)]. The definition of runoff treatment requires this runoff to be treated in a primary SCM [15A NCAC 02H .1002(43)]. There is no provision in the Falls Lake Rules that allows for low density developments. 2. Please explain why the nutrient reduction portion of the review was submitted to the Department but the TSS and peak flow requirements were submitted to the local review program. The Falls Lake Rules include TSS and peak flow requirements. 3. Please complete the Applicant's Certification section of the SWU-101 Application Form. 4. Please submit a Supplement EZ form for the site. The Supplement EZ form is required for all developments, including low density. The Supplement EZ form can be found on the Stormwater Design Manual website. 5. Please submit an Operation and Maintenance Plan and Agreement. The O&M EZ form has options for both high and low density. The O&M EZ form can be found on the Stormwater Design Manual website. Provide pdfs of all revisions, 2 hardcopies of revised plan sheets, and 1 hardcopy of other documents. Pdfs must be uploaded using the form at: https:Hedocs.deq.nc.gov/Forms/SW Project_Submittal Please note that this request for additional information is in response to a preliminary review. The requested information should be received by this Office prior to September 10, 2020, or the application will be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee. Please reference the State assigned project number SW5200702 on all correspondence. If you need additional time to submit the information, please submit your request for a time extension to the Division at the contact below. The request must indicate the date by which you expect to submit the required information. The Division is allowed 90 days from the receipt of a completed application to issue the permit. The construction of any impervious surfaces, other than a construction entrance under an approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement action pursuant to NCGS 143-215.6A.
