Thorpe, PhD., Manager Planning and Environmental Branch North Carolina Department of Transportation 1548 Mail Service Center Raleigh, North Carolina, 27699-1548 Dear Dr. Thorpe: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 1,610 square feet (0.037 acres) of wetlands and to remove 2,500 square feet (0.057 acres) of wetland fill for the purpose of replacing Bridge No. 67 (Mill Creek Bridge) on SR 1226. The project shall be constructed in accordance with your application dated 6 September 2004 (received 22 Septembe2004). After reviewing your application, we have decided that this fill is covered by General Water Quality Certifi ation Number 3404. This certification corresponds to the Nationwide Permit 14 issued by the Corps of Engineers. In addition, you should acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval will expire with the accompanying 404 permit, unless otherwise specified in the Water Quality Certification. This approval is valid solely for the purpose and design described in your application (unless modified below). Should your project change, you must notify the DWQ and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to remain valid, you must adhere to the conditions listed in the attached certification. 1.) Upon completion of the project, the NCDOT shall complete and return the enclosed "Certification of Completion Form" to notify DWQ when all work included in the 401 Certification has been completed. The responsible party shall complete the attached form and return it to the 401/Wetlands Unit of the Division of Water Quality upon completion of the project. 2.) The post-construction removal of any temporary bridge structures will need to return the project site to its preconstruction contours and elevations. The revegetation of the impacted areas with appropriate native species may also be necessary. 3.) If the old bridge is removed, no discharge of bridge material into surface waters is preferred. Strict adherence the Corps of Engineers guidelines for bridge demolition will be a condition of the 401 Water Quality Certification. 4.) No live or fresh concrete shall come into contact with waters of the state until the concrete has hardened 5.) During the construction of the project, no staging of equipment of any kind is permitted in waters of the U.S., or protected riparian buffers. N. C. The dimension, pattern and profile of the stream above and below the crossing should not be modified. Disturbed floodplains and streams should be restored to natural geomorphic conditions. 7.) Any riprap used must not.interfere with thalweg performance and aquatic life passage during low flow conditions. 8.) Heavy equipment must be operated from the banks rather than in the stream channel in order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream. 9.) All mechanized equipment operated near surface waters must be regularly inspected and maintained to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids, or other toxic materials. 10.) All work shall be performed during low or normal flow conditions. 11.) Discharging hydroseed mixtures and washing out hydroseeders and other equipment in or adjacent to surface waters is prohibited. 12.) The NCDOT will need to adhere to all appropriate in-water work moratoriums (including the use of pile driving or vibration techniques) prescribed by the NC Wildlife Resourc6s Commission, the US Fish and Wildlife Service, and National Marine Fisheries Service. \ 13.) No in-water work is permitted between February 15`s and September 30th of any year, without prior approval from the NC Division of Water Quality and the NC Wildlife Resources Commission. In addition, NCDOT shall conform with the NCDOT policy entitled "Stream Crossing Guidelines for Anadromous Fish Passage (May 12, 1997) at all times. 14.) A copy of this Water Quality Certification shall be posted on the construction site at all times. In addition, the Water Quality Certification and all subsequent modifications, if any, shall be maintained with the Division Engineer and the on-site project manager. 15.) The outside buffer, wetland or water boundary located within the construction corridor approved by this authorization shall be clearly marked by orange fabric fencing prior to any land disturbing activities. Impacts to areas within the fencing are prohibited unless otherwise authorized by this certification. 16.) There shall be no excavation from or waste disposal into jurisdictional wetlands or waters associated with this permit without appropriate modification of this permit. Should waste or borrow sites be located in wetlands or stream, compensatory mitigation will be required since it is a direct impact from road construction activities. 17.) The NCDOT shall strictly adhere to sediment and erosion control Best Management Practices as described for High Quality Waters entitled "Design Standards in Sensitive Watersheds" (15A NCAC 04B .0024) throughout design and construction of the project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. T Ao? PROJECT SUMMARY: NCDOT proposes to replace Bridge No. 67 on SR 1220, a narrow two-lane bridge in the Town of Winfall, in Perquimans County, North Carolina. NCDOT TIP No. B-4225 September 6, 2004 Page 2 PROJECT SETTING Mill Creek Bridge (Bridge No. 67) is located along State Road 1220, northeast of the Town of Winfall, in Perquimans County. The bridge is situated at the approximate midway point between Winfall and the NCDOT Maintenance Facility at US 17, and is the only bridge along this section of SR 1220. Waters in this area are classified as inland by agreement between the Marine Fisheries Commission and Wildlife Resource Commission. The Division of Environmental Management's water quality classification for the Perquimans and its tributaries is SC (fish propagation). Mill Creek is a tributary of the Perquimans River, which feeds into the Albemarle Sound, and falls within the Public Trust Area of Environmental Concern (AEC). The creek is subject to a February 15th to September 1st moratorium for Anadromous Fish. Visual inspection of the site indicated a high amount of aquatic activity near the bridge. Mill Creek Bridge is an aging narrow bridge constructed in 1924 under State Project No. 180, through a swamp. The construction included the creation of a raised fill road and bridge approach. The clearance under the bridge is approximately 75, and the span is 32'. The existing bridge is a concrete cast single span with a bituminous surface, sitting on deck girders over reinforced concrete abutments. There is no riprap in or around the creek or the existing bridge. The Water depths at the bridge are approximately 4.5', and appear to be absent of any submerged aquatic vegetation. A bottomland hardwood swamp extends out from the creek with the exception of the existing bridge approach and two residences approximately 100' west and northwest of the bridge approach. While there is no known archeological site within the project area, there are a number throughout the county. Sites Pq 50, Pq 51 and Pq 51a are located approximately 2 miles from Mill Creek Bridge, adjacent to the Perquimans River (See Enclosed USGS Map). There are no known unique geological formations associated with this site. PROJECT DESCRIPTION The North Carolina Department of Transportation (NCDOT) proposes to replace Mill Creek Bridge with a longer and wider structure to accommodate traffic needs in the area. The existing bridge is narrow and does not allow for the safe passage of two vehicles at the same time, stopping traffic short of the bridge to allow the passage of a single lane of traffic. According to the application demolition of the existing bridge will be in compliance with the NCDOT Best Management Practices (BMP) Manual. No demolition debris will be placed in water for later removal. The existing bridge dimensions of 32' x 20' will be expanded to 102' x 42'. The grade under the bridge will be cut and widened to increase flow under the new structure, and reduce the possibility of flooding during severe storm events. The increased clear area under the bridge will not include widening the actual creek. The cut area under the proposed bridge totals approximately 335 x 55' 4 NCDOT TIP No. B-4225 September 6, 2004 Page 3 on each side of the creek for a total of 3,685sf, resulting in the removal of approximately 2,500sf of wetland fill placed when the original bridge was constructed in 1924. Neither the plans nor the application indicate that the removal of the fill under the bridge is proposed for mitigation or wetland restoration. Construction of the new bridge will include the installation of two end bents, and two interior bents under the bridge, The interior bents will be placed approximately 26' from the end bents and 50' apart, straddling Mill Creek, 10' to 12' landward of normal water level. The written description in the application indicates that the two interior bents will be placed in water, but the plans submitted indicate that the landward location will be used. Pilings for the bents will be driven to a minimum bearing capacity of 45 tons each. Class II riprap will be placed around the end bents at widths varying from 10' to 20', depending on the severity of the adjacent slope, for erosion control. No riprap is proposed for the interior bents. Two funnel drains will be installed on the east side of the bridges eastern most end bent. ??? a Widening the bridge will necessitat widening the bridge approach, and result in the filling of approximately 1,610 square feet (0. 9 Acres) of non-coastal wetlands. There are no Coastal Wetlands within the project area. It is also important to note that no portion of the new construction will be placed waterward of normal water level. A letter requesting that the Ecosystem Enhancement Program (EEP) provide mitigation for the wetland fill as a part of this project is forthcoming, The total area of disturbance including wetland fill is estimated to be 33,000sf (0.75 Acres). ANTICIPATED INPACTS The project, as proposed, will not involve any construction within Mill Creek. The only work to be preformed within the creek will be the removal of two reinforced concrete abutments. Approximately 1610 square feet of non-coastal wetlands will be filled in association with the new, wider, bridge. In addition to expanding the width of the bridge the bridge will be longer, spanning approximately 100'. The plans include removing old dirt fill, approximately 33.5' on each side of the creek (3,685 square feet), to increase the opening under the bridge. By opening the area under the bridge upstream back flow during severe storm events will be reduced, Based on the drawing there will be no erosion control structure placed along the shoreline once the old concrete abutments have been removed. However, the application states that the work shall comply with the NCDOT BMP Manual. The expansion of the bridge will help alleviate traffic problems at the bridge. The narrow bridge is not able to accommodate two-lane traffic for large vehicles, and trucks. 1 NCDOT TIP No. B-4225 September 6, 2004 Page 4 It is anticipated that there will be temporary localized turbidity within Mill Creek during demolition of the existing bridge.
