As part of an on-going bridge replacement project which did not require a permit, we replaced and extended an existing 24” driveway pipe carrying an unnamed tributary (UT) of Foster Creek adjacent to the bridge. The pipe had to be extended to provide enough ground surface for guardrail installation to meet safety standards. The UT is not shown on the project plans for some unknown reason. Pipe extension resulted in 16 linear feet (lf) of permanent impacts to the UT; approximately 20 lf of the creek were temporarily dewatered during the extension. Temporary impacts overlie the permanent ones. The stream is approximately 10-12” wide and 3” deep with a predominately sand, gravel, and cobble substrate. Foster Creek is classified as Class C; Tr, ORW. Existing channel morphology was maintained upstream and downstream of the pipe. Riparian vegetation will be reestablished along disturbed areas associated with the project. Stormwater will be diverted through grass-lined ditches or vegetated buffers prior to entering streams. This project did not affect the northern long-eared bat (Myotis septentrionalis) (NLEB). Following the SLOPES protocol from NWP Regional Condition 3.13, the project is not located in a red HUC or within 0.25 mile of one. No tree was removed for the pipe extension. No effect on the remaining Madison County list of federally protected species (threatened or endangered) occurred. We request Marla Chambers, North Carolina Wildlife Resources Commission Western Region Coordinator, to comment directly to the Corps concerning the permit request.
