These DMRs are being submitted as the following sample designated in the Tier III section of the permit: As required in Tier III of the Stormwater Plan, Bendel will continue to monitor for all required parameters until such time as the site can demonstrate three consecutive samples that are below the benchmark value for all parameters in a Tier response. Based on the new general stormwater permit, this should be attainable for copper. Once attainment has been reached for copper, Bendel may seek a variance from the Department of Environmental Quality for zinc. Additionally, Bendel has triggered a Tier I response in March for TSS. As designated in the Tier I section of the Permit, Bendel will: • Conduct a stormwater management inspection of the facility within two weeks of receiving results. Identify and evaluate possible causes of the benchmark value exceedance. • Identify potential, and select the specific feasible: source controls, operational controls, or physical improvements to reduce concentrations of the parameters of concern, and/or to bring concentrations within the benchmark range. • Implement the selected feasible actions within two months of the inspection; and o Record each instance of a Tier One response in the SPPP, including the date and value of the benchmark exceedance, the inspection date, the personnel conducting the inspection, the selected actions, and the date the selected actions were implemented.
