Dear Mr. Ingram:
This letter is in regard to your prospectus document for the proposed Walnut Wood Mitigation
Site (dated February 2018), a modification to the RES Cape Fear 02 Umbrella Mitigation Banking
Instrument (UMBI). The proposal consists of the establishment and operation of a 38.4-acre
commercial stream mitigation bank located within the Climax Creek watershed in the Cape Fear
02 River Basin (Haw River Basin), east of the intersection of Alamance Church Road and Coble
Church Road, in Julian, Guilford County, North Carolina (Latitude 35.9808°N, Longitude
-79.6446°W).
The Corps determined the Prospectus was complete and issued a public notice (P/N 9 SAW-
2017-01470) on May 3, 2018. The purpose of this notice was to solicit the views of interested
State and Federal agencies and other parties either interested in or affected by the proposed work.
Attached are comments received in response to the public notice from the U.S. Fish and Wildlife
Service and the North Carolina Division of Water Resources.
The Corps has considered the comments received from members of the Interagency Review
Team (IRT) and information that was discussed during an IRT site review on March 15, 2018.
We have determined that the proposed mitigation bank appears to have the potential to preserve
and enhance aquatic resources within the Cape Fear 02 (Haw River) 8-digit Hydrologic Unit
Code (HUC) 03030002 of the Cape Fear River Basin. Therefore, the bank sponsor may proceed
with preparation of a draft UMBI.
Please provide a response to the attached comments with your draft UMBI submittal. We
appreciate your interest in restoring and protecting waters of the United States. If you have
