aluminum culvert at an existing neighborhood road crossing. The proposed
project includes adding a concrete baffle and larger rip rap to create a 12-
inch bury of the culvert, improving slopes at the culvert inlet and outlet, and
improving the riprap dissipator pad at the culvert outlet.

at the letterhead address within ten (10) days of the commenoeMent of construction.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. Ae authorization to proceed with your proposed impacts or to conduct
impacts to welters as depicted in your application and as authorized by this Certification, shall expire upon
expiration of the 404 or CAMA Permit.
if you do not accept any of the conditions of this Certification (associated with the approved wetland or
stream impacts), you may ask for an adjudicatoiy hearing. You must act within 60 days of the date that
you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of

This office has completed its review and hereby approves the subject plans received at this office July 23, 2007
for compliance with current Department of Transportation minimum subdivision construction standards.
It is the responsibility of the owner/developer to provide verification certifying that the completed subgrade and
base course meet NCDOT requirements. This certification shall be conducted by a professional engineer and
shall include the following: proofrol ling of subgrade and base course. (Reference attached construction
guidelines)
The paving of this roadway shall be in accordance with the revised NCDOT 2006 Standard Specifications,
Sections 610, 1012 and 1020. The Contractor shall follow all procedures of the attached Quality Management
System (QMS) for asphalt pavement - Maintenance Version. The Contractor must adhere to all testing
requirements and quality control requirements specified. The Contractor shall contact the NCDOT Division 5
QA Supervisor at (919)-562-0018 prior to producing plant mix and make the Supervisor aware that the mix is
being produced for a future NCDOT road. Only NCDOT approved mix designs will be acceptable. A quality
control plan shall be submitted to the District Engineers' Office prior to asphalt production. Use form QMS-
MVl for the Quality Control Plan submittal. Failing mixes and/or densities are subject to penalties including
monetary payments or removal and replacement.
The North Carolina Department of Transportation does not add roads to its system unless they meet the
requirements of the current (January 1, 2000) NCDOT Subdivision Roads Manual. Please be aware that only
North Carolina Department of Transportation approved structures are to be constructed on public right of ways.
The Department will not be held responsible for damages to sprinkler systems placed within the right of way and
reserves the right to remove any system that adversely affects safety or maintenance of the roadway. The
Department will not be responsible for the perpetual maintenance of BMPs. Since these requirements are the
responsibility of the owner/developer, we ask that you provide them with a copy of this letter. Feel free to

Subdivision Construction Guidelines
The construction, including all materials used within, Rose Hall Subdivision — Phase 2 roadways shall be in accordance
with NCDOT's 2006 Standard Specifications far Roads and Structures and NCDOT's 2006 Roadway Standard
Drawings. These manuals may be obtained from the Design Services Branch at the Century Center Complex Building
B off of Poole Road. Contact Kim Canady at 250-4124 or go online tow.uw.dolt.dot.state.ne.usfguidelinm.
Production and inspection of asphalt plant and roadway operations shall be in accordance with the latest Quality
Management System (QMS) for asphalt pavements - Maintenance Version. The Department's Division Quality
Assurance Lab Supervisor, .Ian Womble (919-562-0018), shall be advised prior to asphalt production and form QMS-
MV I shall be submitted to the District Engineers' Office prior to asphalt production.

All Roadway Technicians supervising asphalt work shall be certified by NCDOT. Guidelines can be viewed at

The Engineer shall be responsible for all construction inspection, field materials sampling and testing, and
communication and coordination with NCDOT's District Engineer.
The Engineer shall be familiar with NCDOT's standard procedures and practices as set forth in the Department's
Construction Manual, Standards and Specifications, Roadway Standard Drawings, and Materials and Tests- Manual.
The Engineer shall work under the general guidance and direction of NCDOT's District Engineer.
The Engineer shall keep detailed and accurate records of the Contractor's daily operations.
The Engineer shall maintain records of all sampling and testing accomplished.
The Engineer shall verity that all work is being performed in accordance with the Department's Specifications and
guidelines.
The Engineer shall provide verification signed and sealed certifying that construction meets NCDOT's requirements.
Certifications shall include, but not be limited to the following:
Embankment Compactions: Every 5000 cubic yards or fraction placed
Subgrade Density: Every 1000 linear feet per travel lane (In Subdivisions proofroll all lanes will
also be required)
ABC Sampling shall be performed according to NCDOT guidelines for projects exceeding
2500 tons.
Stone Base Density: Every 1000 linear feet per 28 foot width (In Subdivisions proofroll all lanes
will also be required)
Stone Base Thickness
Asphalt Density: In Accordance with QMS Specifications,
Nuclear density results are not accepted with out control strip results.
Asphalt Thickness must be verified by taking cores
Asphalt Certifications shall be submitted via form QMS-MV2
All drainage pipes, precast concrete, cast iron fittings, and guardrail must be pre -approved by NCDOT's material and
test section prior to shipping to construction site. An engineer or certified technician shall verify that all pipe used was
properly marked by NCDOT when the material arrived on construction site.
All structural stormwater BMP's and associated access/maintenance easements shall be depicted on a final subdivision
plat which is recorded with the county Register of Deeds. The operation and maintenance agreements shall be
referenced on the final plat and shall be recorded with the county Register of Deeds upon final plat approval.
All structural stormwater BM P's shall be located outside of the NCDOT Right -of -Way. A permanent public drainage
easement shall be established outside of the NCDOT Right -of -Way by the designer for access to the BMP's. The
NCDOT assumes no responsibility for the operation, maintenance or liability of the structural stormwater BMP's.
All drainage pipes, precast concrete, cast iron fittings, and guardrail must be pre -approved by NCDOT's material and
test section prior to shipping to construction site. An engineer or certified technician shall verify that all pipe used was
properly marked by NCDOT when the material arrived on construction site.
The developer shall be responsible for the installation of all required signage in accordance with NCDOT Standards
Any plan changes shall first be approved by the District Engineer.

Diehl & Phillips, P.A. designed the subdivision streets for Rose Hall Subdivision Phase 2 in
2007. Cadenza Lane in Phase 2 included an 84-inch aluminum culvert crossing of a branch that
carried Neuse Riparian Buffers. The 84-inch culvert crossing was the subject of a flood study as
required by Wake County, and Neuse Riparian Buffer impacts (letter attached). All required
environmental permits were obtained and followed during construction to the best of our
knowledge. NCDOT reviewed and approved the plans for construction of Phase 2 streets (letter
attached). The project was constructed and a "Built to Standards" letter was issued by the
NCDOT District Office on October 9, 2008 (copy attached).
A 72-inch culvert was required hydraulically for the Cadenza Lane crossing in Phase 2. An 84-
inch culvert was approved so that the culvert could be buried 12 inches as required by the
environmental permitting. The inverts of the 84-inch culvert were designed 12 inches below the
existing channel to achieve the 12-inch burial requirement. The rip rap dissipator on the
downstream end of the culvert was set 12 above the culvert invert out with the intent of creating
a dam to promote filling the bottom of the culvert with sediment. The 84-inch culvert installation
was surveyed following construction to verify that the elevations matched the design. The
survey confirmed that the culvert was set such that the flood elevations matched the approved
flood study and environmental requirement (see attached certification). Thus, the 84-inch culvert
was constructed as designed and approved by regulatory agencies.
Our firm visited the culvert installation in June, 2020 at the request of the Rose Hall
Homeowners Association. We were given a copy of a October 16, 2015 memo from Bridge
Maintenance to your office regarding items required for correction for street maintenance
acceptance (copy attached). Enclosed with this letter are plans and details to address the items
listed in the Bridge Maintenance Memo. The following are proposed:
1. The culvert is set at the proper elevation per the certification. A concrete baffle wall and
larger rip rap are proposed to create the 12-inch bury (sedimentation) of the culvert as
originally intended. The void area under ends of the culvert would be grouted.
2. The slopes at the inlet end would be improved by installing rip rap lined channels on
either side to replace the original channels. Filter fabric would be installed under the
channels and the new rip rap at the culvert entrance.
3. The slopes on either side of the outlet end of the culvert would be improved by installing
rip rap lined channels on either side of the culvert. The dissipator for culvert would be
improved by adding Class 1 rip rap and filter fabric. The rip rap would be placed against
the baffle wall for added stability.
4. The gouges in the top of the pipe were observed. No water, seepage, or soil was evident
from any of the damaged sites. Further, it appears that the gouges were repaired during
construction by adding structural elements on the outside of the culvert to seal the
gouges. Since the structure appears to be sound, we do not propose corrective action.
We request that you review the plan and notify us if the N.C. Department of Transportation will
allow the proposed measures to satisfy the deficiencies noted. Contact our office if you require
