Everhart, PhD, CWB Southeastern Permit Coordinator Habitat Conservation Program Date: March 27, 2007 RE: Harnett 27, LLC - Stoneridge, 401/404 Application, Harnett County, DWQ#07- 0434 Biologists with the North Carolina Wildlife Resources Commission (NCWRC) have reviewed the subject application for impacts to wildlife and fishery resources. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.), and Sections 401 and 404 of the Clean Water Act (as amended). The project is located on the north side of NC 27, approximately 1 mile east of its intersection with MacArthur Rd. (SR 1213), in Harnett County. The property consists of approximately 206 acres including approximately 45 acres of wetlands and 3,551 linear ft of streams including Hickory Branch and Barbecue Creek, a tributary to the Upper Little River. Land use in the vicinity includes undeveloped, agricultural, and residential. The subject property is currently undeveloped. The applicants propose to impact approximately 0.1 acre of wetlands and 2571inear ft (0.04 acre) of stream through filling/culverting to provide infrastructure fora 299-lot subdivision. The applicants propose to mitigate for impacts through stream and buffer restoration preservation on- site. Mailing Address: Division of Inland Fisheries 1721 Mail Service Center Raleigh, NC 27699-1721 Telephone: (919) 707-0220 Fax: (919) 707-0028 Harnett 27 - Stoneridge Subdivision 2 March 27, 2007 We have the following concerns/recommendations: • We recommend that 50 and 100 ft native forested buffers be maintained or created on each side of intermittent and perennial streams, respectively. • The NCWRC does not support the filling of wetlands for development and any required permit authorization will receive a recommendation for denial unless the project has significant public benefits and all wetlands or aquatic habitat impacts are fully mitigated. We recommend that all remaining on-site wetlands, streams, and buffers be preserved using the proposed deed restrictions included in the application.
