Dear Mr. Nobles:
On September 16, 2016 the Division of Energy, Mineral, and Land Resources (DEMLR)
received your application for modification to a Certificate of Coverage under the State
Stormwater General Permit Number SWG060000. In accordance with your application request,
we are forwarding herewith the subject Certificate of Coverage (COC) Number SWG060004,
along with a copy of the General Permit, for the construction of built -upon area associated with
this low density project. This COC replaces all previously issued COC's issued for this site. The
General Permit is issued pursuant to the requirements of North Carolina General Statute 143-
215.1, Title 15A NCAC 211.1000.
Please pay particular attention to:
1. Enclosure 1: Permit condition Section B.1 requires the Permittee to notify the
Division at least forty-eight (48) hours in advance of commencing construction of
the permitted project.
2. Enclosure 2: Permit condition Section B.3 requires that a designer's certification
and as -built drawings for the project be submitted to the Division within 30 days
of completion of the permitted site grading, road construction, sidewalks, and
stormwater conveyance system, and prior to the sale of or construction on any
lot.
3. Enclosure 3: Permit condition Section B.6 requires the Permittee to routinely
update the Master Plan of development and/or the submitted site plan by March 18'
of each year, beginning not later than one (1) year from the COC effective date,
and ending when the project is completely built per the approved plans. The
Permittee shall submit project BUA status and all changes to the Division for
review using the provided Annual Permittee Certification Form.
Permitting of this project does not constitute an acceptance of any part of the project that does
not meet the stormwater rules unless specifically mentioned herein. Division approval of this
project is based on acceptance of the certification provided by an appropriate North Carolina
licensed professional in the application. It shall be the Permittee's responsibility to ensure that
the as -constructed project meets the appropriate design criteria and rules. Failure to comply
may result in penalties in accordance with North Carolina General Statute §143-215.6A through
§143-215.6C and/or referral of the North Carolina licensed professional to the appropriate
licensing board.

This permit shall be effective from the date of issuance until rescinded and shall be subject to
the conditions and limitations as specified therein, and does not supersede any other agency
permit that may be required. Please pay special attention to the conditions listed in this permit
regarding the Operation and Maintenance of the BMP(s), recordation of deed restrictions,
procedures for changes of ownership, and transferring the permit. Failure to establish an
adequate system for operation and maintenance of the stormwater management system, to
record deed restrictions, and to follow the procedures for transfer of the permit, will result in
future compliance problems. This cover letter shall be considered part of this permit and is
therefore incorporated therein by reference.
Please take notice that this Certificate of Coverage is not transferable except after notice to and
approval by the DEMLR. The DEMLR may require modification or revocation and reissuance of
the Certificate of Coverage.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing by filing a written petition with the Office of
Administrative Hearings (OAH). The written petition must conform to Chapter 150B of the North
Carolina General Statutes, and must be filed with the OAH within thirty (30) days of receipt of
this permit. You should contact the OAH with all questions regarding the filing fee (if a filing fee
is required) and/or the details of the filing process at 6714 Mail Service Center, Raleigh, NC
27699-6714, or via telephone at 919-431-3000, or visit their website at www.NCOAH.com.
Unless such demands are made this permit shall be final and binding.

In compliance with the provisions of North Carolina General Statue 143-215.1, as
amended, other lawful standards and regulations promulgated and adopted by the North
Carolina Environmental Management Commission, and 15A NCAC 2H.1000, SL 2008-211,
and SL 2006-246, the Stormwater Rules,
D & J Properties of New Bern, LLC
is hereby authorized to construct 54,762 square feet of built -upon area on a site containing
12.24 acres located at:
Jill's Pet Gallery
1580 Old Airport Road, New Bern, NC, Craven County
and to discharge stormwater to receiving waters designated as Scotts Creek, a class SC;
Sw, NSW water in the Neuse River Basin, in accordance with the provisions of the General
Permit for a Low Density Development, No. SWG060000, and the submitted stormwater
management plans and specifications, and other supporting data as attached and on file
with the Division of Energy, Mineral, and Land Resources and considered a part of this
permit for the subject project.
This certificate of coverage shall become effective October 24, 2016 and replaces all
previously issued COC's for this site.
This Certificate of Coverage shall remain in effect for the duration of the General Permit
SWG060000.

ANNUAL PERMITTEE's LOW DENSITY CERTIFICATION FORM
(Yearly Submittal to DEMLR is required until Construction of the Permitted State Stormwater
Project Site is Complete).
I / We hereby certify the following:
1. All clearing, grading, construction, development and operation/maintenance of the
temporary and permanent stormwater system will be done pursuant to the following
permits and approvals:
a. State Stormwater Permit # or Low Density GP COC#:
b. Phase Name or # (if applicable)
2. All personnel involved in the construction of this permitted project have been trained
on all state stormwater requirements associated with this permit.
3. The recorded covenants and deed restrictions for this development include the
restrictions outlined in the state stormwater permit, including the specific BUA limits
for each lot.
4. These covenants and deed restrictions have been recorded with the appropriate local
government office. Check which applies below:

5. Upon purchase of the lot, each new lot owner has received a copy of the covenants,
deed restrictions, and a copy of the stormwater permit. The lot owner has read the
documents and indicated by signature that they have received the documents and have
read and understand the stormwater restrictions and the BUA limit for their lot.
(DEMLR reserves the right to request copies of these documents for proof of
compliance with the State Stormwater permit listed above).
6. The proposed construction on each lot has been reviewed and approved by the
permittee and/or Architectural Review Board. The currently occupied lots are in
compliance with the approved grading plan and permitted BUA limits. Vegetated
conveyances have not been altered from their original certified/permitted condition
and/or they have been returned to their original condition after construction. Piping
has not been added other than minimal driveway piping which is appropriately sized
and sloped for each lot.
7. A copy of the yearly BUA construction report is attached for review by DEMLR.
8. The plat showing the lots and drainage easements for the project or for this phase or
section has been recorded. Check which applies below:
