You have our approval, in accordance with the attached conditions and those listed below, to place till
material in a total of 20 linear feet of stream (two separate crossings @10'/crossing) for the purpose of
replacing deteriorating pipe culverts and making roadway improvements to SR 1723 in Columbus
County. Specifically, one 40LF crossing of 36" RCP will be replaced with 50LF of 42" CMP, while
another crossing with (2) 40LF culverts of 36" RCP will be replaced with (2) 50LF sections of 95"x 67"
CMPA. The project shall be constructed in accordance with your application dated July 28, 2004
(received August 16, 2004). After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Number 3404. This certification corresponds to the Nationwide
Permit 14 issued by the Corps of Engineers. In addition, you should acquire any other federal, state or
local permits before you proceed with your project including (but not limited to) Sediment and Erosion
Control, Non-Discharge, and Water Supply Watershed regulations. This approval will expire with the
accompanying 404 permit, unless otherwise specified in the Water Quality Certification.
This approval is valid solely for the purpose and design described in your application (unless modified
below). Should your project change, you must notify the DWQ and submit a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter, and is
thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in
the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet,
compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this
approval to remain valid, you must adhere to the conditions listed in the attached certification.

1) Upon completion of the project, the NCDOT shall complete and return the enclosed "Certification
of Completion Form" to notify DWQ when all work included in the 401 Certification has been
completed. The responsible party shall complete the attached form and return it to the
401/Wetlands Unit of the Division of Water Quality upon completion of the project.
2) NCDOT shall conduct its activities in a manner consistent with State water quality standards
(including any requirements resulting from compliance with section 303(d) of the Clean Water
Act) and any other appropriate requirements of State law and federal law. If DWQ determines that
such standards or laws are not being met (including the failure to sustain a designated or achieved
use) or that State or federal law is being violated, or that further conditions are necessary to assure
compliance, DWQ may reevaluate and modify this certification to include conditions appropriate
to assure compliance with such standards and requirements in accordance with 15A NCAC
2H.0507(d). Before modifying the certification, DWQ shall notify NCDOT and the US Army
Corps of Engineers, provide public notice in accordance with 15A NCAC 2H.0503 and provide
opportunity for public hearing in accordance with 15A NCAC 2H.0504. Any new or revised
conditions shall be provided to NCDOT in writing, shall be provided to the US Army Corps of
Engineers for reference in any permit issued pursuant to Section 404 of the Clean Water Act, and
shall also become conditions of the 404 Permit for the project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

(EEP) will provide mitigation for the 0.02-acre of unavoidable non-riverine wetlands associated
with the above referenced project.
The subject project is not listed in Exhibit 2 of the Memorandum of Agreement among
the North Carolina Department of Environment and Natural Resources, the North Carolina
Department of Transportation, and the U. S. Army Corps of Engineers, Wilmington District
dated July 22, 2003; therefore, the EEP intends to provide compensatory non-riverine wetland
mitigation up to a 2:1 ratio in Cataloging Unit 3040206 of the Lumber River Basin.

Culvert Replacement SR 1723-Columbus County
The North Carolina Department of Transportation (NCDOT) has scheduled to grade, drain, base
and pave SR 1723, in Columbus County. Total project length is 1.4 mile. The roadway will be
widened from 16 feet to 20 feet and stabilized grass shoulders (6 foot) will be provided. This
project will require the replacement of two (2) wet cross lines as shown below:

New stream impacts = 20 linear feet
Construction of this project will require impacts to waters of the United States in the Lumber
River Basin. The Crossings convey UT's to Slades Swamp. (Class C Sw).
Crossing #1 conveys an agricultural ditch under SR 1723. Hydrology was noted at the culvert
entrance and exit, but, for the most part, the channel was dry. The channel is intermittent with a
bottom width of four (4) foot. On the downstream of the culvert, it was also noted that the
channel was excavated with sidecast material situated along the top of bank. The existing 40LF
36" RCP will be removed and a 50LF 42" CMP will be installed. The culvert will be buried 8
inches (20% of diameter), though there is little opportunity for aquatic movements due to the
intermittent nature of the UT to Slades Swamp.

Crossing #2 also conveys a UT to Slades Swamp. At this crossing, a small swath of wetlands will
be impacted by the placement of fill material along both sides of the road. The impact is minor,
0.021 acre, which is necessary to provide for the proposed safety improvements, i.e. 20 foot
paved roadway with 6 foot stabilized shoulders and 3:1 side slopes. The existing culvert consists
of twin 40LF 36" RCP's, but, due to reoccurring overtopping of the roadway, the crossing will be
upgraded. The culvert is presently flush with the stream invert. The NCDOT Hydraulics Unit has
determined that the replacement be Twin 95"x 67" CMPA's. The culverts will be buried one (1)
foot and a sill will be installed at the entrance of the off-line culvert. The sill will close off the first
2.5 foot of stream elevation to the bank full stage. Low flow will be conveyed through the in-line
culvert, while flows greater than bank full will be conveyed through both culverts.
RESOURCE STATUS
In general, there will be minor impacts proposed as the result of the replacement of the culverts
along SR 1723 in Columbus County. Twenty (20) linear feet of stream impacts and 0.02 acres of
wetland impacts are expected. A Nationwide Permit #14 / NCDENR 401 WQC 3404 is required
for the project.
Endangered Species: Plants and animals with Federal classification of Endangered (E) or
Threatened (T) are protected under provisions of Section 7 and Section 9 of the Endangered
Species Act of 1973, as amended. As of January 29, 2004, the U.S. Fish and Wildlife Service lists
five federally protected species for Columbus County.

A biological conclusion of "No Effect" was reached for all species during the May 19, 2004

REGULATORY APPROVALS
Application is hereby made for a Department of the Army Nationwide Permit 14 / NCDENR 401
WQC 3404 as required by the above-described activities. Due to the minor nature of the wetland
impacts, wetland mitigation is not required for this project.
The National Register was reviewed in addition to conducting a field view of the project for
significant historic features. Submission has been made to the State Historic Preservation Office
for their concurrence and clearance.
The project impacts are minor in nature and should not remove or degrade existing water quality
uses. Pipe sizes proposed are the minimum necessary to create a safe highway while
accommodating the 25-year design storm. By utilizing the erosion control measures, downstream
water quality standards will be protected. All appropriate BMP's will be utilized during
construction.
Attached is a Preconstruction Notification Form, plan sheets, marked county road map, quad
location map and photographs.

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and MRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,

IV. Prior Project History

It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
wetlands, open water, and stream channels associated with the project. The applicant must also

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to

freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
