HomeMy WebLinkAbout20061203 Ver 2_Scoping Comments for Western Wake_20100222Western Wake Regional Wastewater Management Facilities - Scoping Meeting Comments (April 19, 2007, Apex Town Hall) Scoping Comments Grouped by Category (from Scoping Meeting held April 19, 2007, Apex Town Hall) A) Effect on New Hill Community 1. Community of New Hill will not be included in project without construction of pump station. 2. No one came to New Hill to get input and thoughts on project even though they are in the center of project. Keep New Hill informed about each step in NEPA process. (been working well with DENR) 3. New Hill Historic District- No one has made effort to protect New Hill Historic District. Cultural Resources section 106. Consult with SHPO. 4. Inverse condemnation of community (smell adversely impact land values). B) Environmental Justice 1. Environmental Justice Issues - mitigation plan for these issues does not include entire community of New Hill 2. New Hill already had "share" of projects for "public good" i.e.: Sharon Harris, Jordan Lake, US 1, Dixie Pipeline, Progress Energy High Voltage transmission lines. (Environmental Justice Issue) Progress Energy asking to extend license. May have to add new (another) reactor rods. Don't have economic ability to fight. (another "hit" for the community) EJ issue. 4. Environmental Justice- study of demographics of affected areas vs. service area C) WRF Site Evaluation and Selection Want to see evaluation of alternatives sites S&E of US 1 particularly once with contiguous borders. How were borders determined? (versus individually owned tracts not individual parcels). Progress energy owns 25,000 acres, why not use some of this property instead of individually owner property?(sites 18-24 all owned by Progress Energy) 2. Why weren't citizens informed before land was condemned? Western Wake Regional Wastewater Management Facilities - Scoping Meeting Comments (April 19, 2007, Apex Town Hall) When sites were ranked, selected site at best was ranked #4. How did it get to be #1? 4. If project were sited South and East of US 1, there would be no issue. "Want it in our backyard, not our front yard." --support project just not at current site selected. 5. Will cost be the only determining factor for site approval? 6. Site 14. Discussion involved 1 mile exclusion area around the plant. There are other sites on Progress Energy Property that are not within exclusion area. 7. Site 30 would cost $3 million more than site 14; Apex proposes to spend $3 million to mitigate for EJ issues. Site 30 avoids Historic District, churches, cemeteries, center of town. 8. Move facility to Progress Energy would cost $27 million. Asked for details, didn't get them. Got 1 sheet of paper with 10 line items. 9. Why not consider future values (location/community) and uses to specific sites. 30 over 14 example vs. cost of installation (same $) 10. Thorough review of site selection process on an equal basis. Specifically the Progress Energy sites. Why were they excluded? D) Potential Spills and Contamination Cary's record of managing sewer plants. What is back up plan for if and when wells, ponds, wetlands are contaminated? Water supply during clean up? (people, livestock, crop irrigation) ie: Honolulu 2. Do towns have to have performance bond to pay for clean up? 3. Pipeline routing goes through farms and woodlands. If there is a spill, it can go on for days before discovery. If it (pipe) follows highway right of way-it would be easier to visually discover the spill (concern about influent line). 4. Monitoring lines in case of spills. Compliance issues about existing sewer plants especially since Cary will be running new facility. 6. With regard to the potential/inevitable for leaks in force main. Like to see specific mitigation preparedness response and recovery plan for this project. In addition to the existing plan for Town of Cary maintenance. With regard to operation, we need to specific reaction and service plan to address local problems as they arise-Apex has 7D but Cary operates the facility. Who will be accountable for issues? How will "they" be enforced? 8. Compare project to ones Nationwide success/ failure of ones of similar site/scope. E) NEPA, Procedural Issues, and Review Process 1. State said project is being handed to Corps. What does that mean? If one says yes and the other says no, does it go forward? NEPA vs SEPA 2. Does Corps have all of the information that has been provided to DENR? (New Hill can provide it). 3. Where advertised? 4. "Project will be located within wastewater treatment area." This is incorrect in Public Notice document. 5. Is process influenced by 2011 deadline? There will be a lot of pressure to get this permitted. NEPA process. 6. Can Corps influence DENR to change deadline (2011)? DENR and partners. 7. Thorough review by federal EPA regional office Atlanta. 8. EIS needs to be reviewed by Chatham County Environmental Review Board F) Comments on EIS Document 1. Need to cover physical characteristics of area and use similar to list provided in Nuclear Regulatory Commission Scoping Meeting for their EIS (he provided written list). 2. Need accurate depiction of waters, wetlands, ponds, and influent and effluent pipelines for entire project. G) Project Alternatives Analysis 1. Re-evaluate non-regional option or the other presented options (alternatives). 2. Explore inter basin transfer at a regional level. Perhaps there is really no net loss justifying requirement to return water. Harris has Auxiliary Lake. Can't WWTP effluent go there without polluting main lake? Expansion of existing facility (reactor) 2. Location of facility closer to river-distance? Evaluate discharge sites downstream, possibly 3 miles -relocate to less populated areas -evaluate less expensive discharge site benefiting Chatham County. 1) Secondary and Cumulative Impacts Secondary and cumulative impacts report developed by several of the communities (towns). None of them cover adverse impacts to New Hill (DENR said the Impacts Reports are acceptable). New Hill has no representation in the towns. J) Effects on Chatham Cou 1. Explain who has legal authority to cross into Chatham County without notice/review/approval with Chatham County government 2. Explain how Chatham County population growth will affect Jordan Lake- wastewater. 3. Mitigation approach is to allocate some of the 38 million gallons per day to Chatham County. Problem 117,000 people -solution give Eastern Chatham County some of allocated 38 million gallons per day. 4. How did Cary receive increased allocation of water from Lake Jordan without considering the expected increase of needs from Chatham County? 5. Explain why Chatham County has not been consulted or contacted (project sites/discharge through Chatham county? x2 (project partner)?????????? 6. Explain effects of project causing Eastern Chatham County to become involuntary, annexed into Apex/Cary. (more vulnerable to include Holly Springs). 7. Will this project limit future project in Chatham County to spray fields only? K) Effects on Shearon Harris Nuclear Plant I Progress Energy Issues Progress Energy wants to develop some of their land for commercial, residential, and industrial development. They have been given preferential treatment. Tax money spent on waste water treatment study. Project would allow increased development within this area. How would this impact evacuation routes and plans in case of nuclear accident (event)? L) Pipelines 1. As taxpayer, object to cost of 13 miles of effluent pipe line (64 feet of??? line) 2. Why can't sewer line cross Crops property at Jordan Lake? 3. Forced sewer line, Beaver Creek, reasoning behind choice of alternate (#2) to be used over option #1. Why not alternative #2 extended through wetlands. 4. Should effluent be routed so that future post processing can occur, pre-discharge into Cape Fear River. (reduce nitrates, phosphates, etc.) Areas south of US 1 require fewer bore crossings of US 1 and rail roads. Why was this not considered? M) Other 1. Explore option of pushing this facility to a stage III facility-weigh cost/benefit including above concerns. 2. Explain why WW partners did not have open community meeting and consulted the affected residents at existing plant or at any final location within 1 mile. - Why reports were misrepresented to DENR.
