The North Carolina Department of Transportation is requesting a NW 3 permit for the replacement of bridge # 19 on SR 1164 in Hertford County. This bridge is located approximately 2.3 miles from the intersection of SR 1164 and SR 1160. The bridge crosses over Panther Creek, which is classified as a "Class C Nutrient Sensitive Water" by the Division of Water Quality. This creek drains into Potecasi Creek approximately 1 mile downstream and eventually empties into the Chowan River. The existing bridge has five spans that total to 77 feet in length. The bridge is constructed of timber piles, caps, joist and flooring. The overall width of the bridge deck is 19 feet. This bridge will be removed using NCDOT best management practices for bridge demolition. The proposed bridge will have three cored slab spans that total to 142 feet in length. There will be two end bents and two interior bents that support the three deck slabs. The bents will have steel H-piles supporting them and concrete caps. The proposed bridge deck will be 30 feet in width. Due to the widening of the bridge deck from 19 feet to 30 feet the bridge approaches will need to be widen, which will result in 245 sq. feet of riverine wetland impacts. This wetland impact will be mitigated by using a combination of on-site restoration and EEP credits. The old fill approaches can be pulled out and restored to surrounding wetland elevation, which will result in 400 sq. feet of restored wetlands. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion, so long as the property is clearly defined. For administrative and distribution purposes, the USACE requires information to be submitted on sheets no larger than 11 by 17-inch format; however, DWQ may accept paperwork of any size. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Provide photocopies of previously issued permits, certifications or other useful information. Describe previously approved wetland, stream and buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project, list and describe permits issued for prior segments of the same T.I.P. project, along with construction schedules. Proposed Impacts to Waters of the United States/Waters of the State It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the project. The applicant must also provide justification for these impacts in Section VII below. All proposed impacts, permanent and temporary, must be listed herein, and must be clearly identifiable on an accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial) must be shown on a delineation map, whether or not impacts are proposed to these systems. This is the result of bank stabilization (rip rap) placement which will protect the slopes from highwater flows. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Bridge replacement is going to stay on the existing alignment and traffic will be detoured around the site by using an off-site detour. This will reduce temporary impacts'to wetlands and the creek by not utilizing an on-site detour and keeping the road open. The bridge is being extended which will allow NCDOT to pull out existing fill in wetlands and restore the area to wetland elevation Impacts to the wetlands are resulting from shoulder stabilization with the placement of rip rap which will keep the approach banks from eroding away during high water storm events This is necessary to insure long term bridge stability. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. Page 9 of 13 USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o enr state nc us/newetlands/strm,ide.btml. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. NCDOT will impact 245 sq feet of riverine wetlands. NCDOT will restore on-site 400 sq. feet of riverine wetlands by pulling out fill material from the old approach and setting the elevation to surrounding wetland elevation Mitigation is being required at a 2:1 ratio for riverine wetland impacts which sets the 245 sq feet of impact to 490 sq. feet of mitigation needed Therefore we will have a net impact of 90 sq feet of riverine wetlands after the on- site restoration is applied NCDOT will request the balance of 90 sq. feet of riverine wetland impact for the EEP A copy of the request letter is included with this PCN. 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP). Please note it is the applicant's responsibility to contact the NCWRP at (919) 733-5208 to determine availability and to request written approval of mitigation prior to submittal of a PCN. This bridge will be replaced on it's existing alignment with an off-site detour. The current structure is a 5 span wooden bridge that totals 77 feet long and it will be replaced with a 3 span core slab structure that will be 142 feet long. This project is TIP # B-4151, the WBS# is 33500. 1.1 The purpose of this letter is to request that the North Carolina Ecosystem Enhancement Program (EEP) provide confirmation that you are willing to provide compensatory mitigation for the project in accordance with the Memorandum of Agreement (MOA) signed July 22, 2003 by the USACE, the NCDENR and the NCDOT. RESOURCES UNDER THE JURISDICTION OF SECTION 404 AND 401 OF THE CLEAN WATER ACT AND THE COASTAL AREA MANAGEMENT ACT We have avoided and minimized the impacts to jurisdictional resources to the greatest extent possible as described in the permit application. There are unavoidable wetland impacts due to the widening of the bridge approach on the west side. The wetlands are being impacted by bank stabilization, which is necessary to insure long term stability of the bridge. The total fill in wetlands will be 245 sq. feet (0.006 acres). In order to off-set these impacts NCDOT will pull out 400 sq. feet (0.009 acres) of old approach fill and grade it to surrounding wetland elevation, which will restore it back to wetland status. The 245 sq. feet of wetland impact must have a ratio of 2:1 applied in accordance with COE mitigation requirements, resulting in 490 sq. feet of required mitigation. NCDOT is providing 400 sq. feet of on-site restoration, which leaves a remaining 90 sq. feet (0.002acres) of impact to jurisdictional resources needing mitigation. Therefore, NCDOT is requesting EEP provide 90 sq. feet (0.002 acres) of riverine wetland mitigation.
