No Please give a brief project description below. A stream culvert crosspipe (corrugated metal pipe) is failing. The bottom of the pipe has completely rusted away, and the street above the pipe and the curb inlets are beginning to sink. The Town proposes to remove the pipe and replace it with a reinforced concrete pipe (possibly two, depending on utility restrictions) of the same length and a headwall. Stream impacts are limited to the length of the existing pipe (no new impact). A riprap lined plunge pool will be added at the downstream end of the culvert (the downstream reach of stream is lined with riprap, so also, no new impact). The project is in design. Please note that the work may be done due to safety concerns and this application may be submitted after -the - fact. However, your described activity does not require notification to this office. As described you may proceed with the culvert replacement utilizing a non -notifying NWP 3. Of course, there are instances where the use of NWP 3 would require notification as follows: The repair of an impounding structure (i.e. dam) 1. Removal of accumulated sediments 2. Temporary impacts exceeding 0,1 acre or 150 linear feet 3. Certain cases of NWP 3 use in designated trout watersheds. More detail on the notification requirements for NWP 3 can be found on page 2, and 35-36 (regional conditions 4.1.1-4.1.3) on the attached NWP3. If you need further clarification please let me know.
