the volume of wastewater to be permitted in this project has been evaluated along the route to the
receiving wastewater treatment facility and that the flow from this project is not anticipated to
cause any capacity related sanitary sewer overflows or overburden any downstream pump station
en route to the receiving treatment plant under normal circumstances, given the implementation of
the planned improvements identified in the planning assessment where applicable. This analysis
has been performed in accordance with local established policies and procedures using the best
available data. This certification applies to those items listed above in Sections I and II plus all

Sewer System Extension Permit
Dear Mr. Robinson,
On behalf of Chatham Park Investors LLC, please find the attached documentation in support of a Fast Track
Application (FTA 04-16) for the referenced project. As noted in the application, this project will consist of
2,040 LF 8" PVC sewer located north of Thompson Street and will connect to sewer within Subdivision West
-Phase 1 being permitted and constructed under separate cover. Subdivision West - Phase 1 then connects
to sewer permitted, constructed and certified under permit # WQ0039848. The proposed sewer described
within this application will serve Phase 2B of Subdivision West containing 81 single family and townhomes
within this development.
The proposed project will meet all of DWR's minimum design criteria for sanitary sewer extensions. The
design flow rate for this project is calculated at 14,580 gpd based on NCAC 2T Rules for wastewater flow
rates and the DEQ approved sewer flow reduction of 60 gal/bedroom approved under separate cover for
Chatham Park and included with this submittal package. The proposed sanitary sewer line sizes are more
than adequate to convey the design flow rates.

On July 16, 2018, the Division of Water Resources (Division) received an adjusted daily sewage flow
rate (flow reduction) request that would apply to all permitted but not yet tributary residential
connections and all future residential connections within the Chatham Park Development service
area.
In accordance with 15A NCAC 02T .0114(f)(2), the Division has evaluated the request as well as
additional information received on October 15, 2018, and based on the data submitted and the
Division of Water and Infrastructure (DWI) guidance, the Division hereby approves for use by the
Chatham Park development an adjusted daily sewage design flow rate with the following
conditions:
• The flow reduction is applicable to residential single family dwellings only.
• The minimum flow for 1 and 2 bedroom dwellings shall be 120 gallons per day.
• Each additional bedroom above two bedrooms shall increase the volume by 60 gallons per
day per bedroom.
• This flow reduction shall not apply to sewer extension applications and/or permits for any
other public or private organizations whose wastewater flows are or might become
tributary to Chatham Park collection system.
Future sewer extension applications should be made using the flow reduction amount stated above.
All other aspects of the permitting process remain unchanged, and all applications must be in
compliance with the statues, rules, regulations and minimum design criteria as certified by the
owner and engineer.
Regardless of the adjusted design daily wastewater flow rate at no time shall the wastewater flows
exceed the effluent limits defined in the NPDES Permit for the treatment _facilit r�or exceed the,
capacity of the sewers downstream of any new sewer extension or service connections .

The granting of this flow reduction does not prohibit the Division from reopening, revoking,
reissuing and/or modifying the flow reduction as allowed by the laws, rules, and regulations
contained in 15A NCAC 02T, NCGS 143-215.1, or as needed to address changes In State and/or
Federal regulations with respect to wastewater collection systems, protection of surface waters
and/or wastewater treatment.

11iis application is for sewer extensions involving gravity sewers_ pump stations and fierce mains, or any combination that has been
certified by a professional engineer and the applicant (lint the project meets the requirements of 15A NCAC 02T and the Division's
Minimum Design Crileria and that plans, specifications and supporting documents have been prepared in accordance with, 14. A
NCAC 02T, I5A NCAC 02T .0300, Division Policies and good engineering ractices.
While no upfront engineering design documents are required for submittal, in accordance with 15A NCAC 02T .0305(b), design
documents must be prepared prior to submittal of a best track permit application to the Division. This would include plans, design
calculations, and project specifications referenced in 15A NCAC 021 0305 and the applicable ininimum design criteria. These
documents shall be available upon request by the Division.
Projects that are deemed permuted (do not require a permit from the Division) are explained in .15A C 02T.0303.

E. Flow Tracking/Acceptance Form (Form: FTSE 04-16) (If Applicable):
® Submit file completed and executed FTSE form from the owners of the downstream sewers and treatment facility.
Multiple forms maybe required where flee downstream sewer owner and wastewater treatment facility are different.
The flow acceptance indicated in form FTSE must not expire prior to permit issuance and must be dated less than one
year prior to the application date.
Submittal of this application and form FTSE indicates that owner has adequate capacity and will not violate G.S. 143-
215.67 a
Intergovernmental agreements or other contracts will not be accepted in lieu of a project -specific FTSE.
F. Site Maps (All Application Packages):
® Submit an 8.5-inch x 11-inch color copy of a USGS Topographic Map of sufficient scale to identify the entire project
area and closest surface waters.
Location of the project (gravity sewer, pump stations & force main)
Downstream connection points and permit number (if known) for the receiving sewer
® Include a street level snap (aerial) showing general project area so that Division staff can easily locate it in the field.
G. Existing Permit (All Modification Packages):
❑ Submit the most recently issued existing pennit.
❑ Provide a list of any items within the permit the Applicant would like the Division to address during the permit
modification (i.e., permit description, flow allocation, treatment facility, etc.).
H. Power Reliability Plan (Required if portable reliability option utilized for Pump Station):
❑ Per 15A NCAC 02T .0305 h 1 , submit documentation of power reliability for pumping stations.
►- This alternative is only available for average daily !lows less than 15,000 gallons per day
Y It shall be demonstrated to the Division that the portable source is owned or contracted by rite applicant and is compatible
with the station. The Division will accept a letter signed by the applicant (see 15A NCAC 02T .0106(b)) or proposed
contractor, stating that "tile portable power generation unit or portable, independently -powered pumping units, associated
appurtenances and personnel are available for distribution and operation of this pump station,,'
%- If the portable power source or pump is dedicated to multiple pump stations, an evaluation of all the pump
stations' storage capacities and the rotation schedule of the portable power source or pump, including travel
timcframes, shall he provided in the case of a multiple station power outage. (Required at time of certification)
I. Certificate of Public Convenience and Necessity (All Application Packages for Privately -Owned Public Utilities):

This is quick and basic but hopefully provides the information requested and answers your question.
• The first exhibit is an overall Town sewer distribution map that Hydrostructures prepared for the Town back in
2015. 1 have highlighted the subject gravity lines from our project to the Town's WWTP and added approximate
location of the gravity sewer that was permitted and installed with the Thompson Street Subdivision plans. I
wanted to provide a third party exhibit plus this is the only overall sewer map that I have.
The second exhibit is the overall utility plan from the Thompson Street Subdivision construction plans that
provides additional detail. The sewer and infrastructure were installed over the last two years with the sewer
certified and as -built.
• The last exhibit is the overall utility plan for Subdivision West Phase 1 which of course is what we are trying to
permit now. Phase 2A and 2B are just extensions of this development as shown with the phasing.

Sorry for this being so drawn -out, but we've got another inquiry based on internal conversations we've had about these
projects:
For all three of the Chatham Park Section 5.1 projects that we currently have applications for, how do they make it to
Pittsboro's plant? From the applications, I see they all list WQ0039848 as the downstream sewer extension, which is the
"Chatham Park -Thompson Street Subdivision" project. I plan to look at that application the next time I'm in the office
(likely tomorrow afternoon) and see if the application states the receiving downstream permit, but I wanted to go ahead
and get the ball rolling on this. Do you know what is downstream of WQ0039848? Does it go to another newly
permitted and constructed line? Or flow into an old line in Pittsboro's existing collection system? We're trying to get a
better understanding of all the different construction going on out there. We've already issued at least 9 Chatham Park
permits, I think some go to Pittsboro's existing system, some may go into new interceptor lines (or be new interceptor
lines), some go to Chatham Park's WWTP, and we're trying to better understand this for each Chatham Park application.
Are you able to provide plans that shows how these 5.1 projects flow to the Pittsboro treatment plant? If not, even a
hand -drawn sketch would be helpful.

1. These applications state that the downstream sewer and the downstream facility that will receive and treat the
wastewater is Pittsboro's. we know that Pittsboro has plans to eventually decommission their plant and send
their wastewater to Sanford. Therefore, will the flow from these Chatham Park projects eventually go to
Sanford's treatment plant? (item V.1) That is correct, the flow from these three phases will be tributary to the
Town's WWTP via existing gravity sewer that flows south and west of the project. This flow will eventually go to
Sanford's WWTP once the Town's WWTP flow is redirected.
2. it was our understanding that we will initially issue this permit to Chatham Park Investor's LLC, but after
construction and certification, it will be transferred to the Town of Pittsboro. However, a Developer's Agreement
was included in the resubmittals that essentially states that the project will be transferred to the "Chatham Park
Residential Association, Inc. ". Please confirm who the project will be transferred to upon completion and
certification of the project. (Item Vi.2 and DOA included in the opp) Per our conversation last Wednesday, it is
Chatham Park's intent that the permit and collection system will be transferred to the Town of Pittsboro. It is
my understanding that the Town is in agreement as well but will let Mr. Kennedy and Mr. Poteat advise if
necessary. However, in order to provide a complete application we included a signed Developer's Operational
Agreement which is required with this type of application. The Developer's Operational Agreement lists
Chatham Park Residential Association, Inc. as the corporation that would handle the operations of the Disposal
System but again, the intent is that the permit and collection system will be transferred to the Town of Pittsboro
with no need for the Agreement to be executed. It is our thought that the Developer's Operational Agreement
remains on file and only used if necessary.
3. Please confirm that the homes will all be three bedroom (180 GPD) (item V1.7). Per our noted conversation, we
confirmed that the residential units will be an average of three bedrooms.
4. Please confirm that there are no aerial crossing, no contact of surface waters, and no lines on streambanks that
are subject to erosion (Item iV.6). There are no aerial crossings, no contact of surface waters, and no lines on

The flow-tracking/accepton ce form (FTSE) serves as an approval that the receiving treatment facility is willing to
accept the wastewater. Item 1.o of the FTSE states that the flow is going to Pittsboro, and Mr. Poteat of
Pittsboro signed the form. However, Item if states that the flow for this request is T", even though Item V1.7 of
the applications shows flow from new houses. The flow -tracking sheets for all the "West" projects need to be
updated to reflect the flow request for each project, and signed by Pittsboro staff Please find attached the
updated FTSE forms for all three phases that have been initialed and dated by Mr. Poteat.
6. Item II of the FTSE does not show any downstream pump stations. Please confirm there are no pump stations
between these Chatham Park projects and the Pittsboro WWTP. There are no pump stations between these
projects and the Town WWTP. As noted above, the existing gravity line serving this area flows south and west

Based on the below email from July 14`h and discussions with the Town of Pittsboro, please see Sewer Revised Permit
Extension Application Packages and supporting documentation for Subdivision West Ph 1, 2A, and 2B in the Sharefile
Link below. The Applications have been revised to show Chatham Park Investors LLC as Applicant. Formal submittals

Subject: Chatham Park Section 5.1 Sewer Ext Applications - Additional Info Request

Pittsboro Staff,
We have received multiple applications from the Town of Pittsboro that propose to use a flow reduction that was
approved by DWR for Chatham Park Investors, LLC. Chatham Park Investors, LLC was granted a flow reduction in a letter
dated January 14, 2019 (attached). As stated in the letter, this flow reduction cannot be used by the Town of Pittsboro,
and therefore the application cannot be processed as submitted (see excerpt from letter below).

The applications that the DWR Raleigh Regional Office has received from Pittsboro that propose to use the approved
flow reduction are the following:
• WQ0041721— Chatham Park — Section 5.1 Subdivision West — Phase 1
• WQ0041811— Chatham Park — Section 5.1 Subdivision West — Phase 2A
• WQ0041812 - Chatham Park — Section 5.1 Subdivision West — Phase 213
• WQ0041807— Chatham Park — Section 5.1 Subdivision North - Phases 4A & 413 (application states zero flow,
requests "authorization to construct", says permit mod will be submitted with flow after construction is
complete and the project is certified)
To resolve the issues with these applications, one of the following will need to be done:
1. The applications can be revised using the design flows from 15A NCAC 02T .0114(b).
2. The Town of Pittsboro can apply for a Flow Reduction for single-family residential development that occurs in
the Chatham Park Development Area (this would need to be defined). This will require the submittal of
updated, recent data in accordance with 15A NCAC 02T.0114(f) as the data utilized for the previous reduction
issued to Chatham Park Investors is now approximately two years out of date.
3. The applications can be revised to show Chatham Park Investors, LLC as the applicant/owner. Once the project
is constructed and certified, Pittsboro can request that the permit is transferred into their name. Upon approval
of the transfer by DWR, Pittsboro will become the owner of the permit/project.
In addition, it's my understanding that Chatham Park Investors has recently submitted a request for a flow reduction for
multi -family residences as well. As submitted, that request will likely have the same issues. If it is granted as submitted,
only sewer extension applications for multi -family residences submitted by Chatham Park Investors, LLC would be able
to utilize any approved flow reduction.
A response from Pittsboro that resolves this issue is considered required in order to proceed with the review of the
applications and issuance of permits. The response should also address the multi -family flow reduction request recently
submitted by Chatham Park Investors, LLC. If a complete response is not received within 30 days from the date of this
email (7/14), all of the listed applications and supporting documents will be returned to you in accordance with 15A
NCAC 02T.0107(e)(2).
