Any changes to this form will result in the application being returned. The Division of Water Quality (Division)will
only accept application packages that have been fully completed with all applicable items addressed. You d_ o not need

D.Certificates of Public Convenience and Necessity—If the application is being submitted in the name of a privately-
owned public utility, submit two copies of the Certificate of Public Convenience and Necessity, which demonstrates
that the public utility is authorized to hold the utility franchise for the area to be served by the sewer extension. If a
Certificate of Public Convenience and Necessity has not been issued- provide two copies of a letter from the NC
Utilities Commission's Public Staff that states that an application for a franchise has been received,that the service area
is contiguous to an existing franchised area,and/or that franchise approval is expected.
E. Operational Agreements—Submit one original and two copies of a properly executed operational agreement if the
sewer extension will be servin- residential or commercial lots (e.g., houses, condominiums, townhomes, outparceis,
etc.)that will be owned by a homeowners'association or developer. If the applicant is a homeowners' association,use
Form HOA 10/99. If the applicant is a developer,use Form DEV 10/99.
F. Flow Acceptance Letters— If the owner of the downstream sewers and/or«'WTF is different from the applicant,
submit two copies of a flow acceptance letter from the owner of the downstream sewers and IA WTF. Flow acceptance
letters must contain the following minimum information: applicant and project name, amount of flow accepted, and
name and permit number of the receiving sewer0A\A'TF. The flow acceptance must not expire prior to permit
issuance and must be dated less than a year prior to the application date. Intergovernmental agreements or other
contracts will not be accepted in lieu of a project-specific flow acceptance letter.

On September 27, 2000,the Division of Water Quality Central Office received a flow reduction request for
condominiums,villas and homes at the Mountain Air Country Club.Supporting documentation was submitted by Mr.
Larry K. Barthelemy,IV,E.I. with Cavanaugh&Associates,P.A.on behalf of the club.The study requests approval
of a residential flow value of 75 GPD/bedroom for the dwellings located in the subject area. A previous flow reduction
request had been granted by the Division reducing the flow from 120 GPD/bedroom to 105 GPD/bedroom.
Mr. Barthelemy completed an evaluation between July 1999 and July 2000 for 20 developments (462
bedrooms) in accordance with 15A NCAC 2H .0219(1)(3). This evaluation included the monthly water flows for a
thirteen month period for the developments listed and daily sewer meter readings for July 2000. Since September 1999
had the highest peak monthly flow and the daily sewer meter readings were submitted for July 2000, the Division
requested daily sewer meter readings for September 2000. These were submitted but the daily average peak flow was
not greater than the July 2000 readings. The study indicated that 61 GPD/bedroom is the actual use but the request is
for 75 GPD/bedroom, 18%above the highest recorded reading.
Based upon the information submitted, the Division hereby approves the use of 75 GPD/bedroom in all
applicable non-discharge permit applications for future wastewater collections extensions for the Mountain Air Country
Club. This consideration applies to any applicable future projects submitted to the Division as well as any projects which
are currently under review. Regardless of the adjusted design daily wastewater flow rate,at no time shall the wastewater
flows exceed the effluent limits defined in the Non-Discharge permit of the treatment facility.
