Dear Mr. Knowles:
The Municipal Unit of the Division of Water Resources has reviewed the Industrial User Pretreatment Permits
(IUPs) submitted by the Town of Rose Hill for the following Significant Industrial Users (SIUs). The IUPs were
received by the Division on August 19, 2020.

The review indicates that more information is needed to determine if the ]UPS meet the minimum requirements of
15A NCAC 2H .0905, .0916, and .0917 and 40 CFR 403.8(f)(1)(iii). For the Division to complete its review of
the IUPs, you are required to submit the following additional information by October 19, 2020:
1) Both IUPs: The required procedures for issuance of IUP renewals include the following:
a) SIU sends new application at least 180 days before IUP expires.
b) POTW issues renewed permit based on that application.
c) The renewal IUP is issued with an effective date no later than the day after the expiration date.
d) The permit history lists the IUP event as a renewal and includes all changes.
e) The IUP is transmitted to the SIU and the Division at the time of issuance.
f) Also relevant is that IUP modifications cannot extended the expiration date more than 5 years after the
effective date of that IUP renewal cycle.

Rose Hill IUP Review — Additional Information Required
The IUP's as submitted do not appear to follow this general sequence. Please explain the POTW's intent for these
IUPs. Include a timeline of events for these IUPs, along with any documentation you may have of the dates the
events occurred. For example, documentation of the POTW's receipt of the SIU applications and the SIU's
receipt of the IUPs, emails, meeting or phone call notes, etc. Provide any documentation that the IUPs were
transmitted to the SIUs and the Division upon issuance.
Until the Division has received the required information, we will be unable to make a decision on the adequacy of
the IUPs. Therefore, as allowed by 15A NCAC 2H .0917 (e)(2), the Division's thirty -day comment period will be
suspended until the additional information is received, and at that time the full 30-day comment period will
recommence. You are encouraged to notify the affected industries of the extension of the Division's comment
period.
Federal and State pretreatment regulations require the local delegated pretreatment program to effectively control
and document the discharge of wastewater from Significant/Categorical Industrial Users to the POTW. It is the
POTW's responsibility to ensure that these objectives are consistently met.
