PERMIT RENEWAL REQUEST Stormwater Permit No. SW8 921108 Meadowbrook Subdivision, Phase If New Hanover County Dear Mr. Stephens: Dee Freeman Secretary The Division of Water Quality (DWQ) issued a high density State Stormwater Management Permit, number SW8 921108, to Meadowbrook Subdivision on September 4 1996. This permit expired on September 4, 2006. The Division of Water Quality recently discovered -that a Renewal Notification was never sent. However, per 15A NCAC 2H.1003 (h) (the stormwater rules), it is your responsibility to submit an application to renew the permit 180 days prior to the expiration of the permit. Please complete and submit the enclosed renewal application prior to July 3,.2011. The renewal application must be accompanied by a processing fee, which is currently set at $505.00. If you have sold the project, or are no longer the permittee, please provide the name, mailing address and phone number of the person or entity that is now responsible for this permit. Enclosed is a form for change of ownership, which should be completed and submitted if the property has changed hands. Your permit requires that upon completion of construction and prior to operation of the permitted stormwater treatment system, a certification of completion be submitted to the Division from an appropriate designer for the type of system installed. This is to certify that the permitted facility has been installed in accordance with the permit, the approved plans, specifications and supporting documentation. The DWQ does not currently have a certification for this system in our files. Therefore, please include a copy of the certification with your permit renewal request and processing fee. If a renewal application is not submitted prior to June 25, 2011, enforcement actions may be initiated, which may include the assessment of civil penalties. It has the following two permits: 1.) SW8 920504: This is a low density permit that allows 30% overall impervious area for the subdivision and has 17 lots at 1,927sf of impervious area per lot. This permit does not expire and has fairly easy maintenance requirements as specified in the attached documents. 2.) SW8 921108: This is a high density permit that has expired. The attached letter was written to the permittee (the developer) earlier this year. Generally the developer is the original permittee who builds the subdivision, and once everything is finished he is supposed to submit paperwork to transfer the permit to the HOA. The permit gets renewed every 10 years. It does not look like this one got transferred from the developer to the HOA. So, the developer still needs to submit the renewal application, http://portal.ncdenr.ore/web/wa/ws/su/statesw/forms docs and if the subdivision is complete or if he is otherwise ready to transfer this to the HOA per the recorded covenants then he would also submit the HOA Name/Ownership change form (same link under "miscellaneous"). As a part of that process the site will be inspected by DWQ to see if it is compliant. If it is not compliant, then the developer will have to take action to "fix" anything that is wrong. Then, we will transfer the permit to the HOA. If he doesn't take action then things can get difficult. He has missed the deadline to submit the paperwork we requested earlier this year. But, since you are calling to ask about it perhaps things are in the works to get the ball rolling. DWQ file review and site inspection revealed that the site is not in compliance with the terms and conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the recent inspection. As indicated in the attached inspection report, the following deficiencies must be resolved: 1. Expired Permit: Your permit expired on September 4, 2006. You were mailed a renewal request on February 1, 2011 but a response has not been received. You had submitted paperwork to transfer the permit on November 20, 1996 but it was not a complete package. You were notified on January 15, 1997 that additional paperwork was needed for the transfer, and so you are still the permittee and responsible for compliance. 2. Maintenance: a. Pond 2: Eroded area near the outlet structure must be fixed. b. Pond 3: The outlet structure needs to be unclogged. c. Pond 4: Eroded area near the outlet structure must be fixed. d. Pond 4: The trash rack on the outlet structure needs to be fixed. Please inform this Office in writing before January 5, 2011, of the specific actions that will be undertaken and the time frame that will be required to correct the deficiencies. Failure to provide the requested information, or to respond to this letter by the due date, may initiate enforcement action including the assessment of civil penalties of up to $25,000 per day. If a written plan of action is not submitted to this office by January 5, 2011 then DWQ staff will re -inspect the site and issue a Notice of Violation if the listed deficiencies have not been addressed. Please be reminded that if an ownership change, or a name change or a mailing address change has occurred, it is your responsibility to submit a completed and signed Name/Ownership Change form to the Division. No homeowner/lot owner/developer shall fill in, alter, or pipe any drainage feature (such as swales) shown on the approved plans as part of the stormwater management system without submitting a revision to the permit and receiving approval from the Division. 5. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon area. Once the lot transfer is complete, the built -upon area may not be revised without approval from the permittee, and responsibility for meeting the built -upon area limit is transferred to the individual property owner. 6. The following items will require a modification to the permit: a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area. e. Further subdivision of the project area. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. In addition, the Director may determine that other revisions to the project should require_ a modification to a permit. 7. The Director may notify: the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. A. H. SCHEDULE OF CONVTLYANCE 1. The permittee will comply with the following schedule for construction and maintenance of the stoimwater management system: a. The stoninwater management system shall be constructed in it's entirety, vegetated and operational for it's intended use prior to the construction of any built -upon surface except roads. b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 2. The permittee grants permission to DEHNR Staff to enter the property for the purposes of inspecting the project for compliance with the conditions of this permit. 4 State Stormwater Management Systems Permit No. SW8 921108 Modification 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in it's entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris _removal and unclogging of outlet. structure, orifice device and catch. basins and piping. g. Access to the outlet structure must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. Prior to the sale of any lot, deed restrictions must be recorded which limit the built -upon area per lot to the amount as shown on the Project Data Sheet, per Part I #2. The recorded statements must follow e - o m:---- -- a. "The maximum built -upon area per lot is 2,405 square feet, inclusive of that portion of the right- of-way between the lot line and the edge of pavement, structures, pavement, walkways of brick, stone, or slate, but not including open wood decking." b. "The covenants pertaining to stormwater regulations may not be changed or deleted without concurrence of the State." C. Alteration of the drainage as shown on the approved plan may not take place without the concurrence of the State." d. "Lots within CAMA's Area of Environmental Concern may be subject to a reduction in their allowable built -upon awa due to CAMA regulations." If the subdivision exceeds low density, one of the following additional statements are necessary to ensure that all runoff from built -upon areas of the lot is picked up by the pond. Additional statements include: e. "Roof drain gutters are required on all homes and must drain into the street. " L "Two-thirds of the lot must be graded toward the street." g. "Perimeter swales and ditches must pick up the runoff and direct it into the pond. " 6. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 8. A copy of the recorded deed restrictions must be submitted to the Division within 30 days of the date of the recording. The recorded copy must be signed by the permittee, dated, stamped with the deed book number and page, and bear the stamp of the Register of Deeds. 9. A copy of the approved plans and specifications shall be maintained on file by the. Permittee for a minimum of ten years from the date of the completion of construction. M. GENERAL CONDITIONS 1. This permit is not transferable.
