• Dear Mr. Phillips:
In accordance with your application received February 2, 1987, we are forwarding
herewith Permit No. 14521, dated April 15, 1987, to Mr. Gary Phillips for the
construction and operation of the subject non -discharge type wastewater treatment and
disposal system.
This permit shall be effective from the date of issuance until April 30, 1992,
and shall be subject to the conditions and limitations as specified therein.
If any parts, requirements, or limitations contained in this permit are
unacceptable to you, you have the right to request an adjudicatory hearing upon
written request within 30 days following receipt of this permit. This request must be
in the form of a written petition, conforming to Chapter 150B of North Carolina
General Statutes, and filed with the Office of Administrative Hearings, Post Office
Drawer 11666, Raleigh, North Carolina 27604.
If you wish to have the hearing before the Hearing Officer with this
Department, you must indicate in the petition that you waive the right to have the
contested case conducted by a Hearing Officer in the Office of Administrative
Hearings, and wish to have the matter conducted in the Department of Natural Resources
and Community Development. Unless such demands are made this permit shall be final
and binding.

For the discharge of Sewage, Industrial Wastes, or Other Wastes
In accordance with the provisions of Article 21 of Chapter 143, General
Statutes of North Carolina as amended, and other applicable Laws, Rules and
Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
construction and operation of a 450 GPD non -discharge type wastewater treatment and
disposal system consisting of a 1,500 gallon septic tank, a 135 square foot surface
sand filter, a chlorinator, two 1,500 gallon storage/pump tanks, a 14.0 GPM
irrigation pump, a 15,169 square foot irrigation field, and associated valves,
piping, and appurtenances to serve the Gary Phillip's residence.
pursuant to the application received February 2, 1987, and in conformity with the
project plan, specifications, and other supporting data subsequently filed and
approved by the Department of Natural Resources and Community Development and
considered a part of this permit.
This permit shall be effective from the date of, issuance until April 30, 1992,
and shall be subject to the following specified conditions and limitations:
I. This permit shall become voidable unless the facilities are constructed in
accordance with the approved plans, specifications and other supporting data.
2. This permit is effective only with respect'to the nature and volume of wastes
described in the application and other supporting data.
3. The facilities shall be properly maintained and operat6d at all times.
4. This permit is not transferable.
5. Upon the availability of a municipal or regional. sewerage collection system, the
• subject wastewater treatment system shall be abandoned, and all wastewater
discharge into the municipal or regional sewerage system.
i6. The wastewater treatment system shall be effectively maintained and operated
- at all times so that there is no discharge to the surface waters, nor
any contamination of ground waters which will render them unsatisfactory for
normal use. in event the facilities fai.l. to perform satisfactorily, including the
creation of nuisance conditions, or failure of the irrigation area to adequately
absorb the wastewater, the Permi.ttee shall take such immediate corrective
action as may be required by the Division of Environmental Management.
7. Any monit•ori.ng deemed necessary by the Division of. Environmental Management to
insure surface and ground water protection will be established and an acceptable
sampling reporting schedule shall be followed.
R. Monitoring wells shall be constructed and sampling schedules arranged as
required by the Division of. Environmental Management And constructed in
accordance with 15 NCAC 2C 0.0100.
9. The sludge generated from these treatment facilities must be disposed of in
accordance with General Statute 143-215.1 and in a manner approvable by the North
Carolina Division of Environmental Management.
10. A suitable year round vegetative cover shall be maintained.
11. Dikes shall be constructed so as to prevent surface water runoff from the spray
field.
. 12. The Raleigh Regional Office, Phone No. 91.9/733-2314, shall be notified in
advance of backf.illing and operation of the installed wastewater treatment and
disposal system so that in -place inspection can be made. Such notification to
Regional Supervisor shall be made during normal office hours from 8:00 a.m.
until 5:00 p.m. on Monday through Friday, excluding State Holidays.
13. Wastewater shall not be applied during inclement weather or until twenty-four (24)
hours following a rainfall event of 1/2-inch or greater in twenty-four (24) hours
or when the ground is frozen and in a condition which would result in surface
runoff.
14. Diversion or bypassing of the untreated wastewater from the treatment
and disposal facilities is prohibited.
15. The Permittee, at least six (6) months prior to the expiration of this Permit,
shall request its extension. Upon receipt of the request, the Commission will
review the adequacy of the facilities described therein, and as indicated, will
extend the Permit for such period of time and under such conditions and
limitations as it may deem appropriate.
16. The application rates shall not exceed:
a. 0.33 inches/acre/week
b. 0.20 inches/hr
1.7. The issuance of this permit shall not relieve Mr. Gary Phillips of the
. responsibility for damages to surface or ground waters resulting from the
operation of this facility.
18. The facilities shall be effectively maintained and operated as a non -discharge
system to prevent the discharge of any wastewater resulting from the operation of
this facility.
19. No type of wastewater other than that from the Gary Phillips residence
shall be sprayed onto the irrigation areas.
20. No traffic or equipment shall be allowed on the disposal area except while
installation occurs or while normal maintenance is being performed.
2J. Adequate inspection, maintenance, and cleaning shall be provided by the
permitt.ee to insure proper operation of the subject facilities.
22. The Permittee is responsible for the operation and maintenance of the entire
treatment and disposal system; including, but not limited to, the following
Items:
a. The septic tank shall be checked every six (6) months and pumped out as
required, but no less frequently than once per year.
b. The tablet chlorinator shall. be checked every week until the actual usage
rate is established; and thence, on a monthly basis. Tablets shall be
added so as to provide proper chlorination.
C. The storage and pump system shall be inspected monthly. The scum layer
. shall be removed at the same interval as the septic tank is cleaned out.
The alarm system and pump operation sbal.l be checked.
d. The spray system shall be inspected monthly to make certain of the sprayers
proper operation, that the vegetative growth allows proper spray patterns,
that the soil is absorbing the disposed treated wastewater with no surface
runoff, and that no objectionable odors are being generated.
23. Failure of the Permittee to properly operate this system is subject to a penalty
up to $10,000 per day.
24. Failure to meet permit conditions or violation of the State's surface or
ground water regulations will require cessation of occupancy of the residence.
25. This permit may be voided if an operation and maintenance agreement is not signed
by the permittee and a copy returned to this Division.
26. The sand filter bed and spray irrigation field must be located no closer than 100
feet from any public or private water supply well.
27. The spray irrigation area shall be identified as such and fenced to prevent
access.
28. If excavation into bedrock is required for the septic tank placement, the pit
shall be lined with a 10 mil synthetic liner.
