Hello. My name is Jeanna Cook. I live in the South Mountain area on Wards Gap Road. I am writing to
inform you that the residents In the area would like a public hearing for the water permit renewal for
Pine Mountain.  My husband and my 3 children agree with me that we want to see this dumping in our

Regarding Intent to Issue Wastewater Permit NC0036935 I am requesting full disclosure of any and allviolations and or fines associated under the current permit.  In addition I am requesting information
and explanation as to enviromental impact any violations have caused.  Some areas of specific interestare as follows:
*  The number of violations Pine Mountain Lakes has received and amount of fines associated with
violations.  
*  Can a permit be revoked/suspended.

Pine Mountain has had a waste water treatment plant since about 1974. The system is connected to nearly 30
townhouses, a golf shop, gate house, a restaurant, and a 100 room motel. These properes ha ve been connected
to the system since their construcon and ha ve no other opon f or their waste water.

I am a member of the Pine Mountain Property Owners Associaon, and spouse of the PO A President, Edith S. I
am concerned for her safety and our community. Since my wife’s name is on the permit, she has become a target.
She is a volunteer and puts in about 50 hours a week for the community. It seems that the noce of r enewal has
sparked negav e reacons fr om one parcular neighbor and their f amilies. Kenneth Cook and the Jeanna Cook
families have taken to social media in a Private Group. They are also posng ph ysical signs to “Stop Pine Mountain
Dumping Sewage”. These signs are placed high on power poles, on DOT traffic signs, and on right-of-way property
along road sides. The NCDEQ is accepng public c omments on this issue so you should know that there are many
sides.

Jacobs Fork River runs through the Cook property. They say they are concerned for the river, but they have a dirt
road through the river that connects to a field that they have clear cut for farming. They have not kept a proper
riparian border. Their farm equipment runs through the river washing any petrochemical products into the river.
The dirt road and lled fields ar e a source of sediment to the river. They seem more concerned to cause harm to
Pine Mountain and its members than they are about the health of Jacobs Fork River.

The group at Pine Mountain Resort wishing to dump sewage into Jacob Fork River should not beallowed to do this.   That river runs through South Mountain State park as well as residential areas.
Children play in that river, livestock drinks from it, and and wildlife thrives in and around the area. 
I have witnessed some of the waste from that has floated down stream through my friend’s property.It is disgusting and does not spear to be treated. 
Please do NOT approve or renew this permit.

I would like to start out by saying thank you so much for returning my call this morning, I’m very
appreciative to you for listening to my concerns. Like I stated in our phone conversation our small
community is trying to be proactive to save and support the Jacob Fork River. We are aware that this is a
renewal to a permit that goes back to 1982. Many people have been asked “why the concern now?” Well,
this community was even smaller back in 1982 and most people were not aware of “treated sewage”
from Pine Mountain being dumped into the Jacob Fork River and the ones that were aware had no
knowledge of how to stop it. Pine Mountain was built around 1973 so where did the sewage go for
those 9 years previous to the permit? The Jacob Fork River runs through my property and we are the first
ones to see the sewage and that will receive the repercussions of sewage in the river. My children along
with all families that live on or near the river and all the family friends of everyone are effected by this.
This is also hazardous to livestock, aquatic animals, and all wildlife that live near the river. We have been
informed that the sewage is treated and even treated before it reaches their sewage pond. It is obvious
to the naked eye that this is not true. I’ve taken pictures of the river at my home and you can also see
the sewage pond from the river since it’s right beside it. Pictures alone can prove their is sewage in the
river. I’ve also taken a water sample to have tested out of the river. The area we live in near South
Mountain State Park and Pine Mountain is not in any city or town limits. That being said there is no
sewage or water system. All residents in the area had to pay to put in their own septic tanks and have a
well dug. This is also true to many residents that live in Pine Mountain up pass the motel, lodge,
restaurant, and town houses. This community is only asking to save and protect our fresh water in the
Jacob Fork River. Sewage in the water is extremely hazardous to everyone and all wildlife. The
community is also aware of two people that previously worked for Pine Mountain and quit because they
were afraid of losing their license because what Pine Mountain was doing with their sewage was illegal
and they did not want any part of it. One person was a plumber and the other worked within the
treatment facility. The community has also been aware of Pine Mountain have around 8 previous
violations since 2019 about their sewage. The community’s concern with this of course, how many
violations and fines does it take to put a stop to it. It’s pretty clear that violations are not a successful
consequence for dumping sewage into the Jacob Fork River. They receive a violation, I’m assuming they
pay the fine, but they continue to dump the sewage. The only way to put a stop to damaging our fresh
water is to not approve the renewal of the permit. This community believes that it is only right and fair
that the facilities and such at Pine Mountain put in their own septic tanks just as everyone else has had
to pay to do; in order to fully protect our fresh water, children, livestock, and wildlife. In the past year
more children have become sick from playing in the river and families are speaking with their doctors
about it and how it could be coming from sewage bacteria in the water. Also, another main reason that
the concern has become more of an issue is due to the fact that in all the previous years there was really
no usage of the motel, lodge and restaurant at Pine Mountain. Therefore if no people were staying there
then pretty much no sewage problem. Well, within the past year an organization “TLR” has moved in with
200-300 occupants using the facilities creating lots and lots of sewage that has not been seen previously.
I am going to send you a separate email with the photos that have been taken of the Jacob Fork River.
This community is aware and understands that people in Raleigh are not here to truly see what is

personally would welcome someone from Raleigh with your department to my home and I would guide
them in the river to see for themselves the sewage in the river and they would also be able to smell the
awful waste in the river. I would also like to point out that when we have lots of rain the river floods and
with that being said, so does the sewage pond. Due to the pond being located beside the river, when it
floods the pond sewage also floods straight into the river. Thank you so much for your time and for
reading my long email. Please take into account the importance of fresh water, children, and animals and
this community begs of you to not approve the permit. Again, anyone from your department that would
like to enter into the river just below Pine Mountain Sewage Pond to witness for themself is welcome to

resident of Pine Mtn I am sickened by the actions of the group of people that have taken up residencythere. I am AGAINST this permit. The dumping of sewage into Jacob's Fork is not acceptable. I pray
that you will do the right thing for our community as well as the surrounding areas, considering thisflows into the Catawba River making this a whole bigger issue.

hello . do you know of Jacob's Fork River ? i used to swim in it . my dad and i have rafted it . it's ahealthy waterway, it teems with life; minnows, and turtles, and fish and other wildlife (like crane birds)
come to live at its' waterside . 
     i have immediate family who live in the countryside, closer to FingerBridge Road; and i myselfreside in Burke County . and i have signed a petition . because i want to inform the NC Environment
Management Commission that Pine Mountain Lake WWTP is helping to flow HUMAN WASTE into theJacob's Fork River . 
     there is a sewage treatment plant near the Pine Mountain Development Golf Course . we have
always known about the aging plant; which, today hosts more waste water than it was
designed to filter...hosting the 30 townhouses/condos of the Pine Mountain Estates HOA
Residential Development AND a hotel which was closed until recently; when a group, The Last
Reformation ("TLR") moved into the hotel . the hotel also hosts a restaurant, a golf
shop, and multiple RV hook-ups; but, on the waste water discharge permit
(#0036935)
the permit claims 150 individuals are on the entire sewage system...which,
very simply is not true and so i agree with my county in saying...any request for any
renewal of a waste water discharge permit...should be denied until the sewage
disposal problem is corrected...

Please do not renew this permit. People come all around to swim in our river. By dumping their nastysewege in our rivers it will make people sick. I understand that this had been happening for a while
but now they have more sewage systems hooked up to it and the treatment center cannot support theload. Why would you want to put that nastyness in our water.

Mr. Bennett, Thank you for checking on this. I did not contact, or give my email to anyone in that department. 
Just to reaffirm, I am a resident of Pine Mountain.  We need our sewer plant to serve our community. Not sure why at this time some neighbors find a problem with this. I know our Board has been
keeping up with all necessary deficiencies that are brought to their attention.  I know we can solve thisissue by working together.

I am writing to express my concern regarding a discharge permit for the Pine Mountain Lakes in BurkeCounty.  I believe it is permit no. NC0036935.  It is my understanding that this permit allows discharge
into a creek emptying into the Jacob Fork River and that the facility has been out of compliance onseveral occasions resulting in high levels of fecal coliform bacteria into the water.  This permit covers
the Pine Mountain resort area including houses, golf course, and facilities including restaurant andhotel as well as campsites.  The system appears to be very overloaded.  While I don't live in that area
of the county, this is a beautiful river that is used below the point of discharge for swimming, fishing,canoeing, etc.  and the treatment facility should be of sufficient size and operational to the point that
discharges are safe for the public.  I understand that a new permit has been requested, and I'd likethere to be a public hearing on this matter.  Please notify of such here or in writing at 5169 Little

My name is Jeanna Cook. I live at 8122 Wards Gap Road. I have three children. They are my most prized
possession and recently one of my daughters had a middle ear infection and an inner ear infection and
my other daughter had whats known as swimmers itch and I believe this was due to bacteria and sewage
in the Jacob Fork River. This may just be another permit to you but it is my family I am concerned about.
I urge you to deny this permit and make Pine Mtn clean up the sewage plant and the sewage swamp
they have on their property. I am 100% against this permit and I would love to talk more about this in a
public hearing. I also am concerned that not one person in our area was notified of how much more
sewage than necessary was being dumped in our river. If i had known I would have never let me children
in that water. I beg you to take into consideration the people that live next to the mess and what it is

I am writing you today, to respectfully request that Permit #0036935 not be renewed, or at least delaythe renewal until a public hearing can occur. 
I am a member of the South Mountain community, and have been my entire life. My family still lives
on the same land that was originally settled on in the 1700’s. ( http://www.burkesheriff.org/Mull.htm )Camp Creek is a tributary to Jacob Fork and runs through my land; the creek that I played in as a child
and my children have as well. We also enjoy finding Native American pottery shards and other artifactsin these waters. 
Pine Mountain HOA’s blatant disregard to the health of our waters is irresponsible and inexcusable.
With the addition of the “religious” community inhabiting the old resort, the antiquated system isfailing and functionality is subpar. If this sewage system can’t be immediately replaced with a method
more congruent to current standards, the residents of the Pine Mountain community should berequired to move to individual sewage systems. Also, the time frame for this replacement of
their sewage system or installation of individual septic systems should be less than 6 months.
The allowance of a 3,833.3% over limit release of human waste into our waters should have promptedimmediate action, and public notice to those downstream from this breech. This is only one
occurrence of many. The Pine Mountain Home Owners Association have not shared their fines, oroutfall limit violations to their property owners. 
With the new concerns that we face with COVID 19, are you aware that the whole live virus can be
found in human fecal material. With the concerns of spreading this virus to our most vulnerablepopulations, and the “unknown,” I feel this matter should be addressed as soon as possible.

Pine Mountain Lake, next to South Mountain State Park in Lower Fork Burke County is dumpingsewage in the Jacob Fork River.   Photos have been taken that show the sewage in the river.  People in
our community are asking for a public hearing before this permit is renewed.  Things have changed atPine Mountain since the last renewal.  A religious group called The Last Reformation or TLR has moved
in to the hotel at Pine Mountain.  They are using the hotel as a retreat and have large gatheringsfrequently.   The present permit states 150 individuals are on this sewage system but that is not
correct.  The hotel has about 100 rooms, there are 30 townhomes/condos, a restaurant, and a golfshop that are connected to this sewage system.  There have been many violations in the last year.  The
sewage lines, holding pond and overall system needs updated.
We need your help.  Please help us save our river.

I am strongly against the renewal of this permit. Raw sewage is being dumped into Jacob Fork River by
the 200-300 people living at South Mountain Resort. The River is used by families and farmers down

Dear Mr. Benne,
Please do not renew the permit #0036935 without a thorough public review of the Pine Mountain
Development Golf Course sewage system. If there is any chance that dangerously high levels of
pollutants are entering the Jacob Fork River from the development, that issue must be addressed to
ensure the health of the river system. The Jacob Fork River is a home to wildlife, including trout, and a
beloved recreaon des na on. Also , campers like myself regularly drink water we have filtered from
the river. I am not sure at what point in the course of the river the suspected sewage is entering the
water, hopefully we filter and drink above that point. However, 2 weeks ago, I was hiking and I swam in
the river before I le the park, so I entered the water at a down stream locaon. Some of the w ater
went up my nose, and it seemed unusually painful. I have swum in many mountain rivers and had
plenty of water up my nose, this feeling was painfully unique. And, several days later I developed a
fungal infecon. I don't kno w what caused this really, I knew I was swimming downstream from a lot of
people also. But I haven't had a fungal infecon be fore, so when I heard about possible sewage
contaminaon, I de finitely took note.
The Jacob Fork Rivere and South Mountains State Park are a precious natural resource. Many people
enjoy quality family me and r ecreang in the beauful na tural environment there. It's a treasure for all
North Carolinians. Please do what needs to be done to protect the water quality. A sewage system can
be replaced and updated so it works properly, an enr e wildlife habitat can't as easily be fixed.

Mr. Bennett--  I write to oppose the renewal of Pine Mountain Resort's WWTP permit.
Further, I am requesting that you arrange a virtual PUBLIC hearing on this issue. 
I am making this request as a concerned citizen and frequent visitor of the South
Mountains and of many areas downstream of Pine Mountain Resort. Jacobs Fork
River is an invaluable Outstanding Resource Water (ORW) that deserves all efforts to
maintain that status.  I am also quite aware of the historic compliance issues related
to this plant.

As a lifelong resident of North Carolina, I was recently appalled to learn of the proposed dump oftreated sewage from the Pine Mountain resort into the Jacob’s Fork River. 
It’s unconscionable to allow further dumping against the advice of Riverkeepers such as David
Caldwell and Brandon Jones. 
I ask that you listen to the concerns expressed by Mr. Jones, myself, and countless other residents whohave zero tolerance for the further destruction of our environment and natural resources. 
Please hold a virtual meeting for the pubic in order to fully inform those you serve, and please listen to
those calling for more prudent behavior on behalf of our land.

SIGNS
Families are posting MANY signs on the road we live on - Ward's Gap Road - including one right across from our Pine Mountain entrance. This is
also the entrance to our Golf Business. This seems to be an attempt to hurt our business - which is struggling now anyway.
The signs are numerous and starting to feel like harassment. photos attached.
This group has drilled holes into STOP signs and bolted on their signs!! They post signs in Road right-of-ways - mistakenly thinking that is open for any individual to post a protest
sign.
I live at Pine Mtn. All homes on the mountain each have their own septic systems.
* No one from the concerned group has contacted or discussed the issue with anyone at P.M. nor with anyone on our Board. Our Board members have offered to talk and even explain and
our waste water system. * And I do not question anyone's right to be concerned about the environment.
THE PETITION
Some issues listed in Mrs. Jeanna Cook's petition on Change.org:
#1. "Swimmer's Itch" The petition blames this rash on Pine Mtn waste water. According to the Mayo Clinic: "Also known as cercarial dermatitis, swimmer's itch is most common in fresh
ponds, but it occasionally occurs in salt water.
Swimmer's itch is a rash usually caused by an allergic reaction to parasites that burrow into your skin while you're swimming or
wading in warm water."

#2. Ear Infections can be caused by any river water or no water at all - I would imagine. Not a Dr but I have had ear infections in the middle of winter.
#3. COVID-19 . Recent signs posted by concerned families are stating "COVID is in Blood and blood is in sewage." This is simply NOT TRUE. There has been NO case of COVID transmiss
thru blood - as it is airborne. This is a sad attempt to incite fear!

CONCERN
It is hurtful to read these comments from people who don't take 15 minutes to LEARN The truth.
I am afraid things could escalate. The temps are hot and everyone seems stressed from COVID and the continued state Lockdown.

I wish to add my voice (and attached photos) - to Ms. Edie Stitt's letter below.
This has been very stressful for me and other homeowners.
The concerned community has NEVER contacted anyone at P.M. 
We have posted on their Social Media comments that we would talk, discuss, explain, even give a tourof the sewer system. These offers went ignored. 
We first learned of their concern thru signs posted onto state road Stop Signs. They drilled holes thru
State signs & attached their signs with bolts. (Attached). 
There are many signs posted on either side of our Pine Mountain entrance. These
signs are misleading and some are outright lies!
This is the main entrance to our homes - as well as our Golf Business (which is
struggling).
These signs are not helping our business- which is possibly one motive.
We have TLR "The Last Reformation" with Torben Sondergaard /and owner Fred
Waugh at 100 room hotel / restaurant holding full and even overflow events- yet not
paying their true share. There were 100s of people in tents, campers and in hotel
over July 4th.
There seem to be full time residents at the hotel. The parking lot has campers, RVs,
and many out of state vehicles.
We have our own septic tank - as do all other single family homes on Pine Mtn. Yet,
our dues will continue to increase to subsidize the sewer & water system.

2.) We have sought help from the state and our operators with the wastewater treatment plant
(WWTP) problems and received NO EFFECTIVE solutions. Meanwhile, we have complied or are inprocess of complying with all requests/demands - even knowing the outcome will not change.
Meters and weed-eating will not change the results, in other words. We have taken great care to do what was advised as fast as we are physically and financially able to
do it.-No inspection report from the state has ever found its way to my desk. 
3.) Last August-September the commercial facilities within Pine Mountain’s border, (which have not
been fully operational since 1998,) opened and hosted hundreds of people in a one-hundred roomhotel and a separate restaurant. This was when many problems began, of late. In addition, while
these facilities are being invoiced, they are not paying Pine Mountain’s POA for their capacity- ascharged. They invite RVs and Campers to dump their wastes into our sewer system. 
4.) Environlink- our operator- had N.C. Rural water help with a smoke test to find potential leaks in
the system. None were found. Envirolink has been trying to arrange for another smoke test in thecommercial facility area to determine whether or not they are dumping storm water into the WWTP.

5.) “Slick Rock” at Jacob’s Fork River on Ward’s Gap Road is an attractive nuisance not far from the
WWTP. There are dirty diapers always left on site in the river, people wash their cars and trucks inthat river, and leave trash. The Catawba River Keepers are never onsite cleaning it up. Residents of
Pine Mountain do.
6.) There are three structures/homes/business leeching their sewage directly into White Oak Creekon Wards Gap Rd near Pine Mountain’s entrance. We have no authority to change this condition, yet
it could directly affect the water quality - before it reaches Pine Mountain’s effluent, just a shortdistance away.
7.) The ‘neighbors’ stirring up the hate and public disgust- have removed acres of riparian barrier to
Jacob’s Fork River, farm up to its banks, and have a road that runs through it—- ALL of whichdirectly affect water quality.
8.) Pine Mountain’s Board of Directors has been committed and ACTIVELY seeking resolution to our
problems. The vicious aggressive and egregious attacks against our community has beenundeserved. When trying to engage the agitators into productive conversation, they refuse, delete
our factual representation on social media, and escalate the ugliness.
Municipalities dump sewage into the rivers during rain events, Duke dirties rivers with coal ash run-off, the vindictive combative neighbors filth the river of their own accord; all the meanwhile the state
hammers punitively at this small community-owned system. No help.
Pine Mountain POA has paid $4200/month to a private operator over the last year for theoperations and testing of the system; we have made thousands of dollars in repairs and
maintenance; and yet we are still having difficulties. This is an expense to be shared among theusers and the largest entity is not paying. This subsidy is harming the affordability of living at Pine
Mountain- where the WWTP has 35 customers.
In light of the situations that confront us; the neighbors that don’t know what they are talkingabout, the lack of problem resolutions from the the state of NC and our operator; and the punitive
strangling from the state, The Board of Directors -all volunteers- have concluded that the propertyowners association should not be in the sewage business.
We tried to turn it over to a private entity, but considering it is not a money-maker, we can’t evengive it away.
If you can provide direction to the process, I am ready to sign all rights, the equipment, the land itoccupies, and the operations of Pine Mountain’s Wastewater Treatment Plant to the state of North
Carolina- in best respect and comfort to all the parties involved.

 Randy Cook – July 14, 2020 – Expressed concern that waters be protected since they were Class A
waters. Didn't think the facility had been discharging for years, now with the hotel open felt that
flow will increase. Thinks they should do something else with their sewage like handle onsite.
Mentioned erosion around the pond and also noted State park near by and questioned impact to
that.
 Debra Cook – July 17, 2020 - Want to dispute permit. Commented that the facility hasn't
discharged in years. Said there was slime and sewage in the water. Noted hotel now has a group
using it again and was concerned that they are dumping straight into the stream from there. Felt
that the facility wasn't monitored at all and just left on their own. Wanted to stop the discharge and
make them do an onsite system. Mentioned Class A waters.
 Unknown – Voicemail message – Commented that the lake looks like raw sewage. Issue needs a
public hearing. Noted religious group taking over the hotel. A lot more people than before and
more flow, etc. No info on who left the call.
 Tim Ashbrunner – August 3, 2020 – Commented that Jacob Fork had always been clean etc. Sees
signs and number to call locally. If true that there is raw sewage and people getting sick, then this
needs to stop.
