DANIEL SMITH Director Mr. James B Best 439 J B Wilson Road Newton Grove, NC 28366 Subject: Notice of Deficiency Jimmy Best Farm AWS820102 Sampson County NOD-2020-PC-00456 Dear Mr. Best: NORTH CAROLINA Environmental Quality September 29, 2020 On September 3, 2020 staff of the NC Department of Environmental Quality (DEQ) Division of Water Resources (DWR), Water Quality Regional Operations Section (WQROS) inspected the Jimmy Best Farm and the permitted waste disposal system. We wish to thank Mr. Jimmy Best and farm staff for their assistance during the inspection. As a result of this incident, you are hereby notified that, having been permitted to have a non - discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2T Section .1300, you have been found to have been found to be in violation of your permit as follows: Deficiency 1: Failure to maintain the collection, treatment, and storage facilities, and the land application equipment and fields shall be properly operated and maintained at all times, [15A NCAC 02T. 1304(b)] in accordance with Condition II 1. of Swine Waste System General Permit No. AWG100000. On September 3, 2020 during your Routine Compliance Inspection, DWR staff documented that one of your pop in solid set sprinklers had been broken off by hay harvest equipment. This allowed waste to drain out of the irrigation system and pond in the field and make its way to the woods. You stated that you had repaired two other broken sprayers and had found this one with plans to repair it later in the day. You or your farm staff failed to see that waste was flowing from the underground pipe and contain such waste to prevent it from leaving the field. Prior to DWR staff departing the farm it was documented that you had contained the waste. On September 9, 2020, Greer Moore reported that you had repaired the broken hydrant pipe. You stated that you did not have isolation valves in your irrigation system, but it would be helpful to install these. This would allow you to turn off each zone for repair and allow you to pump in other zones. In addition, you need to make sure the hydrants on the lower end of the system are not allowed to drain after each spray event. You are required to take any necessary action to address the above violation: The Division of Water Quality requests that, in addition to the specified corrective action above, please submit the following items on or before October 31, 2020. 1. An explanation from the OIC for this farm regarding how this violation occurred. 2. A list from the OIC concerning the steps that will betaken to prevent these violations from occurring in the future. 3. Documentation that the irrigation line has been repaired. Failure to comply with conditions in the permit may result in a recommendation of enforcement action, to the Director of the Division of Water Resources who may issue a civil penalty assessment of not more than twenty-five thousand ($25,000) dollars against any "person" who violates or fails to act in accordance with terms, conditions, or requirements of a permit under authority of G.S. 143-215.6A If you have any questions concerning this Notice, please contact Steve Guyton at (910) 303-0151 or at Steve. guytongncdenr. _ og_v.
