The 3,080-gallon sanitary sewer overflow(SSO)occurred due to a severe natural condition (SNC) of excessive rainfall. According to the Community Collaborative Rain, Hail and Snow Network, the total rainfall from 7:00 AM June 811 to 7:00 AM June 9th was 7.3 inches. For the three days of storm events(June 8, 9, and 10),the total rainfall was 11.9 inches. Due to this SNC,our system received flows from inflow/infiltration (1/1) into our Catawba Avenue pump station that exceeded its capacity. This station receives 100%of the flow in our collection system and conveys wastewater to the Burke County system. 2. We acted promptly to prevent any SSO's if possible. As soon as it was evident the storm was going to potentially cause excessive 1/1 flow,we contacted our contract pumping and hauling service, Bumgarner Septic Tank&Grading. This was call made at 8:05 PM. We also actively managed our other pump stations to prevent them from all pumping toward the Catawba Avenue pump station simultaneously. The driver for Bumgarner was not able to get to the pump truck quickly due to the normal route to his truck being blocked by high water. He had to take a detour. The pump truck arrived and started pumping by 10:10 PM at which time the SSO was stopped. This delay in arrival of the pump truck was,outside of our control and was due to the SNC,which not only affected our collection system but also local roads. 3. The nearby wastewater treatment plants that normally accept hauled septage or wastewater were not accepting any during the storms. This illustrates the severity of the storms. Thankfully,we have empty storage tanks on our property that we were able to use for temporary storage of the excessive flow. 4. The appearance of the SSO water was very clear, indicating it was primarily stormwater and therefore caused little to no health or environmental impact. 5. The Town of Rhodhiss has been making significant improvements to its collection system to reduce 1/1 sources. A one million-dollar improvements project was completed last year. A $400,000 project is scheduled to start later this year. 6. The Town spent$3,600 for the pump truck services (30 loads), in addition to paying overtime for our employees. ORC is not required for this deemed system,but taking this step/cost is a smart move for the Town. 6) Whether the violation was committed willfully or intentionally; Neither 7) The prior record of the violator in complying or failing to comply with programs over which the Environmental Management Commission has regulatory authority; Since January 2017 there have been four NOV's issued, associated with five SSO's reported. The notice requested a detailed explanation of what we plan to do to eliminate these types of spills in the future. Our system had been neglected for decades which causes a sever influx of rain water that we can normally control with alternating pumps and the utilization of a large vacuum pump truck, but on this night we were just overrun.As of this morning I have received the notice that our CDBG to repair and replace our water/sewer system is ready for distribution and that NCDENR will be here in July to go over the process,get signatures, and get us prepped for construction. To try to explain which areas and when would take volumes of paper, let's just say the entire system is being overhauled from stem to stern and the work should begin after the July meeting. I tried to print off the map but since it's the whole town it didn't come out right. If you still need this information I will see if the engineers can print one off that I can hand deliver to you. First, regarding your letter of November 26, 2007, we agree that it would be beneficial to salvage the old septic tanks for use as emergency storage in the event of pump failure and/or excessive inflow/infiltration(I/I)events. However, in each case it will not be possible. In the case of the Northside(Caldwell County)Pump Station,the Town had to promise to remove the old tanks and pump station in order for the property owner to grant the land for the new pump station (the old septic tanks conflict with a fixture road the property owner may build). In the case of the Southside(Burke County)Pump Station,the new pump station will be considerably down gradient from the old tank. Thus, any surge flows will fill up the wetwell and surrounding lines and manholes before the old septic tank would fill up. Therefore,due to the elevation difference the old septic cannot be used as an emergency storage tank. The new pump stations will both have standby power generators. However,the Town should continue to find and eliminate sources of 1/1. Second, regarding your April 21, 2008 letter, I examined the"rodding and lugging" of the discharge piping at the Caldwell-side new pump station. The contractor installed'/4"threaded rods between the discharge elbows and a concrete"deadman"outside the wetwell. He used bent eye-bolts to connect the threaded rods to the flanges of the elbows. The bent eye-bolts appeared to me to be manufactured in the bent position, not bent in the field. Furthermore, Mr. Franklin of Wilkie Construction stated to me that the eye-bolts were purchased already bent. Therefore, I am satisfied that the connections will withstand any thrust forces normally anticipated for this syste,r. If you need additional information, please let me know. In March 2000, the North Carolina Environmental Management Commission enacted rules related to sewage collection systems. These rules are now found in the North Carolina Administrative Code 15 NCAC 2T .0403 for deemed permitted facilities. They include facilities with a privately-owned collection system that serve condominiums, apartments, mobile home parks, subdivisions, shopping centers, colleges, etc. that are tributary to larger municipally owned systems, yet are not owned or managed by the municipality. If you are aware of any such privately-owned collection systems, we would also like to be informed of their existence. In addition, we would like to know where any privately-owned pump stations are located that are connected to your collection system. The type of information we are requesting is the facility name, location and contact person. If that system is in a state of disrepair or if you have received complaints about it previously, please note that as well. Your attention to this request is most appreciated. We have been notified of problems at some of these facilities in the past and have had a difficult time locating the responsible party to affect a repair to the problem. In order to comply with the regulation the following specific criteria is required by 15 A NCAC'02T .0403: (1) The sewer system is effectively maintained and operated at all times to prevent discharge to land or surface waters, and to prevent any contravention of groundwater standards or surface water standards. (2) A map of the sewer system has been developed and is actively maintained. (3)An operation and maintenance plan including pump station inspection frequency, preventative maintenance schedule, spare parts inventory and overflow response has been developed and implemented. (4) Pump stations that are not connected to a telemetry system (i.e., remote alarm system) are inspected by the permittee or its representative every day (i.e., 365 days per year). Pump stations that are connected to a telemetry system are inspected at least once per week. (5) High-priority sewers are inspected by the permittee or its representative at least once every six-months and inspections are documented. (7) Overflows and bypasses are reported to the appropriate Division regional office in accordance with 15A NCAC 02B .0506(a), and public notice is provided as required by G.S. 143-215.1C. (8) A Grease Control Program is in place as follows: (A)For publicly owned collection systems, the Grease Control Program shall include at least biannual distribution of educational materials for both commercial and residential users and the legal means to require grease interceptors for new construction and retrofit, if necessary, of grease interceptors at existing - establishments. The plan shall also include legal means for inspections of the grease interceptors, enforcement for violators and the legal means to control grease entering the system from other public and private satellite sewer systems. (B) For privately owned collection systems, the Grease Control Program shall include at least biannual distribution of grease education materials to users of the collection system by the permittee or its representative. (C) Grease education materials shall be distributed more often than required in Parts (A) and(B) of this Subparagraph if necessary to prevent grease-related sanitary sewer overflows. (9) Right-of-ways and easements are maintained in the full easement width for personnel and equipment accessibility. (10) Documentation shall be kept for Subparagraphs (a)(1)through(a)(9) of the Rule for a minimum of three years with exception of the map, which shall be maintained for the life of the system. (b) Private collection systems on a single property serving an industrial facility where the domestic wastewater contribution is less than 200,000 gallons per day shall be deemed permitted. (c) The Director may determine that a collection system should not be deemed to be permitted in accordance with this Rule and Rule .0113 of the Subchapter. This determination shall be made in . accordance with Rule .0113(e) of the Subchapter. Please be advised that the Asheville Regional Office will be performing NPDES Wastewater Collection System inspections sometime in the near future. If this office has not previously inspected your wastewater collection system and records of same, you should be prepared to demonstrate compliance with all criteria listed above. In an effort to promote compliance with the regulation and offer assistance please see enclosed a copy of the 02T regulation regarding deemed wastewater collection system O & M. Also,this office has a WWTP Consultant on staff to offer assistance to you in complying with the requirements of the regulation.
