This inspection was conducted to verify that the facility is operating in compliance with the conditions and limitations specified in NPDES WW Permit No. NCG530158. A summary of the findings and comments noted during the inspection are provided in the enclosed copy of the inspection report. The Compliance Evaluation inspection was conducted by Division of Water Resources staff from the Asheville Regional Office. The following deficiency(s) was noted during the inspection: Inspection Area Description of Deficiency Effluent Sampling Required anlyses per permit condition Part 1, Section A for Total Suspended Solids and Settleable solids not available. The first settling pond appears to be full of solids and is not being maintained adequately. The BMP fails to reference any maintenance procedures for the pond. Please address the solids in the pond immediately and revise the BMP to include a maintenance schedule. A follow-up inspection will be scheduled for April 2021; and, 2. You are to notify the Division within 30 days of receipt of this letter as to the ownership status of the treatment ponds. If you no longer own the lower ponds, you will need to discuss options with Division staff to assure adequate treatment. Remedial actions should have already been taken to correct this problem and prevent further occurrences in the future. The Division of Water Resources may pursue enforcement action for this and any additional violations of State law. To prevent further action, carefully review these deficiencies and address the causes of non-compliance to prevent the recurrence of similar situations. NCG530158 I11 12I 20/09/21 117 18 ICI Section D: Summary of Finding/Comments (Attach additional sheets of narrative and checklists as necessary) Site inspection was conducted by Kevin Mitchell and Tim Fox with the Asheville Regional Office on September 21, 2020. Howard Brown was present during the inspection. The site visit began with an overview of the facility operations. The facility grows — 350,000 pounds of rainbow trout per year and utilizes — 5-6 million gallons of water per day. The facility uses settling ponds and keeps daily feed rate records to manage solids. Monitoring records for total suspended solids, settleable solids, dissolved oxygen,and flow were not available per permit requirements. Monitoring results need to be maintained and available on site for a minimum of three years. First settling pond/raceway appears to be exceeding capacity. Immediate maintenance is required. A follow up inspection will be scheduled for April 2021 to ensure maintenace is complete. It is also worth noting that the settling ponds south of Trout Haven Lane are not under the ownership of the trout farm facility.
