Section 3.e has been revised to call out Tract 3 as the tract receiving runoff from
pipes "A" & "D".
2) Please find enclosed two (2) sets of the revised plans showing the correct lot line
between the future tracts 3 & 4. The lot line between tracts 2 & 3 goes down the
middle of Currituck Drive.

(d) Each parcel owner shall provide sufficient'parking spaces in accordance with
the Town of CedarPoint Zoning and Building Regulation Ordinances on the parcel and off the sheet
prior to the use and occupancy of any, building constructed on the parcel.
(e) With regard to the two access streets (Currituk Drive andBodie Drive) as well
as other stormwater ditches or swales along any parking areas, property perimeters, or other
locations, each parcel owner shall be required to install a culvert and driveway over the swales or
stormwater. dirtching for continuous flow of stormwater. No parcel owner shall pipe either of the

without prior appro o a stormwater plan revision from Division of Water Quality. No parcel

submitted to and approved by the Architectural Control Committee. The Architectural Control
Committee is authorized to permit decorative fencing or screening for landscaping, courtyard or

Dear Mr. Farrington:
The Wilmington Regional Office received a Stormwater Management Permit Application for
The Village at Magen's Bay on January 19, 2005, and received application modifications on
February 10, 2005. A preliminary review of that information has determined that the
application is not complete. The following information is needed to continue the stormwater
review:
Please include statements in the restrictive covenants that specifically identify
Tract 3 as being responsible for treating Currituck Drive and Bodie Drive
stormwater runoff for any future, high density, outparcel development.
2. Please clarify Tract 2, Tract 3, and Tract 4 property lines on the plans.
Please note that this request for additional information is in response to a preliminary review.
The requested information should be received by this Office prior to February 18, 2005, or the
application will be returned as incomplete. The return of a project will necessitate resubmittal of
all required items, including the application fee.
If you need additional time to submit the information, please mail or fax your request for a time
extension to the Division at the address and fax number at the bottom of this letter. The
request must indicate the date by which you expect to submit the required information. The
Division is allowed 90 days from the receipt of a completed application to issue the
permit.
The construction of any impervious surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is 'a violation of NCGS 143-215.1 and is subject
to enforcement action pursuant to NCGS 143-215.6A.

Dear Mr. Bartlett:
This letter is in response to comments in your letter dated January 21,2005.
1. Note #7 on Sheet 1 of 4 has been revised to read 25% instead of 30% built upon.
2. Article III, Section 3 (e) of the Draft Covenants has been revised as requested.
3. Article III, Section 8 of the Draft Covenants has been revised as requested.
4. Article III, Section 8 (B) of the Draft Covenants has been revised as requested to address
Stormwater Permits for the future lots along Hwy 24.
As previously discussed, Article III, Section 3 (e) and section 8 (B) of the Draft Covenants
have been revised to address the treatment swales for the two access drives.
Plans have been revised per your request.
In addition to the above revisions, Bodie Drive was moved Eastward about 70 feet to line up with Lois
Drive, across Hwy 24, as requested by NCDOT. Also, per our discussion, the catch basin in the entrance
drives have been moved closer to Hwy 24. Also, the owner requested that the Northern boundary line be
moved closer to Hwy 24 to encompass the swale parallel to the parking lot. This changes the overall
project area and the percent built upon. See the revised Narrative and Application Form.
Please find enclosed two (2) sets of revised plans and two (2) copies each of the revised: Page 1 & 2 of
4 of the Permit Application, Page 1 & 2 of 2 of the Low Density Supplement, Stormwater Narrative and
the Draft Restrictive Covenants.

The Village at Magens Bay is being developed as a residential condominium
project. The site consists of 8.4 acres. The project will have 12 condominium
buildings. Runoff from the asphalt parking areas will sheet flow into grassed swales

flow thru grassed swales with 5:1 side slopes prior to draining to a swale along Hwy 24.
When the front tract is developed, a Stormwater Permit will be applied for at that time.

The Wilmington Regional Office received a Stormwater Management Permit Application for
The Village at Magen's Bay on January 19, 2005. A preliminary review of that information has
determined that the application is not complete. The following information is needed to
continue the stormwater review:
1. Please revise Sheet 1 of 4, Note #7 to read 25% instead of 30% or less built
upon area.
2. Please delete the current Article III, Section 3.(e) of the restrictive covenants and
replace with a deed restriction that no parcel owner can have access to that
portion of the swale treating runoff from access drives (i.e., Pipe A and Pipe D
northward to Highway 24).
3. Please revise Article 111, Section 8 of the restrictive covenants bty, inserting
"uncovered" before the words "wood decking..." on page 11, 15 line.
4. Please specify the maximum built -upon area in Article III, Section 8.13. of the
restrictive covenants for each outparcel, and please include statements regarding
the high -density requirement for stormwater treatment systems for each
outparcel.
5. Please include statements in the restrictive covenants that specifically identify
which outparcels are responsible for treating drainage from Bodie Drive and
Currituck Drive, as previously requested.
6. Please add "TYP" to the dimensions on Building 9.
Please note that this request for additional information is in response to a preliminary review.
The requested information should be received by this Office prior to January 28, 2005, or the
application will be returned as incomplete. The return of a project will necessitate resubmittal of
all required items, including the application fee.

DECEMBER 2004
The Village at Magens Bay is being developed as a residential condominium
project. The site consists of 7.7 acres. The project will have 12 condominium
buildings. Runoff from the asphalt parking areas will sheet flow into grassed swales
with 5:1 side slopes then eventually discharge into the Highway 24 storm drain system.
