Based on the information you provided, it is likely that the proposed armoring can be authorized under NWP 13 without
notification.

Hi Eric. I wanted to touch base and see if you had any additional comments or concerns. If not, can you confirm that we
are ok to not modify the existing permit and utilize a NW 13, or if you prefer to put it under the existing GP31? I need to
know, because the DWR permit will need to be a written authorization either way. Thanks.

Thanks Eric! This is the first time I’ve run into impacts being cumulative (left bank plus right bank). My apologies for not
knowing! We have reduced the impacts to 475’, so we are below the threshold for written authorization for both USACE
and DWR..
1. Pictures on the west bank are included in the attached email.
2. The river has received numerous floods (including record high water) since construction started. The area
downstream of the project where the failure occurred had no vegetation removed for construction. There was a
causeway in the river immediately upstream of the failure. The causeway may have caused the failure, but its
hard to be certain given the flood events.
3. Pictures prior to work beginning are in the attached email.
The attached email is from our Assistant Resident on the project. He provides a good explanation of why we need to
armor the east bank as well. Let me know if you have any questions.

Amy: Since the proposed armoring is on opposite banks of a large river, we look at them separately re: lf of impact. If
nationwide permit 13 is applicable, the greater than 500 lf of impact would require a waiver by the Corps if we can make

the determination that the discharge will result in no more than minimal adverse environmental effects. A PCN should
include information that supports no more than minimal adverse environmental effects.
To determine if a mod of the permit is required, I need additional info:
1. Please provide photos of the area of the west bank that needs armoring.
2. Is the bank failure on either bank related to the construction activities for the bridge , such as woody vegetation
removal?
3. Do you have any photos of the proposed armor areas before the bank failure, either before or during
construction?

Subject: [Non‐DoD Source] I‐0911A Yadkin River bank erosion
The I‐0911A project in Forsyth and Davie Counties is currently under construction. It involves widening I‐40 and building
new bridges over the Yadkin River. We have had several large rain events since the start of construction, and the river
has been out of its banks many times during construction. We have had a bank failure that needs to be repaired (see
attached photos). This failure occurred just beyond the limits of the causeway. We would also like armor the banks of
the river inside the project limits to aid in long term stability.
Here is an estimated quantity for armoring:
East Riverbank – Approx. 350’ x 12’(8’high @1.5:1) = 4200sf
West Riverbank – Approx. 250’ x 12’(8’high@1.5:1) = 3000sf

Total square feet of stream impact= 7200sf = 0.165ac
Total linear feet of stream impacts= 350’
We could either do a permit modification for the existing GP31 or do a NW13. Let me know what your preferences
are. Copies of the existing permits can be found here.
