Hi Charles,
I just did an inspection of NC0033251. The WWTF hasn't been used in 10 years and the pipes are disconnected from the
camp plumbing. They have an installed subsurface drip system now that's been permitted by Henderson County
(attached).
Mr. Fitzgerald said he doesn't need this permit anymore and would like it rescinded.

In accordance with the provisions of Article 11 of Chapter 130A, General Statutes of North Carolina as
amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

operation of 12,000 GPD wastewater collection, treatment and disposal system. The collection,
treatment and disposal system consists of two 3,000 gallon existing septic tanks in series; 1-3,360
gallon pump tank; duplex control panel pumping system, on/off timer controls, and audible/visible
high water alarm system; two 3-inch force mains 6-3,000 gallon septic tanks in series [with 2 Zabel
A300-12x36-VC effluent filters in the final septic tank]; 2-5,400 gallon recirculation tanks; 1-5,400
gallon filter bed dosing tank; 16 EZ Treat Model 650 pods and associated appurtenances; 2-5,400
gallon pump tanks; duplex control panel pumping system, on/off timer controls, and audible/visible
high water alarm system; one 3-inch supply line, drip irrigation headworks box and associated
appurtenances; and 4 subsurface drip irrigation fields (18,094 linear feet total) with no discharge of
wastes to the ground surface or to surface waters, pursuant to the application received June 18, 2008
and in conformity with the project plan, specifications, and other supporting data previously filed
and approved by the Henderson County Department of Health Department (Local Health
Department) and the Department of Environment and Natural Resources (DENR) and considered a
part of this permit.
This permit shall be effective from the date of issuance until April 20, 2021 (five year operating
period) and shall be subject to the following specified conditions and limitations:
1. PERFORMANCE STANDARDS
1. The owner is subject to all provisions of Article 11 of Chapter 130A of the General Statutes
and 15A NCAC 18A .1900 et.seq. The owner is especially referred to Rules .1935
(29,31), .1937 (d,e), .1938(g),.1.945(a,b), .1950(a through I), .1961 (a through d), .1965,
.1967 and .1968.
2. All tenants are prohibited from operating a garbage disposal or grinder.
3. All tenants are prohibited from disposing of any chemical cleaners or any other
potentially inhibitory/interfering substance into the wastewater system, including but not
limited to quaternary ammonia compounds. Except for meeting the conditions for
sanitizing as set forth in the permit issued by Henderson County Department of Public
Health for the Summer Camp.
4. The facility is prohibited from disposing of out-of-date or damaged food goods into the
wastewater system, including but not limited to milk, ice cream, juice, and soft drinks.
5. The Permittee shall keep the plumbing in the facility in good repair and eliminate leaks,
drips, or excess flows as they occur. Use of low flow fixtures and water conservation is a
condition of this permit, and must be continued for the life of this system.
6. The issuance of this permit shall not relieve the Permittee of the responsibility for damages
to surface or groundwater resulting from the operation of this facility.
7. The wastewater treatment and disposal facilities shall be effectively maintained and
operated at all times so that there is no discharge to the ground surface or to surface waters.
In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions or failure of the subsurface disposal area to adequately assimilate the
wastewater, the Permitee shall take immediate corrective actions including those actions
that may be required by the Local Health Department, such as the construction of
additional or replacement wastewater treatment and disposal facilities, upon receipt of a
repair permit
8. Residuals generated from these treatment facilities must be treated and disposed in
accordance with the Federal Regulations codified in 40 CPR 503 and in a manner approved
by the Division of Solid Waste.
9. Diversion or bypassing of the untreated wastewater from the treatment facilities is
prohibited.
II. OPERATION AND MAINTENANCE REQUIREMENTS
1. The facilities shall be effectively maintained and operated as a sub -surface disposal system
to prevent the discharge of any wastewater to the ground surface or surface waters resulting
from the operation of this facility. The Permittee is responsible for operating and
maintaining the septic tanks and pump tanks of the owners, in addition to the pressure
sewer and all subsequent parts of the treatment and disposal system.
2. This system is classified as a Type VIa subsurface system. The Owner shall contract with
or employ a certified subsurface system operator to be in responsible charge (ORC) of the
wastewater treatment facilities. The operator must hold a valid certificate at all times as a
Certified Subsurface Systems Operator. The Owner must also contract with/employ a
certified back-up operator and comply with the conditions of 15A NCAC 8A .0202. The
ORC must visit the facility/system at least twice a week when the system is energized and
the facilities are prepared for operation and until the facility/system is closed for the season.
The ORC must visit the facility/system after it is closed at least twice to ensure that no
components have been damaged due to storms, wildlife, or other occurrences. The ORC
must properly manage and document operation and maintenance of the system and must
comply with all other conditions of 15A NCAC 8A .0202. The Owner must submit a letter
to the Local Health Department, which designates the Operator in Responsible Charge
prior to Operation Permit issuance, and within thirty (30) days upon any changes.
3. Gravity collection system and effluent supply lines shall be inspected at least bimonthly by
walking the lines and checking for settlement, leakage, or wet areas. The collection system
shall be maintained as follows:
• Visual inspections of manholes and connecting sewer lines and shall be.
conducted at least bimonthly, and the septic -tank inlet during every monthly ORC
inspection.
• If visible accumulation of sewage is evident, it shall be washed thoroughly
with fresh water into the sewer lines/septic tank.
• If accumulation of solids has not been removed by flushing, then the lines shall be
rodded with appropriate sewer line cleaning equipment.
• A log of inspections that shows the date of inspection, condition of segment, and
maintenance undertaken shall be maintained.
• Any additional clogging of these lines shall be remedied on an as -needed
maintenance. All emergency maintenance shall be noted in the inspector's log.
• Any spills of sewage shall be immediately reported to the Henderson County
Department of Public Health at (828) 694-6060.
4. The septic tanks and grease tanks shall be inspected bi-weekly for influent/effluent line
blockage, tank leakage, structural integrity, condition of the baffles, effluent filters and
tees, and solids accumulation. Blockages or leaks shall be repaired. The effluent filters
shall be cleaned whenever the tanks are pumped, or as otherwise needed, and repaired or
replaced if necessary. The septic tanks (both chambers) shall be pumped annually, when
the solids level exceeds one-third of the liquid capacity of the tank in the inlet chamber, or
as otherwise determined necessary by the ORC or the LHD. The grease interceptors shall
be pumped out semi-annually, or as otherwise approved by the Henderson County
Department of Public Health. Ground surface around the tanks shall be inspected for areas
of settling or pending of surface water. These areas are to be re -landscaped, as needed.
5. The recirculation tanks and pump tanks shall be inspected bi-weekly for proper operation,
leaks and solids accumulation. Leaks shall be repaired and solids removed whenever the
septic tank is pumped or as otherwise found to be necessary. Pumps, controls, floats, and
alarms shall be checked for proper operation. All components of the pump/control systems
shall be kept in compliance with design standards. Pump elapsed time and cycle counter
readings shall be recorded and evaluated to ascertain proper pump cycling.
6. The EZ Treat pods shall be in service at all times and shall have media in accordance with
approved design specifications or approved modifications. Surface debris shall be
manually removed as needed but at least [monthly. The operating pressure in the pods shall
be monitored bi-weekly. The EZ Treat pods for the fats, oil, and grease removal system
shall be inspected at least once a week and the mattresses should be cleaned or changed out
as needed.
7. Pump flow rates to the dripfields shall be tested at least two (2) times per year by the
following method:
• Determine depth of water in pump tanks, by measuring difference in depth from
top of riser to bottom of the tank, mimes depth to liquid surface. Determine
depth of liquid in tank.
• Run pumps from three (3) to five (5) minutes.
• Re -measure depth of liquid in tanks and similarly determine gallons of water
pumped based upon gallons/inch drawdown. Compute pump rate in gallons per
minute from drawdown volume divided by pump run time.
• Compare design/startup filter pumping rates to measured pumping rates. If
necessary, make adjustments to the timer controls and pump on -off levels to
deliver design dose volumes to filters and to drainfields each dosing cycle.
8. Drainfields shall be inspected at least monthly for seepage or saturation, surface water
ponding or settled ground surface, broken pipes, maintenance of vegetation, protection
from traffic, and diversion of surface water, The owner/operator shall be responsible for
assuring any broken pipe, manifold tap, cleanouts, etc., are repaired within 48 hours of
becoming aware of such a problem.
9. A suitable, year-round vegetative cover shall be maintained on the disposal areas. The
grass height should be no longer than six inches. Clippings and other landscape debris
shall be removed from the disposal area as needed to prevent thatch buildup. No traffic
or other equipment shall be allowed on the disposal fields, with the exception of
mowing equipment, without the permission of the operator and Henderson County
Department of Public Health. The application of chemicals to the distribution fields is
prohibited.
10. All event counters and runtimers shall be recorded weekly. This log shall be maintained
on -site.
III. MONITORING AND REPORTING REQUIREMENTS
1. Any monitoring (including groundwater surface water, soil or plant tissue analyses)
deemed necessary by the Local Health Department to ensure surface and ground water
protection will be established and an acceptable sampling reporting schedule shall be
followed.
2. As an indicator of proper operation and maintenance, the facility shall produce an
effluent in compliance with the following limitations:

The effluent pH shall not be less than 6.0 standard units or greater than 9.0 standard units.
" Monthly averages for all shall be the arithmetic mean of all samples collected during the
reporting period.
The effluent from the subject facilities shall be monitored, by the Permittee, from the final
pump tank for the following parameters:

All effluent sampling, preservation and analysis must be completed in accordance with the
requirements of 40 CFR 136 and at a wastewater lab certified by the state of North Carolina for the
specific analysis.
3. Two (2) copies of all effluent monitoring data shall be submitted on or before the last day of the
following month that the sample was collected. All information shall be submitted to the following
address:

4, Two (2) copies of the operator inspection reports shall be submitted on or before the last day of
January, April, July, and October and must include the inspection reports for the previous quarter.
This report must include the inspections of all parts of the wastewater collection, treatment and
disposal system. An effluent data summary table shall also be included in the report. All
information shall be submitted to the following address:

5. An on -site record shall be maintained of all residuals removed from this facility. This record shall
include the name of the hauler, permit authorizing the disposal or a letter from a municipality
agreeing to accept the residuals, date the residuals were hauled, and volume of residuals removed.
6. A maintenance log shall be maintained at this facility including but not limited to the following
items:
a. Sampling Results
b. Visual observations of the plant and plant site.
c. Record of preventative maintenance.
d. Dates pod distribution laterals are cleared of solids, manifolds are inspected and pressure head
checked/adjusted.
e. Results of wastewater delivery rate and dosing volume measurements, and any adjustments
made to filter or drainfield timer control settings.
f. Dates, times, and duration of site visits.
7. Noncompliance Notification:
The Permittee shall report by telephone to the Henderson County Department of Public health,
telephone number (828)694-6060, as soon as possible, but in no case more than 24 hours or on
the next working day following the occurrence or first knowledge of the occurrence of any of the
following:
a. Any occurrence at the wastewater treatment facility which results in the treatment of
significant amounts of wastes which are abnormal in quantity or characteristic, such as the
dumping of food waste; the known passage of a slug of hazardous substance through the
facility; or any other unusual circumstances.
b. Any process unit failure, due to known or unknown reasons, that render the facility incapable
of adequate wastewater treatment such as mechanical or electrical failures of pumps, fans,
etc.
C. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass
directly to ground surface or receiving waters without treatment of all or any portion of the
influent to such station or facility.
d. Any time that self -monitoring information indicates that the facility has gone out of
compliance with its permit limitations.
Persons reporting such occurrences by telephone shall also file a written report in letter form
within five (5) days following first knowledge of the occurrence. This report must outline the
actions taken or proposed to be taken to ensure that the problem does not recur. When repairs are
needed in accordance with NCGS 130A-334(9)(a) and 15A NCAC 18A .1961(c), the permitted
must obtain a repair permit from the Local Health Department prior to making the repair.
IV. GROUNDWATER REQUIREMENTS
1. The COMPLIANCE BOUNDARY for the disposal system is specified by regulations in
15A NCAC 2I., Groundwater Classifications and Standards. The Compliance Boundary
for disposal systems constructed after December 31., 1983 is established at the property
boundary. An exceedance of Groundwater Quality Standards at or beyond the
Compliance Boundary is subject to immediate remediation action in addition to the
penalty provisions applicable under General Statute 143-215.6A(a)(1).
In accordance with 15A NCAC 2L, a REVIEW BOUNDARY is established around the
disposal systems midway between the Compliance Boundary and the perimeter of the
waste disposal area. Any exceedance of standards at the Review Boundary shall require
remediation action on the part of the permittee.
2. Any additional groundwater quality monitoring, as deemed necessary by the Division,
shall be provided.
V.
I .The Permittee or his designee shall inspect the wastewater treatment and disposal
facilities to prevent malfunctions and deterioration, operator errors and discharges which
may cause or lead to the release of wastes to the environment, a threat to human health,
or a nuisance. The Permittee shall keep an inspection log or summary including at least
the date and time of inspection, observations made, and any maintenance, repairs, or
corrective actions taken by the Permittee. This log of inspections shall be maintained by
the Permittee for a period of three years from the date of the inspection and shall be made
available upon request to the Local Health Department or other permitting authority.
2.Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to
ensure proper operation of the subject facilities.
Any duly authorized officer, employee or representative of the Local Health
Department or DENR may, upon presentation of credentials, enter and inspect any property,
premises or place on or related to the disposal site or facility at a reasonable time for the
purpose of determining compliance with this permit; may inspect or copy any records that must
be maintained under the terms and conditions of this permit, and may obtain samples of
groundwater, surface water, or influent wastewater or effluent wastewater.
VI. GENERAL CONDITIONS
1. This permit shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans and specifications, and other supporting
data.
2. This permit is effective only with respect to the nature and volume of wastes described in
the application and other supporting data.
3. An Administering, Inspection and Compliance fee may be established by the Henderson
County Board of Health or DENR.
4. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Local Health Department or DENR.
5. Prior to a transfer of this land to a new owner, a notice shall be given to the new owner that
provides full details of the materials applied or incorporated at this site.
6. The issuance of this permit does not preclude the Permittee from complying with any and all
statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
7. The Permittee for the life of the project must retain a set of approved plans and
specifications for the subject project.
8. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its
extension.

SHALL BE RESPONSIBLE FOR ADEQUATE SUPERVISION TO PREVENT DAMAGE AND MOVEMENT FROM EQUIPMENT WORKING AROUND
CONSTRUCTION STAKES. THESE CONSTRUCTION STAKES SHALL REMAIN IN PLACE AND BE PROTECTED UNTIL OWNER APPROVES THEIR REMOVAL.
ANY STAKES THAT HAVE BEEN DISPLACED AS A RESULT OF CONSTRUCTION ACTIVITY ARE TO BE REPLACED BY A LICENSED LAND SURVEYOR
ENGAGED BY THE CONTRACTOR AT NO COST TO THE OWNER.
I. UPON COMPLETION OF THE WORK, THE CONTRACTOR SHALL CLEAN THE ENTIRE SITE OF ALL CONSTRUCTION RELATED MATERIAL OR DEBRIS
TO THE OWNERS SATISFACTION.
J. THE ENGINEER WILL NOT BE CONTINUOUSLY PRESENT IN THE FIELD. IT IS SPECIFICALLY UNDERSTOOD THAT HE DOES NOT UNDERTAKE NOR
ASSUME ANY OBLIGATION FOR SUPERVISION OF CONSTRUCTION, SAFETY MEASURES TAKEN DURING THE COURSE OF CONSTRUCTION,
RESPONSIBILITY FOR SCHEDULING THE WORK, FOR INSURING COMPLETE COMPLIANCE WITH THE CONTRACT DOCUMENTS. IN ADDITION, THE
ENGINEER NEITHER UNDERTAKES, ASSUMES, NOR GUARANTEES THE WORK AND/OR PERFORMANCE OF THE CONTRACTOR. HOWEVER, THE
ENGINEER MUST CERTIFY THE COMPLETED PROJECT PRIOR TO OPERATION OF THE WASTEWATER IRRIGATION SYSTEM TO INSURE THE PROJECT
HAS BEEN COMPLETED IN GENERAL ACCORDANCE WITH THE APPROVED PLANS. THE ENGINEER WILL MAKE PERIODIC INSPECTIONS DURING
CONSTRUCTION TO VERIFY GENERAL COMPLIANCE WITH THE APPROVED PLANS.
K. ALL EXISTING IMPROVEMENTS DAMAGED AS A RESULT OF CONSTRUCTION OPERATIONS SHALL BE RESTORED TO THEIR ORIGINAL CONDITION,
TO THE OWNERS SATISFACTION.

PRESSURE BELL ASSEMBLIES, AND ANY OTHER PERTINENT ITEMS INSTALLED FOR THIS PROJECT. PACKAGE MUST BE SUBMITTED PRIOR TO
CONSTRUCTION FOR ITEMS REQUIRING SUBSTITUTION APPROVAL OR AT FINAL INSPECTION FOR ITEMS NOT CHANGED FROM APPROVED PLANS.
INVOICES, PACKING SLIPS OR DELIVERY CONFIRMATION PAPERWORK ARE ACCEPTABLE. FINAL ENGINEERING CERTIFICATION WILL NOT BE
