DANIEL SMITH Director NORTH CAROLINA Environmental Quality September 21, 2020 DWR # 20180765 Ver 5 Jackson County Daniel Communities Attn: Mr. Owen Schultz 1525 Highway 107 South Cashiers NC 28717 Subject: REQUEST FOR ADDITIONAL INFORMATION High Hampton Redevelopment Dear Mr. Schultz: On August 10, 2020, the Division of Water Resources — Water Quality Programs (Division) received your application fee to complete your request dated July 13, 2020 for a modification to the Individual Water Quality Certification #WQC004212 issued by the Division on May 12, 2020 for your project. The modification is requesting an after -the -fact approval for an additional 122 linear feet of stream impacts and 0.02 acres of wetland impacts that have occurred beyond those approved in WQC#004212. Upon review of your request, the Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: The modification application indicates that the new impact areas being requested were previously proposed as impacts for golf holes 1 through 9. The application also notes that through redesign these areas were proposed to be avoided. Please provide a copy of the original detailed design of golf holes 1 through 9 which shows impacts to the areas noted in the modification request, and a copy of the revised detailed design of golf holes 1 through 9 which shows avoidance of impacts to the areas noted in the modification request. The Division is unclear how the current proposal meets avoidance and minimization when the approved design avoids impacts to these areas. 2. The Division is unclear how unexpected inconsistencies with contours align with proposed and revised impacts/designs. Please further explain the unexpected inconsistencies which occurred and explain how these inconsistencies are unique to this site within the project. In order to ensure compliance with the Individual Water Quality Certification issued by the Division, it is required that you provide a detailed list of all approved impacts indicating which impacts have occurred to date. Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. Please respond in writing within 30 calendar days of receipt of this letter by sending one (1) copy of all of the above requested information to the 401 & Buffer Permitting Branch, 1617 Mail Service Center, Raleigh, NC 27699-1617 OR by submitting all of the above requested information through this link: hLtps:Hedocs.deq.nc.gov/Forms/Supplemental-Information-Form (note the DWR# requested on the link is referenced above). If all of the requested information is not received within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee. Please be aware that you have no authorization under the Water Quality Certification Rules for this activity and any work done within waters of the state may be a violation of North Carolina General Statutes and Administrative Code.
