E State of North Carolina Department of Environment, Health and Natural -Resources Division of Environmental Management James B. Hunt, Jr., Governor Jonathan B. Howes, Secretary Nann B. Guthrie, Regional Manager Asheville Regional Office WATER QUALITY SECTION June 10, 1994 Mr. Mike Sorrells Forest Technician USFS Post Office Box _-275.0_____-_._. Asheville, North Carolina 28802 Subject: NOTICE OF VIOLATION Second Quarter 1994 of Compliance Evaluation Inspection NPDES Permit Number NCO020494 Schenck Job Corps Wastewater Treatment Facility Transylvania County, Dear Mr. Sorrells: The -subject inspection was conducted May 5, 1994, by Ms. Kerry Becker. The attached inspection report indicates, the effluent - generated was in compliance with permit limits. However, many of the maintenance and operational problems noted in previous inspections still exist. Failure to properly maintain and operate all wastewater treatment facilities is a violation of the requirement stated in Part II Section C.2 of your NPDES permit. The following observations and results regarding the treatment facility are: 1. West Aeration Basin and Clarifier (35,000 gallon) The dissolved 'oxygen concentration was 0.2 mg/l; cracked and worn diffusers have resulted in inefficient transfer of oxygen to' the basin. The dissolved oxygen concentration should range between 1.0 - 2.0 mg/l. The 30 minute settleable solids was 60%. The mixed liquor suspended solids concentration was 4100 mg/l. Grease was present on ,the.surface of the clarifier; its presence can lead to excessive oxygen demand Interchange Building, 59 Woodfin Place, Asheville, N.C. 2880.1 Telephone 704-251-6208 FAX 704-251-6452 An Equal Opportunity Affirmative Action Employer 50% recycled/ 10% post -consumer paper Mike Sorrells _.. June 10, 1994 Page Two further aggravating the low dissolved oxygen situation in the basin. 2. East Aeration Basin and Clarifier (25,000 gallon) The dissolved oxygen concentration was 4.2 mg/l; it needs to be adjusted to 1.0 - 2.0 mg/l. The 30 minute settleable solids was 80%; mixed liquor suspended solids was 4600 mg/l. The sludge blanket depth in clarifier was 3'1/2 feet; the supernatant contained pin floc. Clumps of dark solids were floating on the clarifier surface. Grease was also evident on the surface of the clarifier. 3. Excessive inflow and infiltration is still a problem. The operator. cannot keep from.losing solids nor maintain proper chlorination rates during heavy rains. An active program to locate and repair/replace leaking lines and manholes needs to be implemented. 4. Rising clumps of solids were present in the polishing tanks. A slight odor of septicity was also present. 5. Current method of sampling is' still not flow proportioned; the end of sampling line is exposed when tank the is siphoned of contents. The line needs to be attached so that it remains below the surface of the water but above the solids level in bottom of tank. 6. BOD analyses of the influent still suggests possible effacts of toxicity. The lack of flow equalization, excessive inflow/infiltration, the marginal to poor condition of the diffusers in the aeration basins, and lack of solids handling facilities have led to the loss of solids from this system. The facility has managed to remain in compliance with permit limits due to the presence of the large. polishing tanks and the polishing pond. Mike Sorrells June 10, 1994 Page Three Based upon your telephone conversation with Ms. Becker on June 2, 1994, funding for "band -aid" repairs is forthcoming. Please notify Ms. Becker when these monies are available and provide as well a tentative schedule denoting the timeframe for initiation and completion of repairs. If you should have any questions, please give Ms. Becker a call at 704/251-6208. Sincerely, RoynMavis, Regional Supervisor -- Division of Environmental Management Enclosure xcm Kerry S. (1st Quarter) Schenck Job Corps Wastewater Treatment Facility NPDES Permit Number NCO020494 Transylvania County Dear Mr. Sorrells: An inspection was conducted March 23,.1994, of the wastewater treatment facility serving the Schenck Job Corps.' As the attached inspection report and laboratory sheets indicate', the facility appeared to be experiencing toxic conditions. Cleaning solutions are the most obvious potential source of toxicity, however, other discharges that occur as.a result of Job Corps training and/or ;activities are also potential sources. All staff as well as the janitorial staff at the Schenck Job Corps should be instructed as to the proper use and disposal of waste solutions to prevent future toxicity problems. Several of the problems noted in previous inspections still exist, however, I do realize that these are being addressed and will be resolved once the budget is finalized. Please keep me informed of the progress of the renovations. If you should have any questions, I can be contacted at 704-251-6208, ext. 258. Sincerely, Kerry S. During the :needing, three major options for f nprovement of the cx enw situation at the center's wastewater treatment. facilities were discussed. nese options included: a) Upgrade of the Center's current wastewater tmatment facilities and the continuation of p: ✓sent operations; _ b) Construction of anew treatment facilities and th6 replacement of the cvsrreut system; and c) Connection of the Center's sewer System to the sewer colleetioh lines of the City of Brevard (approMmately one mile from the Center) A-11 of the above alternatives were thoroughly discussed at the meeting. It was mutually agreed by all attendees, Eliot the upgpdo of the current system did not seem to present a viable option, primarily because the Center's wastewater treatment facilities are aged and severely deteriorated. use cost of the upgrade could easily exceed any short term benefit from it, particularly since the center will eventually have to replace the current existing facilities. Both cptiow b and c represent more viable altawtivess, and definitely deseYve full consideration. The feasibility *w d cost analysis study Should commence as soon as possible, fiw two masons: 1) To prevent the possibility of fiatwe fines and/or penalties that the center may in= due to the Staters concems; and 2) It would be a nee -mq sL-p for the m rater to pry with the seleedon process, and prepare the specifimdon plans and caistruction befom-tbe Center's NPDES permit =Pfres in 1995. Once completed„ thin results and Wing of the f=°biLty/cod analysis report should. be the basis for al selection of the most appropriate option. Meanwhilet as a short teem solution to some of the immediate concems of the DE(as expressed in the NOV} DTS recommends the following: • Tme Center should provide necessary mpasrs to the amtion tmiks's diffusors in order to avoid any potential for septic conditions in the tank. a The levol of chlorivation should beinawsedto prevent any future fecal coliform permit limit violation. erbert S. Breen, Jr. ck Status and Trip Report November 29, 1993 Page 3 Flow equalization tank should be modified to provide a more uniform daily flow, thus preventing the solids form being washed out from the main unit. Becker conducted the fourth quarter Compliance Evaluation Inspection of the wastewater treatment facility serving Schenck Job Corps in Transylvania County. As the enclosed inspection report indicates, many of the problems that have been noted in previous inspections have not been corrected. As a reminder Parts II B.1 and C.2 of the Schenck Job Corps NPDES Permit require that all conditions of the permit be complied with and that the treatment facility and related appurtenances be properly operated and maintained at all times. Failure.to do so constitutes a violation of the permit. Dissolved oxygen levels in both aeration basins were inadequate and'appeared to have been for some time. The activated sludge was not healthy and the supernatant was not clear. Nitrified solids were floating in the clarifier. Although the effluent, was in compliance with permit effluent limits, this result certainly did not reflect the poor condition of the treatment facility. The only reason this facility can achieve compliance is due to the long detention times provided by the polishing ponds. As was discussed during the October 20, 1993 meeting, the • best solution to the problem is connection to public sewer. Until that time, proper operation of this facility obviously will require more operator attention than is being provided. Post Office Box 2750 Asheville, North Carolina 28802 Subject: NOTICE OF VIOLATION Schenck Job Corp NPDES Permit Number NCO020494 Transylvania County Dear Mr. Sorrells: An inspection was conducted August 8, 1993 of the Schenck Job Corp Wenter wastewater treatment plant by Ms. Kerry S. Becker. A copy of the inspection report is enclosed for your reference. Although the effluent data, with the exception of fecal coliform, indicated compliance with permit limits, the facility was in poor condition. The condition of the main treatment unit along with the collection lines warrant serious repair. Parts II B.1 and C.2 of the Schenck Job Corp's NPDES Permit require that all conditions of the NPDES Permit be complied with and that all treatment facilities and related appurtenances be properly operated and maintained at all times. The fecal coliform result of 1700 colonies/100 ml is a violation of the daily maximum limit of 400 colonies/100 ml contained in the permit. The following problems were noted: 1. Aeration basin Dissolved Oxygen (D.O.) concentrations were extremely low, 0.4-0.5 mg/l, resulting in poor settling. The aerators were operating at full capacity and still were not able to bring the D.O. up to 1.0 mg/l. This was due to the condition of the diffusors. 2. Those diffusors that were, not clogged were generating large bubbles of air which are inefficient for oxygen transfer. 3. Diffusor lines are old and cracked in places. • 4. Solids were overflowing effluent weirs into the large settling basin. 5. There is no flow equalization. The large surge tank prior to the treatment facility does not equalize the flow but Interchange Buiding, 59 Woodfin Place, Asheville, N.C. 28801 Telephone 704/251-6208 Fax 704/251-6254 An Coual. OUportunity Affirmaliv<r Aci-ion F.molover Fpe Sorrells ptember 2, 1993 age Two rather surges it. The "flow equalization" tank from the campground surely is a misnomer. This tank is far too small to provide any equalization. 6. The treatment plants are of unequal size. The operator cannot with any precision proportionately split the flow with the system currently in place. 7. According to the operator, the flow meter has not been calibrated within the past 2 years. 8. According to DEM regulations, composite samples are to be flow proportioned and taken at the end of the treatment processes. Although composite samples are being taken at the facility, they are not flow proportioned due to the location of the instrument. 9. As evidenced from the flow charts and the frequent surging (approximately every 20 minutes) of the treatment facility during rainfall events, Inflow/Infiltration (I/I) is a real • problem. Peak flows from I/I are causing solids to wash out of the treatment plant into the fine solids settling basin. 10. With the current method of operation, the operator is unable to determine the rate of chlorination. Chlorination occurs in a batch fashion since the chlorine tank doses rather than continuously discharges. 11. The grounds around the final polishing pond need to be trimmed. Weeds have been allowed to grow in such a manner as to prohibit access. In addition, with as much solids loss as this facility experiences, the pond may need to be cleaned out. 12. At present, the Center uses one of the fine solids basins as a sludge holding tank. There is not enough capacity, otherwise, to store wasted sludge. This facility has several maintenance and design problems which do not allow for efficient operation and have resulted in poor effluent quality from the main treatment units. The large size of the fine settling basins, the large chlorination tank, and the polishing ponds have enabled the Schenck Job Corp to meet the effluent limits in spite of the condition of the treatment plant. This facility is old and worn out and there is increasing demand on system. This facility also discharges to a stream which has been ,the classified as a water supply, and, although the stream at this point does not carry a "B" classification, it is used on a frequent basis for tubing and wading. The current permit is, due to expire November 30, 1995. rpe Sorrells tember 2, 1993 age Three Connection to public sewer or development of plans and specifications for the construction of a new wastewater treatment facility should be started now so that construction can beqin by the time the permit renews in 1995. In the interim, the collection lines should be replaced or repaired. Flow equalization could be achieved by using one of the .fine solids basins as an equalization chamber. Installing an electric pump to pump the waste back up to the aeration basin would allow a constant flow of influent to the treatment plant instead of a surge. The diffusors will need to be replaced, the flow .meter calibrated, and the grounds around the polishing pond trimmed. Some method of collecting samples in proportion to flow will have to be established. Chlorination may have to be increased to bring the fecal coliform count down. It is the recommendation of this office, however, that the treatment facility be replaced with one that lends itself to good operational control. Please respond in writing to this office no later than September 30, 1993, of the actions or proposed actions taken to address. the concerns and violations noted above. Please be aware that these and all other violations can lead to the initiation of enforcement proceedings against the U.S.F.S. resulting in the assessment of civil penalties. A copy of the inspection report is enclosed for your records. At the time of the inspection, the treatment plants appeared to be operating well with good color in the aeration basins; however, the solids inventory in the system appeared to be quite excessive. There was evidence that a good amount of solids had been lost to the polishing ponds and are now causing problems in the effluent. The polishing ponds, in addition to having excessive floating solids, were'generating a lot of algae. As you are aware, the treatment plant is old and there is increasing demand on the system. Also the plant discharges to a water supply stream. Since there is a sewer line available less than a mile away, the Division recommends connection to public sewer as the most environmentally sound approach to dealing'with the wastewater generated by the Federal facilities in the area. • In the interim, more consistent operation of the facility would be possible if flow equalization were provided. This could be accomplished using one side of the polishing pond as an equalization tank. In addition to the plumbing, an extra pump would be required. In addition Interchange Building, 59 Woodfin Place, Asheville, N.C. 28801 • Telephone 704-2516208 n_ c_.._t nik_.__..a..— A-.:-.- -olids washout caused by peak flows, the additional .Livw u11ivuyii wie ocher polishing pond would reduce the residence time and lessen the algae problem. Since these tanks are generously proportioned, there probably would not be a trade off in the loss of settling in the effluent tank. If you wish to discuss the inspection or the reconfiguration, please let me know. Sincerely, W. E. Tedder, Chairman JIM GILPIN USDA SCHENCK JOB CORPS WWTP PO BOX 2750 ASHEVILLE NC 28802 Dear Mr. Gilpin March 7,1994 Ag47J0 L), EHNFi Subject: Classification of Collection Systems NPDES Permit No. NCO020494 Transylvania County Because of the environmental and health risks that can be associated with improperly operated and maintained collection systems, new regulations were recently enacted that require certain collection systems to be classified and for the classified system to designate an operator in responsible charge. The regulations, effective July 1, 1993, require that collection systems that are operated in conjunction with wastewater treatment facilities permitted to municipalities, regional facilities or water and sewer authorities, public utilities, Class III and Class IV state-owned facilities and Class II, Class III and Class IV federally owned facilities be subject to rating as a collection system. The collection system will be assigned the same classification as the wastewater treatment facility to which it is tributary or the collection system will be assigned a classification based on the population served by the collection system, whichever would provide the lower classification. Any collection system, regardless of ownership, may be classified if it is determined by the Commission or its designees that there is a failure to properly operate and maintain the system. Once a collection system is classified, the permittee must designate an operator of the appropriate grade to operate the collection system. The Commission will establish a date for the designation of the operator that will allow the permittee a sufficient time frame for training and certifying an operator. The initial classification of the collection systems will be a lengthy and arduous task. The first step in classifying the systems will be collecting the data that is essential in identifying the systems and other relevant information. The information requested on the enclosed form will provide the Commission with much of the material needed for the classification of the collection system. Please route the Collection System Information form to the appropriate person, have them complete it and return the completed form by April 15, 1994 to: Division of Environmental Management Training and Certification Unit Collection System Information P.O. On October 1, 1989 our revised water quality regulations became effective establishing a new water quality classification called High Quality Waters (HQW). These waters are defined as "...waters which are rated as excellent based on biological and physical/chemical characteristics through division monitoring or special studies, native and special native trout waters (and their tributaries) designated by the Wildlife Resources Commission, ... water supply watersheds which are either classified as WS-I or WS-II ..." In November of 1989, Division staff held public hearings throughout the state on the proposal to reclassify many waters as HQWs based on this definition. The information package for these hearings is enclosed for your reference. Portions of th are included on th High Quality Water Trout Waters by t descriptions of t 29, 32, and 33 of ® the Davidson River Fork Pigeon River of Bee Branch are h h e Davidson River and the East Fork Pigeon River e list of waters proposed for classification as s because they have been designated as Native e Wildlife Resources Commission. The ese specific proposals can be found on pages the enclosed information package. Essentially, from its source to Avery Creek and the East from its source to a point 0.5 miles upstream proposed for High Quality Waters designation. Pollution Prevention Pays P.O. Box 27687, Raleigh, North Carolina 27611-7687 Telephone 919-733-7015 An Equal Opportunity Affirmative Action Employer 40 It is anticipated that the Environmental Management Commission will consider this package of proposals at their meeting on May 10, 1990. In order to protect the water quality of waters classified as HQW, new or expanded wastewater discharges must have advanced treatment, and new developments requiring a Sediment/Erosion Control Plan must meet specific criteria to control stormwater runoff. The HQW regulation begins on page 1 of the enclosed water quality regulations. Restrictions applied to new or expanded wastewater discharges can be found in 15A NCAC 2B .0201(d)(1), and restrictions on development can be found in .0201(d)(2). The existing water quality classifications for the Mills River are as follows: 1) from its source to 500 feet below NC Highway 91 is classified as Class WS-III Trout (a water supply); and 2) from 500 feet below NC Highway 91 to the French Broad River is classified as Class C. North Carolina's water quality standards and classifications (15A NCAC .0200) can be referenced for descriptions of the different classifications and the standards with which they are associated. The Division of Environmental Management supports the Forest Service's efforts to include the Davidson, East Fork Pigeon and Mills Rivers in the National Wild and Scenic Rivers System. Box 2750 Asheville, North Carolina 28802 Subject: Renewal of NPDES Permit No. NCO020494 Transylvania County Dear Permittee: fflu.WA EHNF=1 zG`—saw _ i 1 j t{ ;aa i .:`"` The subject permit expires on 951130. North Carolina General Stature 143.215.1(c) requires that an application for permit renewal be filed at least 180 days prior to the expiration date. As of the date of this letter, the Division of Environmental Management has not received an application for renewal. If continuation of the permit is desired, failure to request renewal at least 180 days prior to expiration will result in a civil assessment of at least $250.00. Larger penalties may be assessed depending upon the delinquency of the request. If operation of a discharge or waste treatment facility is to occur after the expiration date of the permit, or if continuation of the permit is desired, it must not be allowed to expire. Operation of the waste treatment works or continuation of a discharge after the expiration date would constitute a violation of NCGS 143-215.1 and could result in assessment of civil penalties of up to $10,000 per day. A renewal application shall consist of the following information: 1. A letter requesting the renewal. 2. The completed application form (copy attached), signed and submitted in triplicate. 3. A processing fee (see attached schedule) in accordance with 15A NCAC 2H .0105(b). The application processing fee is based on the design or permitted flow, whichever is appropriate. 4. Primary industries listed in Appendix A of Title 40 of the Code of Federal Regulations, Part 122 shall also submit a priority pollutant analysis in accordance with Part 122.21. 5. Facilities which have not been constructed within the last permit cycle and are therefore, considered "new" facilities, shall also submit an Engineering Alternatives Analysis, referenced in 15A NCAC Subchapter 2H .0103 and Subchapter 2B .0201(c). 6. If the facility covered by this permit contains some type of treatment works, a narrative description of the sludge management plan must be submitted with the application for renewal. In addition to penalities referenced above, a permit renewal request received after the expiration date will be considered as a new application and will require the higher application fee. 15A NCAC 2H .0105(b)(2) requires payment of an annual Administrative and Compliance Monitoring fee for most permitted facilities. You will be billed separately for that fee (if applicable), after your permit is approved. Two Letter to Mike Sorrell February 22,1995 The letter requesting renewal, the completed permit application, and appropriate fee should be sent to: Mr. David A. Goodrich Permits and Engineering Unit Division of Environmental Management/WQ Section Post Office Box 29535 Raleigh, North Carolina 27626-0535 The check should be made payable to the North Carolina Department of Environment, Health, and Natural Resources which may be abbreviated as NCDEHNR. Part II Page 1 of 14 PART II STANDARD CONDITIONS FOR NPDES PERMITS The Director of the Division of Environmental Management. 2. DEM or Division Means the Division of Environmental Management, Department of Environment, Health and Natural Resources. Used herein means the North Carolina Environmental Management Commission. The Federal Water Pollution Control Act, also known as the Clean Water Act, as amended, 33 USC 1251, et. seq. a. The "monthly average discharge" is defined as the total mass of all daily discharges sampled and/or measured during a calendar month on which daily discharges are sampled and measured, divided by the number of daily discharges sampled and/or measured during such month. It is therefore, an arithmetic mean found by adding the weights of the pollutant found each day of the month and then dividing this sum by the number of days the tests were reported. The limitation is identified as "Monthly Average" in Part I of the permit. b. The "weekly average discharge" is defined as the total mass of all daily discharges sampled and/or measured during the calendar week (Sunday - Saturday) on which daily. discharges are sampled and measured, divided by the number of daily discharges sampled and/or measured during such week. It is, therefore, an arithmetic mean found by adding the weights of pollutants found each day of the week and then dividing this sum by the number of days the tests were reported This limitation is identified as "Weekly Average" in Part I of the permit. c. The "maximum daily discharge" is the total mass (weight) of a pollutant discharged during a calendar day. If only one sample is taken during any calendar day the weight of pollutant calculated from it is the "maximum daily discharge." This limitation is identified as 'Daily Maximum," in Part I of the permit. Part lI Page 2 of 14 d. The "average annual discharge" is defined as the total mass of all daily discharges sampled and/or measured during the calendar year on which daily discharges are sampled and measured, divided by the number of daily discharges sampled and/or measured during such year. It is, therefore, an arithmetic mean found by adding the weights of pollutants found each day of the year and then dividing this sum by, the number of days the tests were reported. This limitation is defined as "Annual Average" in Part I of the permit. a. The "average monthly concentration," other than for fecal coliform bacteria, is the sum of the concentrations of all daily discharges sampled and/or measured during a calendar month on which daily discharges are sampled and measured, divided by the number of daily discharges sampled and/or measured during such month (arithmetic mean of the daily concentration values). The daily concentration value is equal to the concentration of a composite sample or in the case of grab samples is the arithmetic mean (weighted by flow value) of all the samples collected during that calendar day. The average monthly count for fecal coliform bacteria is the geometric mean of the counts for samples collected during a calendar month. This limitation is identified as "Monthly Average" under "Other Units" in Part I of the permit. b. The "average weekly concentration," other than for fecal coliform bacteria, is the sum of the concentrations of all daily discharges sampled and/or measured during a calendar week (Sunday/Saturday) on which daily discharges are sampled and measured divided by the number of daily discharges sampled and/or measured during such week (arithmetic mean of the daily concentration values). The daily concentration value is equal to the concentration of a composite sample or in the case of grab samples is the arithmetic mean (weighted by flow value) of all the samples collected during that calendar day. The average weekly count for fecal coliform bacteria is the geometric mean of the counts for samples collected during a calendar week. This limitation is identified as "Weekly Average" under "Other Units" in Part I of the permit. c. The "maximum daily concentration" is the concentration of a pollutant discharge during a calendar day. If only one sample is taken during any calendar day the concentration of pollutant calculated from it is the "Maximum Daily Concentration". It is identified as 'Daily Maximum" under "Other Units" in Part I of the permit. d. The "average annual concentration," other than for fecal coliform bacteria, is the sum of the concentrations of all daily discharges sampled and/or measured during a calendar year on which daily discharges are sampled and measured divided by the number of, daily discharges sampled and/or measured during such year (arithmetic mean of the daily concentration values). The daily concentration value is equal to the concentration of a composite sample or in the case of grab samples is the arithmetic mean (weighted by flow value) of all the samples collected during that calendar day . The average yearly count for fecal coliform bacteria is the geometric mean of the counts for samples collected during a calendar year. e. The "daily average concentration" (for dissolved oxygen) is the minimum allowable amount of dissolved oxygen required to be available in the effluent prior to discharge averaged over a calendar day. If only one dissolved oxygen sample is taken over a calendar day, the sample is considered to be the "daily average concentration" for the discharge. It is identified as "daily average" in the text of Part I. Part II Page 3 of 14 f. The "quarterly average concentration" is the average of all samples taken over a calendar quarter. It is identified as "Quarterly Average Limitation" in the text of Part I of the permit. g. A calendar quarter is defined as one of the following distinct periods: January through March, April through June, July through September, and October through December. a. Flow, (MGD): The flow limit expressed in this permit is the 24 hours average flow, averaged monthly. It is determined as the arithmetic mean of the total daily flows recorded during the calendar month. b. An "instantaneous flow measurement" is a measure of flow taken at the time of sampling, when both the sample and flow will be representative of the total discharge. c. A "continuous flow measurement" is a measure of discharge flow from the facility which occurs continually without interruption throughout the operating hours of the facility. Flow shall be monitored continually except for the infrequent times when there may be no flow or for infrequent maintenance activities on the flow device. a. Composite Sample: A composite sample shall consist of: (1) a series of grab samples collected at equal time intervals over a 24 hour period of discharge and combined proportional to the rate of flow measured at the time of individual sample collection, or (2) a series of grab samples of equal volume collected over a 24 hour period with the time intervals between samples determined by a preset number of gallons passing the sampling point. Flow measurement between sample 'intervals shall be determined by use of a flow recorder and totalizer, and the present gallon interval between sample collection fixed at no greater than 1/24 of the expected total daily flow at the treatment system, or (3) a single, continuous sample collected over a 24 hour period proportional to the rate of flow. In accordance with (1) above, the time interval between influent grab samples shall be no greater than once per hour, and the time interval between effluent grab samples shall be no greater than once per hour except at wastewater treatment systems having a detention time of greater than 24 hours. In such cases, effluent grab samples may be collected at time intervals evenly spaced over the 24 hour period which are equal in number of hours to the detention time of the system in number of 'days. However, in no case may the time interval between effluent grab samples be greater than six (6) hours nor the number of samples less than four (4) during a 24 hour sampling period. b. Grab Sample: Grab samples are individual samples collected over a period of time not exceeding 15 minutes; the grab sample can be taken manually. a Arithmetic Mean: The arithmetic mean of any set of values is the summation of the individual values divided by the number of individual values. Part 11 Page 4 of 14 b. Geometric Mean: The geometric mean of any set of values is the Nth root of the product of the individual values where N is equal to the number of individual values. The geometric mean is equivalent to the antilog of the arithmetic mean of the logarithms of the individual values. For purposes of calculating the geometric mean, values of zero (0) shall be considered to be one 0). c. Weighted by Flow Value: Weighted by flow value means the summation of each concentration times its respective flow divided by the summation of the respective flows. A calendar day is defined as the period from midnight of one day until midnight of the next day. However, for purposes of this permit, any consecutive 24-hour period that reasonably represents the calendar day may be used for sampling. 11. Hazardous Substance A hazardous substance means any substance designated under 40 CFR Part 116 pursuant to Section 311 of the Clean Water Act. 12. Definitions (1) "Bypass" means the known diversion of waste streams from any portion of a treatment facility including the collection system, which is not a designed or established or operating mode for the facility. (2) "Severe property damage" means substantial physical damage to property, damage to the treatment facilities which causes them to become inoperable, or substantial and permanent loss of natural resources which can reasonably be expected to occur in the absence of a bypass. Severe property damage does not mean economic loss caused by delays in production. b. Bypass not exceeding limitations. The permittee may allow any bypass to occur which does not cause effluent limitations to be exceeded, but only if it also is for essential maintenance to assure efficient operation. These bypasses are not subject to the provisions of Paragraphs c. and d. of this section. c. Notice (1) Anticipated bypass. If the permittee knows in advance of the need for a bypass, it. shall submit prior notice, if possible at least ten days before the date of the bypass; including an evaluation of the anticipated quality and affect of the bypass. (2) Unanticipated bypass. The permittee shall submit notice of an unanticipated bypass as required in Part H. E. 6.*of this permit. (24-hour notice). d. Prohibition of Bypass (1) Bypass is prohibited and the Permit Issuing Authority may take enforcement action against a permittee for bypass, unless: (a) Bypass was unavoidable to prevent loss of life, personal injury or severe Property damage; Part II Page 9 of 14 (b) There were no feasible alternatives to the bypass, such as the use of auxiliary treatment facilities, retention of untreated wastes or maintenance during normal periods of equipment downtime. This condition is not satisfied if adequate backup equipment should have been installed in the exercise of reasonable engineering judgment to prevent a bypass which occurred during normal periods of equipment downtime or preventive maintenance; and (c) The permittee submitted notices as required under Paragraph c. of this section. (2) The Permit Issuing Authority may approve an anticipated bypass, after considering its adverse affects, if the Permit Issuing Authority determines that it will meet the three conditions listed above in Paragraph d. (1) of this section. 5. 1IRstts a. Definition. "Upset " means an exceptional incident in which there is unintentional and temporary noncompliance with technology based permit effluent limitations because of factors beyond the reasonable control of the permittee. An upset does not include noncompliance to the extent caused by operational error, improperly designed treatment facilities, inadequate treatment facilities, lack of preventive maintenance, or careless or improper operation. b. Effect of an upset. An upset constitutes an affirmative defense to an action brought for noncompliance with such technology based permit effluent limitations if the requirements of paragraph c. of this condition are met. No determination made during administrative review of claims that noncompliance was caused by upset, and before an action for noncompliance, is final administrative action subject to judicial review. c. Conditions necessary for a demonstration of upset. A permittee who wishes to establish the affirmative defense of upset shall demonstrate, through properly signed, contemporaneous operating logs, or other relevant evidence that: (a) An upset occurred and that the pennittee can identify the cause(s) of the upset; (b) The permittee facility was at the time being properly operated; and (c) The permittee submitted notice of the upset as required in Part II, E. 6. (b) (B) of this permit. (d) The permittee complied with any remedial measures required under Part II, B. 2. of this permit. d. Burden of proof.
