This is a letter to explain what happened to cause this violation.
We where in the process of pumping the lagoon down so that we could begin to close it.
I hadn't submitted a closer plan because I wasn't sure when the grading company was actually going to start.
There is a time limit on getting it closed from start to finish. We had NO Funding from the State to get it
closed. We had done a little grading to get down into the lagoon to pump off as much water as possible. We
later hauled out the solids and put it on the field. It came about a 2+ inch rain and washed away part of the dam.
I'm including the waste analysis report with this letter, and I'm also including a picture of the residue we got
out of the creek and off of the bank. The branch that it went into feeds into a swamp that is about 20 acres, then
into a feeder stream. All of this is still on our land. No waste ever got to Third Creek. I continuously check this
for over a month. There has not been any new animal waste put into the lagoon in 3 years. It was a very wet
spring and early summer last year much like this year. We did the best we could under the circumstances with
very limited funds. If you go and look at the farm now I think you will see we did a good job of removal and
putting the land back like it was. Please help us with this problem. To be perfectly honest, I didn't know that
the dam had been breached for about 4 days after the rain came. We do not farm the land or live nearby. If you
