An NPDES discharge permit only applies when there is a point source discharge. If the permittee believes there is no potential discharge of wastewater or stormwater to surface waters, the NPDES permit may not apply; however, a regional office inspector must verify this. In that case, you could request a rescission of the permit. Please bear in mind that discharging close to wetlands or flood zone areas of nearby waters still constitute a potential discharge to surface waters, even if the immediate discharge point appears to go to land, and analytical monitoring applies. I am not sure if this monitoring report pertains to Roy F. Sawyer Mine (NPDES (COC) #NC6020140) as in the past we have only used visual monitoring.
