REGAN Secretary BRIAN WRENN Acting Director Steve Farmartino, PE 1927 S Tryon Street Suite 310 Charlotte, NC 28203 NORTH CAROLINA Environmental Quality February 4, 2020 Subject: Request for Additional Information Stormwater Permit No. SW3191101 Cambridge Village Multifamily Lincoln County Dear Mr. Farmartino: The Division of Energy, Mineral and Land Resources (DEMLR), received a Stormwater Management Permit Application for the subject project on January 16, 2020. A review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1. Original Comment 6 —"Please complete a Supplement-EZ Form for each SCM."The provided hard copy of the Supplement-EZ Form must contain an original signature. 2. Original Comment 11 — "Please provide official documents showing the affiliation of the person listed in Section III, ]a with North Pilot Road, LLC." See below. 3. Original Comment 16b — "The provided forebay is smaller than 15% of the main pool volume (Wet Pond MDC 5)." The provided forebay calculation for wet pond #2 is incorrect. It is impossible to get 3,491 cf of storage between elevations 774 (Top of sediment storage elevation) and 776 (Cross -sectional area of 776 is 1,608 sf. 1,608 sf * 2 ft < 3,491 cf). Please revise the forebay volume calculation and update any effected aspects of the submittal. 4. Original Comment 16c — "The design volume drawdown time is too slow (Wet Pond MDC 7)." The WQ elevation used for wet pond 2 is incorrect. The WQ elevation should be based off of the WQv (from the 1" design storm). Per the provided stage storage tables in the calculations, the design volume 17,624 cf should fill the temporary ponding zone of the wet pond up to about 778 ft (Stage -storage table shows the cumulative storage volume at elevation 778 as 17,770 cf). If the correct ponding elevation is used in the orifice equation, the drawdown time is too fast. Please revise. If Prestige Acquisitions LLC is owned by/a subsidiary of BBC Cambridge LLC, please provide documentation from the NC Secretary of State showing this arrangement. If this is the case, BBC Cambridge LLC may sign on behalf of Prestige Acquisitions LLC. ii. If Prestige Acquisitions LLC is not owned by/a subsidiary of BBC Cambridge LLC, please change all references of "BBC Cambridge LLC" and "Steve Bailey" in the Application to "Prestige Acquisitions LLC" and "Brian Mahoney" respectively. Please also provide verification of name and title from the NC Secretary of State for the person signing on behalf of Prestige Acquisitions LLC. b. The Applicant is the Property Owner— Per the prior comment, Prestige Acquisitions LLC/BBC Cambridge LLC is the owner. If you would like this to be the Applicant, please do the following: i. Provide verification of name and title from the NC Secretary of State for the person signing on behalf of Prestige Acquisitions LLC/BBC Cambridge LLC (Brian Mahoney/Steve Bailey). ii. List their name (Brian Mahoney/Steve Bailey) and position in Section III, la of the Application. This must match what is shown on the NC Secretary of State verification information provided. iii. List their contact information in Section III, lb of the Application. iv. Check only "Owner" off in Section III, lc of the Application. v. Section III, 2 is no longer required. vi. Section IX is no longer required. vii. Have the Applicant (Brian Mahoney/Steve Bailey) fill out and sign Section X. viii. Have the O&M Agreement Form filled out and signed by the responsible party, the property owner (Brian Mahoney/Steve Bailey). c. The Applicant is the Purchaser — Based on our 1/30/20 phone conversation (Correct me if I'm wrong), ArchCo Residential LLC is the purchaser (As indicated on the provided pending sales agreement). If you would like this to be the Applicant, please do the following: i. Provide verification of name and title from the NC Secretary of State for the person signing on behalf of ArchCo Residential LLC (Probably Jason Jacobson). ii. List their name (Probably Jason Jacobson) and position in Section III, la of the Application. This must match what is shown on the NC Secretary of State verification information provided. iii. List their contact information in Section III, lb of the Application. iv. Check only "Purchaser" off in Section III, lc of the Application. v. Change the name and organization of the purchaser to Jason Jacobson (Probably), and ArchCo Residential LLC respectively of Section IX of the Application. vi. Have the property owner re-sign Section IX of the Application (Since it was changed). vii. Have the Applicant (Probably Jason Jacobson) fill out and sign Section X. viii. Have the O&M Agreement Form filled out and signed by the responsible party, the purchaser (Probably Jason Jacobson). d. The Applicant is the Developer— Based on our 1/30/20 phone conversation (Correct me if I'm wrong), North Pilot Knob Road LLC is the Developer. If you would like this to be the Applicant, please do the following: i. Provide verification of name and title from the NC Secretary of State for the person signing on behalf of North Pilot Knob Road LLC (Probably Tadd Miller). This must match what is shown in Section III, la of the Application. ii. List their contact information in Section III, lb of the Application. iii. Check only "Developer" off in Section III, lc of the Application. iv. Have the O&M Agreement Form filled out and signed by the responsible party, the property owner (Brian Mahoney/Steve Bailey). 6. Please use square feet, instead of acres, for the table in Section IV, 10 of the Application. 7. The "Total Drainage Area" item of the "Drainage Area 2" column of the table in Section IV, 10 of the Application should be the sum of the "On -site Drainage Area" and the Off - Site Drainage Area". 8. Please correct the following issues with the Supplement-EZ Form: a. Drainage Area Sheet i. Entire Site Column 1. Line 8 — There should not be any offsite areas included for the entire site. 2. Line 7/10 — The items in Line 10 should add up to Line 7 (As Line 10 is a breakdown of Line 7). 3. Line 13 — Please include the existing BUA located within the entire site. Recalculate Line 5. 4. Line 16/Section IV, 8 — These values should be the same. Please revise for consistency. 5. Lines 18 & 19 — These items is not required. ii. Drainage Area Columns 1. Line 18 — The Design Volume should be based off of the 1" design storm. 2. Line 19 — The calculation method should be either the Simple Method or the Discrete NRCS Curve Number Method. Please refer to the Manual, Part B for more information. b. Wet Pond Sheet i. Wet Pond 1 1. Lines 2 & 35 — The Design Volume should be based off of the 1" design storm. 2. Line 37 — The orifice diameter shown on the plans and in the calculations is 1.5" whereas the one shown in the Supplement-EZ Form is 2". Please revise for consistency. 3. Line 48 — Per the plans, the orifice draws down from below the permanent pool. Please revise for consistency. ii. Wet Pond 2 1. Lines 2 & 35 — The Design Volume should be based off of the 1" design storm. 2. Line 37 — The orifice diameter shown on the plans and in the calculations is 2.5" whereas the one shown in the Supplement-EZ Form is 3". Please revise for consistency. 3. Line 48 — Per the plans, the orifice draws down from below the permanent pool. Please revise for consistency. 9. As mentioned previously, the WQ elevations (As shown on the plans and in the calculations) should be based on the Design Storm (1"). Ensure that the WQ elevations for both wet ponds are based on the Design Storm. 10. There are discrepancies between the stage -storage tables provided in the calculations and in the HydroCAD printouts for both wet ponds. Please revise for consistency. Wet Pond 1 Elevation (ft) Tot. The percent impervious used in the calculations for Wet Pond 1 (73%) does not match the percent impervious for Drainage Area 1 as shown in Section IV, 10 of the Application and the Supplement-EZ Form (66%). Please revise for consistency. 12. Provide pdfs of all revisions, 2 hardcopies of revised plan sheets, and 1 hardcopy of other documents. Pdfs must be uploaded using the form at: https://edocs.deq.nc.gov/Forms/SW Project Submittal Please note that this request for additional information is in response to a preliminary review. The requested information should be received by this Office prior to March 5, 2020, or the application will be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee. Please reference the State assigned project number SW3191101 on all correspondence. If you need additional time to submit the information, please submit your request for a time extension to the Division at the contact below. The request must indicate the date by which you expect to submit the required information. The Division is allowed 90 days from the receipt of a completed application to issue the permit. The construction of any impervious surfaces, other than a construction entrance under an approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement action pursuant to NCGS 143-215.6A.
