So the EPA has come up with a pre -filing meeting required 30 days before the submittal of an application. As soon as I know what that is about, how to apply, what the set up will be, I will pass along. It will be an on line submittal Basically, I think once we know how procedurally it will be done, then go ahead and do the pre file and that probably will be soon enough before you are actually ready to submit the application. DO either of you need to complete an agency verification once the flags of the OHWM of the stream go up? Following the updated mapping of the stream Copart is going to reassess the site plan and do everything they can to decrease the impacts to the streams. At the same time Partner will update the Preliminary Determination Report and resubmit. In the meantime Alan, please withdraw the 401 Application. Once the site plan has been finalized based on the new stream additions we will resubmit the 401 Application. In addition, the updated PCN and additional information will be submitted to the Corps. Re -mapping the stream and making changes to the site plans will take some time. I will keep you guys updated on the progress. Have a Great Day! Katie L. Based on the site visit, it was determined the delineation you conducted did not accurately map all the features onsite. The stream you originally proposed to impact extends approximately 123 linear feet south to approximately the downstream end of the new outfall. In addition, there is an intermittent stream channel on the east side of the perennial stream which extends approximately 92 linear feet up the topographic draw. Please review the attached construction drawing (places circled in red are where a stream needs to be extended and another stream channel added) and the aerial snapshot of GPS points. Next steps: - Revise the delineation map to include these additional features and linear feet of stream channel - Revise the PCN accordingly to ensure these additional linear feet of stream channels are considered and mitigated. - Submit a revised PCN to the Corps and State for review PLEASE NOTE: - There is still the state issue with stream restoration due to unauthorized sediment in a stream that was proposed for impact. This issue is still outstanding and needs to be addressed; either in the resubmittal of a 404/401 applicant or if revised planning results in no impacts to this stream channel then stream restoration needs to occur.
