I would like to propose DSSW only in the disturbed area that is draining to the section of the Abbots Creek that is classified as the Critical area. Would you be opposed to that? That is why we mentioned DSSW vs. 303(d) listing per Scoping comments. I suppose if DOT does not intend to impact that particular catchment, then DSSW requirement is moot. Duly noted that an application is soon to arrive. Let me know if you need anything else on this. Dave W. I looked up the TMDL for Rich Fork to see if there was discussion in the TMDL related to construction impacts (i.e. turbidity) that is 2 contributed to the poor fish community listing. All I can find on the DWR website is the TMDL associated with fecal coliform related issues. Since there appear to be no issues associated with construction related activities, do we still need to meet DSSW for the project?
