Attached are the Alternate Stream Crossing plans. As you can see, while the wetland impacts decrease slightly, the
stream and buffer impacts are much worse with the alternate design than the original design.
Also attached is a summary of the street design requirements and the impacts or the original design crossing vs. the
alternate crossing.

Hi Michael, and thanks for the additional information. We consider items 1, 3, 4, and 5 resolved from our 8/4/2020
request for additional information. However, it appears that there was some confusion regarding item 2 in our letter. As
such, I have attached a figure to show the general location referenced in this item and I will restate the question below:

2) The proposed road crossing is presented as necessary to access uplands for upland residential development. The need
for such access is not disputed, however you have not demonstrated avoidance and minimization to the maximum
extent practicable as required by NWP General Conditions 23(a) and (b). For example, it appears that the proposed road
crossing could be shifted to the north, such that the northern fill slope would be placed just south of Wetland WA31-40
and the associated large meander in Stream SA, resulting in significantly reduced wetland impacts and likely similar or
only slightly increased stream impacts. It appears that the road and lot design could be shifted to accommodate such a
change in road alignment to still allow for a similar scale residential development. Please re -design accordingly, or
provide documentation that such avoidance and minimization measures are not practicable (i.e. available and capable of
being done after taking into consideration cost, existing technology, and logistics in light of overall project purposes);
Also, if the above can be resolved, at the currently proposed crossing location at least 1 at -grade floodplain culvert pipe
is needed to maintain a hydrological connection throughout the wetland (per NWP 29 Regional Conditions 3.6.1-3.6.3)
due to the relatively wide geomorphic floodplain containing riparian wetlands. The Corps recommends that this
floodplain culvert pipe be aligned with the existing overflow channel/braid on the eastern side of the proposed crossing.
If item 2 above can be resolved, please provide an updated plan/profile sheet accordingly.

me know if you have any questions.

Hi Michael. One other item I neglected to include in my earlier email today:
5) Given recent USFWS concerns regarding suitable Schweinitz's sunflower and small whorled pogonia
habitat, please complete a pedestrian survey for these species within the Corps ESA action area. In this
case, the Corps ESA action area would be contained within a 100 foot radius of the footprint of
proposed impacts to waters of the US, including the currently proposed footprint and any revised
footprint if project plans are changed per item # 2 in my earlier email. Following the survey, please
provide the survey report to the Corps (copy also the USFWS) for review. Of course, if you do not believe
that any suitable habitat exists in the Action area for these species, please provide a justification so that
the corps could evaluate the potential for a No Effect determination.
Please direct any questions regarding the Corps ESA action area to me. Please direct any questions
regarding appropriate survey techniques and information to include in a survey report to John Ellis with
the USFWS.

Thank you for your PCN and attached information, dated 7/27/2020, for the above referenced project. I
have reviewed the information and need clarification before proceeding with verifying the use of
Nationwide Permit (NWP) 29 (Blocked Blockedhttp://saw-
reg.usace.army.mil/NWP2017/2017NWP29.pdf). Please submit the requested information below (via e-
mail is fine) within 30 days of receipt of this Notification, otherwise we may deny verification of the use
of the Nationwide Permit or consider your application withdrawn and close the file:
1) The Corps issued a Preliminary Jurisdictional Determination (PJD) for this project on 5/21/2020.
In comparing the PJD map with the project plans (Sheets 1 and 2) it is clear that the
location/meanders of Stream SA are shown in slightly different locations. On the PJD map,
Stream SA closely aligns to the stream channel location shown in QL2 LiDAR data, while the
stream location on Sheets 1 and 2 appears to miss several meanders, including meanders within
the proposed Cadence Drive stream crossing. Update the stream location on Sheets 1 and 2
according to stream location data from the PJD map and update the proposed stream impacts
on the plans/PCN accordingly, or confirm field conditions in this location and provide
photographs showing that the stream location at the proposed crossing matches the Sheet 1
and 2 locations;

crossings, nearly as long as the culvert itself. Please provide justification for a rip rap pad of this
length, noting that we may consider a rip rap pad of this length as more than minimal and view
these impacts as a loss of aquatic function;
4) Please provide a cross-section view of the rip rap pad to demonstrate how the feature will
comply with NWP 29 Regional Condition 3.6.4 (see attached picture as an example).

NCDOT and Guilford County have requirements for the street design as follows:
Maximum grade 100' each way from an intersection cannot exceed 5%.
Residential collector roads have a maximum grade of 9%, except at intersections.
Rate of vertical curvature (K) is 14 at stop conditions.
Rate of vertical curvature (K) is 30, except at stop conditions.
Minimum horizontal centerline radius is 300' per Guilford County.
There is a conceptual Alternate Crossing plan as requested by USACE using NCDOT's
maximum horizontal and vertical alignments. Below is a chart showing the impacts of the
Original Crossing design versus the Alternate Crossing further to the north.

Due to the depth and steep slopes of the Alternate Crossing, the buffer impacts and
stream impacts will be much greater than the Original Crossing. See the attached maps.
The wetlands impact will only be 0.06 acres more with the Original Crossing.
Therefore, we submit that the Original Crossing of Cadence Drive has much less impact
on the stream crossing than Alternate Crossing.
