Based on your submittal and signed certification of no exposure at the above referenced facility as well as observations made during a site visit conducted by Mike Lawyer, Environmental Program Consultant with the Fayetteville Regional Office on September 11, 2020, the Division is granting your conditional exclusion from permitting as provided for under 40 CFR 122.26(g), which is incorporated by reference in North Carolina regulations. Please note that by our acceptance of your No Exposure Certification, you are obligated to maintain no exposure conditions at your facility. If conditions change such that your facility can no longer qualify for the No Exposure Certification, you are obligated to immediately obtain NPDES permit coverage for your stormwater discharge. Otherwise, the discharge becomes subject to enforcement as an un-permitted discharge. You must self -re -certify annually that the No Exposure conditions are being met by completing the Annual Self Re -Certification Form, which can be found at https://deg.nc.gov/about/divisions/energy-mineral- land-resources/npdes-no-exposure. The completed form does not need to be submitted but shall be kept onsite and made available upon request. Your conditional exclusion from permitting does not affect your facility's legal requirements to obtain environmental permits that may be required under other federal, state, or local regulations or ordinances. At the time of inspection, a construction project for warehouse expansion was underway and several open -top dumpsters were brought onsite by the contractor for waste material and other construction debris associated with the project. According to Ms. Hall, these dumpsters are temporary and will be removed from the site upon completion of the project. Other dumpsters that are dedicated to the facility are enclosed, compactor style. Racks for outside storage of equipment and materials are located underneath a shelter at the rear of the facility in a vegetated area. Although the questions on the application related to ASTs and secondary containment are marked Not Applicable, there are several ASTs at the facility and secondary containment is provided. Based on the observations made during the inspection and assurance from Ms. Hall that the open top dumpsters will be removed from the site after completion of the current construction project, a No Exposure Certification is being granted.
