This inspection was conducted to verify that the facility is operating in compliance with the conditions and limitations specified in NPDES WW Permit No. NC0069841. A summary of the findings and comments noted during the inspection are provided in the enclosed copy of the inspection report. The Compliance Evaluation inspection was conducted by Division of Water Resources staff from the Mooresville Regional Office. The following violation(s) were noted during the inspection: Inspection Area Description of Violation Permit NPDES Permit Part I, A. (5.) Schedule of Compliance for Ammonia -Nitrogen, items 1. and 2. were missed. In addition, the issues below must also be addressed: Please note that in accordance with your current NPDES Permit NC0069841, Part I, A. (1.) Effluent Limitations and Monitoring Requirements sheet was split into separate Interim and Final limitations and monitoring requirements sheets [as Section A. (1.) and A. (2.), respectively] to address the reduced NH3-N limits and 4-year compliance schedule. The interim sheet contains existing NH3-N limits to be in effect until completion of the compliance schedule, by January 31, 2022. The final sheet contains NH3-N limits effective at completion of the compliance schedule, lasting through permit expiration. [See Section A. (5.).] 1. By January 31, 2019, the Permittee shall submit to the Division of Water Resources a Corrective Action Plan summarizing the strategy or actions to be taken to achieve compliance with the Ammonia -Nitrogen (NH3-N) limitations listed in Section A. (2.), Which includes specific dates for completion or implementation of each action. 2. By January 31, 2020, the Permittee shall submit a report to the Division summarizing actions taken in accordance with the Corrective Action Plan submitted and approved by DWR. The above noted information has not been submitted by required dates. Remedial actions should have already been taken to correct this problem and prevent further occurrences in the future. The Division of Water Resources may pursue enforcement action for this and any additional violations of State law. To prevent further action, please respond in writing to this office within 30 days upon your receipt of this Notice of Violation regarding your plans or measures to be taken to address the indicated violations and other identified issues, if applicable.
