Fullwood, Executive Director MEMORANDUM TO: Toya Fields, NPDES Unit Division of Water Quality FROM: Ron Linville, Regional Coordinator Habitat Conservation Program DATE: October 20, 2003 SUBJECT: Proposed Wastewater Treatment Plant (WWTP) Permit Renewal, Muddy Creek (NC0081621), Rocky River, Cabarrus County Biologists with the North Carolina Wildlife Resources Commission have reviewed the subject draft permits for impacts to fish and wildlife. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d), North Carolina General Statutes (G.S. 113- 131 et seq.), and the North Carolina Administrative Code 15A NCAC 10I.0102. The referenced renewal is a request for the Water and Sewer Authority of Cabarrus County to continue to discharge treated wastewater from the Muddy Creek WWTP to the Rocky River in the Yadkin -Pee Dee River Basin. Suitable habitats for federal and state listed species may be present in Rocky River, including habitat suitable for the federal and state endangered Carolina heelsplitter (Lasmigona decorata). We appreciate the efforts of the Division of Water Quality to improve water quality in the Rocky River. We are concerned about chlorine in effluent. Chlorine is acutely toxic to aquatic organisms and forms secondary compounds that are also detrimental to aquatic life. We also have concerns regarding daily ammonia concentrations. Freshwater mussels are among the most sensitive aquatic organisms tested for impacts from ammonia, and ammonia may be a significant limiting factor for unionids (Augspurger et al., in press). Recent research by Augspurger et al. (in press) found that ammonia concentrations which may be protective of freshwater mussels range from 0.3 to 1.0 mg/L total ammonia as N at pH8. We recommend that the following conditions be incorporated into the permit to reduce impacts to fish and wildlife resources and in particular to mussels. The use of chlorine should be discontinued by installing ultra -violet or ozone disinfection. Utilization of this technique should provide the additional benefit of removing a hazardous material from the environment and the workplace. We recommend that permit requirements preclude the use of chlorine anytime, especially during plant upsets or emergency situations to meet fecal limits. 2. We recommend a reevaluation of ammonia limits based on the research discussed above and readjusting the limits as appropriate. Generally, ammonia limits should be reduced to the extent practicable. Ammonia and pH monitoring should be required daily. Daily composite sampling may be appropriate for ammonia. If not already in place, we suggest the installation of automatic stand-by power generation to prevent plant emergencies and upsets from power outages. 4. Privately owned and operated WWTPs in the area should connect to this publicly owned WWTP whenever feasible and practicable. Although other factors may also contribute to aquatic habitat degradation, the above considerations and measures are appropriate to help protect aquatic habitats that support or may support listed state and federal species. The existing 0.075 MGD WWT facility appeared to be properly operated and maintained. There have been no changes to the WWT facility during the term of the current permit nor has the WSACC requested any changes to the permit at this time. Effluent limits for 0.0755 0.150, & 0.300 flows should remain in the permit as listed. Pending receipt and approval of the WLA, it is recommended that the permit be reissued as requested. Our sludge management plan consists of truck hauling excess bio-solids to the Rocky River Regional Wastewater Treatment Plant, NPDES Permit No. NC0036269, for final disposal.
