permit. Accordingly, we are forwarding the attached NPDES discharge permit. This permit
is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between North Carolina and the U.S. Environmental Protection
Agency dated May 9, 1994 (or as subsequently amended).

In response to a letter from your office dated September 25, 2000, the permit holder's name
has been changed from "Cabarrus County Utilities Department" to "Water and Sewer
Authority of Cabarrus County". (Refer to permit cover page). Also, due to the fact the
subject facility does not use chlorine for disinfection, a footnote has been added to drop the
monitoring requirement for total residual chlorine unless it is added for disinfection. (Refer
to special condition A. (1.), A. (2.) and A. (3.)).
If any parts, measurement frequencies or sampling requirements contained in this permit
are unacceptable to you, you have the right to an adjudicatory hearing upon written request
within thirty (30) days following receipt of this letter. This request must be in the form of a
written petition, conforming to Chapter 150B of the North Carolina General Statutes, and
filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North
Carolina 27699-6714). Unless such demand is made, this decision shall be final and
binding.

Please note that this permit is not transferable except after notice to the Division. The
Division may require modification or revocation and reissuance of the permit. This permit
does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, the Coastal
Area Management Act or any other Federal or Local governmental permit that may be
required.

Muddy Creek WWTP

conditions set forth in Parts I, II, III and IV hereof.
This permit shall become effective January 1, 2001.
This permit and authorization to discharge shall expire at midnight on October 31, 2003.

Enclosed with this letter is documentation of corrections that need to be made to the final
permit. The following items need to be addressed:
The Permitee's name "Cabarrus County Utilities Department" was changed to
the " Water and Sewer Authority of Cabarrus County", in a letter from your office
dated June 13,1997. (See attached)
➢ In a permit modification letter from your office, dated August 1, 1996 a footnote
was added that states, " Monitoring requirements only apply if chlorine is added
for disinfection. " We use ultra -violet light for disinfection. (See attached)
➢ Part I, page 10 of 14, section D2 (reporting) has your old mailing address. It needs
to be changed to your new address 1617 Mail Service Center, Raleigh, N. C. (See
attached)

Dear Mr. Weaver:
We are requesting a renewal of the permit NCO081621 for the Muddy Creek WWTP.
The current permit is scheduled to expire October 31, 1999. There have been no changes
at the facility since issuance of the last permit.
The permit adequately describes the wastewater treatment plant, except your cover letter
referred to the plant as the "MUD CREEK WWTP". The correct name is "MUDDY
CREEK WWTP". We would like to continue with the tiered flows of .075 MGD,
.150MGD, .300 MGD in the new permit.
Our sludge management plan consists of truck hauling excess bio-solids to the Rocky
River Regional Wastewater Treatment Plant, NPDES Permit No. NC0036269, for final
disposal. The Rocky River Regional Wastewater Treatment Plant is owned and operated
by the Water and Sewer Authority of Cabarrus County.

0.8 mile on Hopewell Church Road and turn left onto a gravel road. The WWTP is
located at the end of this road.

time.
g. Possible toxic impacts to surface waters: Chlorine is added to the waste stream.

PART IV - EVALUATION AND RECOMMENDATIONS
The Water and Sewer Authority of Cabarrus County (WSACC) requests renewal of the
subject permit. Construction of a 0.075 MGD WWT facility has occurred since the permit was
originally issued. The WSACC has not requested any changes to the permit at this time. Effluent
limits for 0.075, 0.150, & 0.300 flows should remain in the permit as listed.
Pending receipt and approval of the WLA, it is recommended that the permit be reissued
as requested.
