JAY ZHVIIMEIERMAN Director RECENEDINCOEQ00 WearQ010y P&MM95-090 On February 16, 2017, DWR Employee with the Raleigh Regional Office (RRO) of the Division of Water Resources conducted a site inspection at 801 Colonial Drive, Durham, NC. During the inspection, RRO staff observed the system was not functioning properly. The following observations were made: - The lid was not on the chlorinator (RRO staff re -attached the lid). - Chlorine tablets were not in the chlorine tubes. - Water was ponding downhill of the effluent discharge pipe that was dark -colored and smelled of sewage. A properly functioning system should discharge clear, odorless effluent. Note: Properly functioning waste system is inclusive of the treatment system properly treating the wastewater, properly functioning chlorinator/dechlorinator, clear identification of the wastewater outlet location, and having the ability to properly collect effluent samples at the effluent location. (It should also be noted that annual payments have not been made for this system for the last two years. A Notice of Violation was sent to you regarding this dated December 12, 2016 (NOV-2016-PC-0621). That is a separate issue from the failing system that this Notice of Violation addresses.) This waste discharges into an unnamed tributary to Ellerbe Creek, a WS-IV and Nutrient Sensitive Waters (NSW) in the Neuse River Basin. Accordingly, these issues violation conditions of the General Permit NCG550000 including: Part I. " Part H. Section C. "Operation and Maintenance of Pollution Controls" • Item 2 — Proper Operation and Maintenance: "The Permittee shall at all times properly operate and maintain all facilities and systems of treatment and control (and related appurtenances) which are installed or used by the Permittee to achieve compliance with this conditions of this permit. Proper operation and maintenance also includes adequate laboratory controls and appropriate quality assurance procedures. This provision requires the Permittee to install and operate backup or auxiliary facility only when necessary to achieve compliance with the conditions of the permit [40 CFR 122.41(e)]. Requested Response the permit. Please do this within 60 days and submit a written response to this office detailing howyou will ensure in a timely manner that the system_ is in full compliance of the permit conditions and functions as intended. If the engineer determines that any part of the system needs to be repaired or replaced, the Permittee should inform this office. The components that are required when replacing a system are included in Section A of Part I of the general permit and in Attachment C of this letter. Before construction begins, an Authorization to Construct (ATC) must be secured from the Division of Water Resources. To apply for an ATC, you are required to submit the following: a. A completed and signed Notice of Intent (NOI) application (attached) delivered to the address shown at the bottom of the NOI. b. A letter of request for an ATC to Charles Weaver, NPDES Permitting Unit, Division of Water Quality, 1617 Mail Service Center, Raleigh, NC 27699-1617. c. Plans and specifications of the proposed sand filter system in triplicate. Plans and specifications must be drawn and submitted by a licensed North Carolina professional engineer. If You believe that the system is functioning properly, please provide recent effluent monitoring results that demonstrate that the system is in compliance. This may be accomplished by contacting a certified lab (see attached list) to perform this analysis and submit the results to this office within 45 days of receipt of this letter. The parameter monitoring limits can be found in Section A of Part I of the general permit and in Attachment C of this letter. It should also be noted that a Notice of Violation was also sent to this residence dated December 12, 2016 This office requires that the violation, as described above, be properly resolved in a timely manner. Payment of annual fees is required by Part II B. (12) of your NPDES permit NCG550000, as well as 15A NCAC 2H.0105 (b)(2). The following unpaid invoices are enclosed, totaling $60 in overdue annual fees: 2016PR001352. Payment instructions are provided on the invoice(s). Please submit payment by December 5, 2016.
