On-Site Determination for Applicability to the Neuse River Riparian Area Protection Rules
(15A NCAC 2B.0233)
Dear Ms. Parker:
On January 6, 2009, at your request I conducted an on-site determination to review an unnamed
tributary located on the subject property for applicability to the Neuse Buffer Rules (15A NCAC
2B .0233). The feature is labeled as "2009-0011" on the attached map initialed by me on
January 6, 2009.
At your request, I conducted an on-site determination as stated above. During my review I
evaluated the stream using the DWQ Stream Classification Form. I evaluated the stream reach
upstream from the confluence with Broad Creek and calculated the score to be 15 points. The
form states that if the score is "greater than or equal to 19 points the stream is at least
intermittent".
The Division of Water Quality (DWQ) has determined that the surface water labeled as
"2009-0011" on the attached map is ephemeral and is NOT SUBJECT to the Neuse Buffer
Rule. This feature and it's associated buffers should be identified on any future plans for this
property. The owner (or future owners) should notify the DWQ (and other relevant agencies) of
this decision in any future correspondences concerning this property. This on-site determination
shall expire five (5) years from the date of this letter.
Landowners or affected parties that dispute a determination made by the DWQ or Delegated
Local Authority that a surface water exists and that it is subject to the buffer rule may request a
determination by the Director. A request for a determination by the Director shall be referred to

determination by the DWQ or Delegated Local Authority that "exempts" a surface water from
the buffer rule may ask for an adjudicatory hearing. You must act within 60 days of the date that
you receive this letter. Applicants. are hereby notified that the 60-day statutory appeal time does
not start until the affected party (including downstream and adjacent landowners) is notified of
this decision. DWQ recommends that the applicant conduct this notification in order to be
certain that third party appeals are made in a timely manner. To ask for a hearing, send a written
petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This
determination is final and binding unless you ask for a hearing within 60 days.
This letter only addresses the applicability to the buffer rules and does not approve any activity
within the buffers. Nor does this letter approve any activity within Waters of the United States
or Waters of the State. If you have any additional questions or require additional information

Only complete application packages will be accepted and reviewed by the Division of Water Quality (DWQ).
A complete package includes all of the items listed below. A detailed application instruction sheet and BMP
checklists are available from h!lp://h2o.enr.state.nc.us/su/-`-bmp-forms.htm. The complete application
package should be submitted to the appropriate DWQ Office. (The appropriate office may be found by locating
project on the interactive online map at http://h2o.enr.state.nc.us/su/msi maps htm.)

receiving stream drains to class SA waters within 1/2 mile of the site boundary, include the 1/2
mile radius on the map.

For all subdivisions, outparcels, and future development, the appropriate property restrictions and protective
covenants are required to be recorded prior to the sale of any lot. If lot sizes vary significantly or the proposed
BUA allocations vary, a table listing each lot number, lot size, and the allowable built-upon area must be provided
as an attachment to the completed and notarized deed restriction form. The appropriate deed restrictions and
protective covenants forms can be downloaded from

In the instances where the applicant is different than the property owner, it is the responsibility of the property

V. SWALE SYSTEM MAINTENANCE REQUIREMENTS
Mowing will be accomplished as needed according to the season. Grass height will not exceed six inches
at any time; and grass will not be mowed too close to the ground or "scalped".
2. Swales will be inspected monthly or after every runoff producing rainfall event for sediment build-up,
erosion, and trash accumulation.
3. Accumulated sediment and trash will be removed as necessary. Swales will be reseeded or sodded
following sediment removal.
4. Eroded areas of the swales will be repaired and reseeded. Swales will be revegetated as needed and in a
timely manner based on the monthly inspections. Side slopes must be maintained at the permitted slope.
5. Catch basins, curb cuts, velocity reduction devices, and piping will be inspected monthly or after every
significant runoff producing rainfall event. Trash and debris will be cleared away from grates, curb cuts,
velocity reduction devices and piping.
6. Swales will not be altered, piped, or filled in without approval from NCDENR Division of Water Quality.

Stormwater Management Narrative
Latham-Whitehurst Nature Park
Broad Creek Road (NCSR 1600)
Craven County
This project proposes a low density construction project which consists of the
development of a nature park. The project proposes limited impervious surfaces which
include a gravel access road, a gravel parking area, an asphalt paved hiking trail, two
restroom buildings, picnic table slabs and a picnic shelter. A portion of the parking area
will be concrete paved in order to provide handicap accessibility. A future allowance of
20,000 square feet is included for any future minor improvements which would be
surfacing existing dirt walking trails as budgets permit. The current plan is for the
existing walking trails to be used, but they will remain in their existing dirt condition.
The asphalt paved hiking trail will access the wooden boardwalk/dock along Upper
Broad Creek.
The project will be low density for the purposes of stormwater treatment. The total
impervious area (existing and proposed) is 108,081 square feet. The project has a built-
upon area of 1.94 %. Approximately 4.1 acres of the site will be disturbed by this
project in order to construct the nature park improvements.
The 16' wide gravel access road will enter the site from Broad Creek Road. The width of
the road is governed by the conservation easement that is in place. The road was located
in the field to generally run along the existing landscape crown through the wooded areas
and the open fields. The relatively narrow road will not have roadside swales due to the
sandy soil texture and the lack of any other impervious areas contributing runoff to the
roadway area. Runoff from the roadway will sheet flow to the adjacent wooded areas or
the existing grass fields.
The primary soil types in the work area portions of the site are classified as Deloss and
Tomotley by the Craven County Soil Survey. Deloss and Tomotley are both classified as
a fine sandy loam at the depths to be disturbed by this project. The depth to the seasonal
high water table was not determined since it varies across the site and since no
engineered treatment systems are proposed.
The property is owned by Craven County and was acquired from the Coastal Land Trust
with the restriction that the site be used as a nature park. A conservation easement placed
on the property provides restrictions regarding road width (16'), trail surfaces and other
methods of development. There have been no previous permits issued for the site.
Pre-1988 built-upon area exists on the site in the form of a dilapidated tobacco barn that
will remain. The project area currently exists as woodlands, an open grassed field and an

existing dirt/grassed trail system through mature woodlands. There is no off-site
impervious area draining into the site.
New utilities constructed by this project will consist only of a water service extension to
serve the new picnic shelters. There are no known historic sites on the property.
The project will be constructed with federal funds. There are not any NCDENR non-
compliance issues associated with the site.
The site drains to Upper Broad Creek, a tributary of the Neuse River. Upper Broad
Creek is classified as SC;Sw,NSW index #27-106-(4). There are Coastal and 404
wetlands on the site. The project access road will cross a portion of the 404 wetlands at
the narrowest point. The wetland crossing is eligible for a Nationwide permit and the
application has been submitted. The Coastal wetlands are only being crossed by the new
boardwalk/dock which is being submitted separately as a CAMA permit. The wetlands
were delineated by Joseph C. Avolis, PE, President Avolis Engineering, PA. and have
been approved in the field by Mrs. Tracey Wheeler of the U.S. Army Corps of Engineers.
The Craven County Soil Survey map shows a "blue line" stream, Dam Branch, south of
the proposed parking area. The USGS map does not show this area as a stream. Craven
County previously had a stream call made on the branch. The NCDENR, Mr. Chris
Pullinger, determined that the stream was not subject to the Neuse Riparian Buffer Rules,
DWQ Project # 2009-0011 dated January 6, 2009. Upper Broad Creek is subject to the
Neuse Riparian Buffer rules, but all impervious surfaces associated with the proposed
hiking trails are kept out of the buffer area. Where the hiking trail goes through the
riparian buffer, boardwalk decking is used.
This project does not require post development runoff rate control.
