Stormwater Permit No. SW1190801

Dear Mr. Grieb:
The Division of Energy, Mineral and Land Resources (DEMLR), received a Stormwater
Management Permit Application for the subject project on October 23, 2019. A review of that
information has determined that the application is not complete. The following information is
needed to continue the stormwater review:
Original Comment 3 — Contrary to the provided comment response, Section III, 2 and
Section IX have both been completed on the latest Application. You may cross out these
items in red pen on the original hard copy of the Application or you may provide a new,
corrected Application.
2. Original Comment 6 — Per the Application, Section IV, 9, "For high density, count 1 for
each proposed stormwater BMP." This means that, for high density projects, the number
of drainage area columns should equal the number of proposed SCMs (2). Please correct
Section IV, 9. While I do appreciate you breaking down each drainage area in this
project, only the drainage areas that directly drain to the SCMs (Drainage Areas 113 &
2A) should be included in this table.
3. Original Comment 10 — I may not have been as explicit in my initial comment as I should
have, but per the Application, we require an original, signed, hard copy of the O&M
Form and the Supplement-EZ. The O&M Form that was provided with this submittal was
filled out correctly and contained all of the needed pages, however, we require the
original, signed, hard copy. Please provide the original, signed, hard copy of the O&M
Form that was provided with this submission. The Supplement-EZ was still not provided.

the Supplement-EZ, sign it, seal it, and submit the original, signed hard copy (As well as
an electronic copy). Ensure that all of the pages of the Supplement-EZ are included
(There should be a cover page, drainage area page, and a page per type of proposed
SCM).
4. Original Comment 11 — Since the Application has been re -signed for this submission,
please provide the original, signed, hard copy of the Application dated 10/8/2019.
5. Original Comments 15 and 17 — Section VI, 8 of the Application states the requirements
that need to be included on the two required sets of plans. While it is often helpful to
include the off -site contours and SCM drainage areas in the stormwater narrative, Section
VI, 8 of the Application explicitly states that this information must be included in the
plans. Please include this information in at least one of the plan sheets in the plan set used
for the submission.
6. Original Comment 16 — The second part of my original comment stated to, "Provided
documentation of the qualifications and identity of the individual who made this
determination." Item 8 in requires that the individual making this determination be
qualified to do so.
7. Original Comment 18 — Please include a soils report based on an actual site visit that
measures the in -situ soil infiltration rate at the facility bottom elevation for the proposed
bioretention cells.
8. Original Comment 20 — The provided documentation does not show the relationship
between the signing official, Ted Godleski, and the applicant/property owner, Leicester
Volunteer Fire Department. In addition, this item was not initialed as being included in
the Application.
9. There is a miscalculation in the Total BUA summation for drainage area 1 B (Section IV,
10).
10. The WQv calculations are not done correctly. The design rainfall depth should be 1.00",
not 1.04", please revise.
11. The contour lines for the bottom of bioretention #2 appear to be mislabeled (2,550
instead of 2,555) on the plan sheets, please revise.
12. The Seasonal High Water Table (SHWT) elevation is not provided for either proposed
bioretention facility. Bioretention MDC #1 requires at least 2' vertical separation from
the SHWT. Please provide facility specific soil boring information showing the SHWT
elevation for each facility.
13. Bioretention MDC #4 requires that Internal Water Storage (IWS) be installed unless the
in -situ soils at the excavated bottom of the facility have an infiltration rate greater than or
equal to 2.0"/hr. Please provide facility specific soil boring information showing an in-
situ soil infiltration rate of greater than or equal to 2.0"/hr at the facility bottom elevation
or provide IWS for each facility.
14. Please add a note to the plans indicating that the media mix should have a P-Index value
less than 50 (Bioretention MDC #7).
15. Please provide a planting plan or add a note to the plans indicating the type of sod to be
used for the bioretention facilities (Bioretention MDC #10).
16. Please provide a stage -storage table for each SMC to verify that the SCMs are sized
correctly (General MDC #1).
17. Please show the side slopes (i.e. 3:1) on the cross -sections of the proposed SCMs
(General MDC #3).
18. Please provide riprap sizing calculations showing that the inlets and outlets of the SCMs
are non -erosive in accordance with General MDC #4.
19. Please show the maintenance access and associated easement on the plans (General MDC
#8 & #9). Ensure that the access and easement go all the way to the nearest public right-
of-way.
20. Provide pdfs of all revisions, 2 hardcopies of revised plan sheets, and 1 hardcopy of other
documents. Pdfs must be uploaded using the form at:

While it is not required, it is recommended that:
- Off -site drainage from the upstream property be diverted around bioretention #2 since the
applicant cannot maintain control over the development of property that they do not own.
If, in the future, additional BUA is built outside of the property boundary, but within the
drainage area to bioretention #2, the facility may become undersized and non -compliant
with the regulations.
- Some form of pretreatment and flow dispersion be provided for the inflow to the
bioretention facilities. A forebay can provide both of these functions.
Please note that this request for additional information is in response to a preliminary review.
The requested information should be received by this Office prior to December 22, 2019, or
the application will be returned as incomplete. The return of a project will necessitate
resubmittal of all required items, including the application fee. Please reference the State
assigned project number SW1190801 on all correspondence.
If you need additional time to submit the information, please submit your request for a time
extension to the Division at the contact below. The request must indicate the date by which you
expect to submit the required information. The Division is allowed 90 days from the receipt of
a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject
to enforcement action pursuant to NCGS 143-215.6A.
