Send all suspicious email as an attachment to nc. ov Good Afternoon Olivia, Schweinitzi's sunflower has very distinct leaves and there are only a few sunflower species that mimic it. With the evaluation area being as small as it is, we did a species survey to see if Schweinitzi's sunflower or any similar in appearance species were present. If we had identified any potential plants, it would have been necessary to revisit the site and observe them while in bloom (the optimal survey window). If David Bailey or the USFWS determine that this is not enough they will require more although we do not feel it is warranted. David can correct me if I am wrong, but generally the USACE consults directly with the USFWS when issuing permits if they feel there is an issue. With regard to issue two, we have also seen instances where wetlands and jurisdictional areas get mowed or otherwise disturbed. However, there are many properties that have jurisdictional features on them throughout the state, most of which do not have deed restrictions. The developer is putting deed restrictions on them in an effort to protect them. If landowners do not abide by the deed restrictions or commit unpermitted activities, they can be held responsible for impacting the areas including restoration requirements. Unless there is some fund available to purchase developable lots that have jurisdictional features, I am unaware of other alternatives that may afford better protection. The applicant is adhering to the state regulated riparian buffer requirements with the project design. There is no argument that 100 or 200 foot undisturbed buffers are preferred and would benefit the environment. Thank goodness we are in a watershed that has buffer regulations or the environmental impacts would be more significant. I will inform the applicant of your preferred buffers but do not anticipate that they are going to voluntarily increase the buffers, revise site plans, sacrifice lots and go through the site plan reapproval process. The optimal survey window for this species is late August through October. We would prefer the surveys are conducted during that time period, but we defer to the USFWS. If you haven't already, please contact the USFWS to determine if they are satisfied with the surveys. I understand that lots with jurisdictional features will have deed restrictions; however, my experience is that often those features still get mowed or disturbed. I am most concerned with the wetlands that are within the lots, particularly WDA 18-36 on Lot 4. Ideally, we would prefer the lot is not developed or it is smaller. Perhaps the lots in the cul de sac could be resized so the wetland is removed from the lot and kept as an open space. Overall, there are no buffers around the wetlands unless they are within the stream buffer. We prefer at least a 100' undisturbed, native vegetated buffer around perennial streams and 50' for intermittent streams and wetlands. Based on the site plans, a 50' buffer is proposed around streams and the pond; however Zone 2 (20') of the buffer can be disturbed but must be revegetated. We request at least the 50' buffer around streams are natural and undisturbed, as well with wetlands.
