(Pilot) received an electronic mail dated July 9, 2020 from the U.S. Army Corps of Engineers (USACE) requesting additional information to process the Nationwide Permit application for the proposed Oak Ridge Landing Subdivision, located south of Oak Ridge Road in Oak Ridge, Guilford County, North Carolina. The electronic mail indicates that the USACE received the Nationwide Permit verification request dated June 19, 2020. The purpose of this letter is to provide the USACE the requested information. USACE Comment 1): "The Corps completed a field verification of the delineation of wetlands and other waters of the US yesterday with Pilot Environmental. The updated field sketch is attached. Please update the "Stormwater Plan" (Sheet 4 of 17) with the overlay of the verified wetlands and other waters of the US. Although a GPS location of the approved wetland flags, stream channels, and ponds is acceptable through most of the property, the limits of Wetland WA/WAA and WD 18-36, and well as Streams ISA and SA in the vicinity of the proposed impact area must be surveyed by a licensed Land Surveyor. This complete map will allow us the fully evaluate direct and indirect impacts associated with the proposed project." Applicant Response: The impact exhibits are attached and have been updated accordingly. PO Box 128, Kernersville, NC 27285 www.pilotenviro.com Response to Requestfor USACEAdditional Information Proposed Oak Ridge Landing Subdivision September 10, 2020 USACE Comment 2): "Regarding the proposed Falcons Trail stream crossing: a. Given the very small remnant of stream channel that would remain upstream of the proposed following construction, the Corps will consider the length of stream between the origin of Stream ISA and the culvert inlet as an indirect loss of stream function and include this length in the calculation of stream loss. Based on QL2 LiDAR and a georeferenced version of your project plans, this length of stream channel is approximately 16 linear feet; b. The proposed culvert slope is very steep (>6%); as such, this culvert would not retain sediment. Further, the stream bed in this location is rocky with several areas of exposed bedrock. Given the preceding, there is no environmental benefit to burying the culvert below the stream bed. As such, please confirm with NCDWR that they are in favor of placing the culvert at grade in this situation. If agreed, please redesign accordingly and update the PCN and applicable plan sheets; C. Based on item b., embedding the rip rap pad in the stream bed is not practicable. Would it be possible to only rip rap the banks in this case? If not, update the plans to show the rip rap pad to be placed at/above grade within the stream channel; d. During yesterday's field visit, we observed a rock head cut/"waterfall" approximately 34 in vertical height near the proposed culvert outlet and rip rap pad, however this feature is not shown on the profile. Please update the profile drawing accordingly and adjust the proposed crossing to account for this feature to maintain stability of the stream channel." Applicant Response: Regarding the proposed Falcons Trail stream crossing: a. The applicant acknowledges that the additional stream channel is considered an indirect loss. The additional impact is accounted for in the revised exhibits and updated Sheet 5 on the PCN application (Attached). b. Pilot confirmed with Ms. Olivia Munzer with the NC Wildlife Resources Commission that they are in favor of placing the culvert at grade (e-mail dated July 20, 2020). The stream crossing has been redesigned accordingly on the revised exhibits (Attached). C. The rip rap has been redesigned to only rip rap the banks. The revised exhibits reflect this change (Attached). d. The profile drawing has been updated accordingly (Attached). USACE Comment 3): "The "Stormwater Plan" (Sheet 4 of 17), when overlaid on the wetland delineation, indicates via lot lines that the only access to upland portions of this lot require crossing Wetland WD 18-36. Please explain/show how access to this lot will be achieved without requiring additional impacts to wetlands. Please note that authorization to impact this wetland for lot access may be difficult to obtain, given the numerous avoidance and Response to Requestfor USACEAdditional Information Proposed Oak Ridge Landing Subdivision September 10, 2020 minimization techniques/methods available to find alternative accesses to this property. Note also that, based on my site visit, this wetland appears to be a high quality wetland resource." Applicant Response: Lots 2, 3 and 4 have been redesigned to avoid potential impacts to Wetland WD 18-36. Please see attached exhibits. USACE Comment 4): "Please note that several lots include wetland and/or stream resources within their proposed lot lines, including Lots 2-17, 19, 20, 25, 27, 28, 32, 33, 41-47 (Lot 47 is bisected by Stream SB)." NCDEQ-DWR Comment: Based on conversations with Ms. Sue Homewood with the NCDEQ- DWR, if lots on the site look buildable and contain jurisdictional features and/or surface water buffers, deed restrictions are required for these lots. Additionally, if there are lots on the site that don't look buildable then the NCDEQ-DWR will require a lot layout showing structures, driveways, septic etc. NC Wildlife Resources Commission Comment (Olivia Munzer): "I am concerned for some of these features on lots where the feature/buffer takes up a big portion of the lot such as Lot 47, 48, 41, 28 (see Dave's comment #4); My recommendation is for the developer only to clear trees where absolutely necessary (mostly pad and roads). It would be nice to see a figure with the features and impacts/basic site plans; I don't see the wetlands on the Stormwater Plan." Applicant Response: The applicant acknowledges that there are multiple lots that contain jurisdictional features. The exhibits have been updated and include footprints of proposed structures showing that the lots are suitable. Additionally, deed restrictions and restrictive covenants are being used to protect the jurisdictional areas and/or stream buffers on the lots within the subdivision that contain these features. USACE Comment 5): "Given the USFWS concerns regarding suitable Schweinitz's sunflower and small whorled pogonia habitat, please complete a pedestrian survey for these species within the Corps ESA action area. In this case, the Corps ESA action area would be contained within a 100-foot radius of the footprint of proposed impacts to waters of the US. Following the survey, please provide the survey report to the Corps (copy also the USFWS) for review." Applicant Response: Pilot revisited the site and conducted a detailed study within a 100-foot radius of the footprint of the proposed impacts. A Detailed Schweinitz's Sunflower and Small Whorled Pogonia Survey Report presenting our findings is included as an attachment. The site is depicted on the attached USGS Topographic Map (Drawing 1) and T&E Survey Map (Drawing 2). Background Pilot previously submitted a Pre -Construction Notification (PCN) to your office requesting a Nationwide Permit 29 Verification. We received a response e-mail from Olivia Munzer with the NC Wildlife Resources Commission dated July 22, 2020. The e-mail indicates that based on her review of the PCN, suitable habitat for Schweinitz's sunflower and small whorled pogonia habitat appear to be present within the area of impact. Following Ms. Munzer's e-mail, we received an email from you (dated July 27, 2020) indicating that a pedestrian survey should be conducted within a 100-foot radius of the footprint of proposed impacts to waters of the US. A summary of the species/habitat description, our methodology and our findings is provided below. Species/Habitat Description Schweinitz's sunflower (Helionthus schweinitzii) Description: Schweinitz's sunflower is a perennial that regularly grows approximately 6.5 feet tall (though it can be shorter if young or injured) and can occasionally reach heights of 16 feet. It has thickened roots that are used by the plant to store starch. The stem is purplish in color, and the upper third bears secondary branches at 45-degree angles. The leaves are arranged in pairs on the lower part of the stem but usually occur singly (or alternate) on the upper parts. Leaves PO Box 128, Kernersville, NC 27285 www.pilotenviro.com Detailed Schweinitz's Sunflower and Small Whorled Pogonia Survey Report Pilot Project 3962.2 September 10, 2020 are attached to the stem at right angles, and the tips of the leaves tend to droop. The leaves are thick and stiff, with a rough upper surface. The upper leaf surfaces have broad spiny hairs that are directed toward the tip and soft white hairs cover the underside. The plant produces small yellow flowers from late August until frost. This species is able to colonize through the dispersal of seeds that readily germinate without a dormant period. Habitat: Schweinitz's sunflower occurs in full to partial sun and is found in areas with poor soils, such as thin clays that vary from wet to dry. It is believed that this species once occurred in natural forest openings or grasslands. Many of the remaining populations occur along roadsides. Small Whorled Pogonia (Isotria medeoloides) Description: Small -whorled pogonia has a greenish -white stem that grows between 3 —13 inches (7.6 - 33 centimeters) tall. It gets its common name from the five or six grayish -green leaves that are displayed in a single whorl around the stem. When the leaves are well developed, a single flower or sometimes a flower pair rises from the center of the circle of leaves. The flowers are yellowish -green with a greenish -white lip. Each flower has three sepals of equal length that spread outward. The flowers are scentless, lack nectar, and are primarily self -pollinating. It produces fruit which ripens in the fall. The seeds contain very little food reserves and therefore need to fall on soil containing mycorrhizal fungi in order for the seed to germinate and seedlings to become established. An over -wintering vegetative bud may form in late August or September. Occasionally small whorled pogonia will reproduce vegetatively, without the use of seeds. Habitat: Small whorled pogonia can be limited by shade. The species seems to require small light gaps, or canopy breaks, and generally grows in areas with sparse to moderate ground cover. Too many other plants in an area can be harmful to this plant. This orchid typically grows under canopies that are relatively open or near features that create long -persisting breaks in the forest canopy such as a road or a stream. It grows in mixed -deciduous or mixed-deciduous/coniferous forests that are generally in second- or third -growth successional stages. The soils in which it lives are usually acidic, moist, and have very few nutrients. Methodology Pilot conducted a literature review to determine specific habitat requirements for these species. Pilot personnel conducted the detailed survey within the specified 100-feet of impacts to waters of the US on July 28, 2020 to determine the presence or absence of these species. The survey was conducted via pedestrian transects within the survey area. Areas surveyed include a utility easement associated with a natural gas pipeline and mixed hardwood wooded land. Site photographs taken in the surveyed area are included as an attachment. Detailed Schweinitz's Sunflower and Small Whorled Pogonia Survey Report Pilot Project 3962.2 September 10, 2020 Findings and Conclusions Areas located within the utility easement are dominated by mixed grasses as well as red maple (Acer rubrum), white oak (Quercus alba), American persimmon (Diospyros virginiana) and sweet gum (Liquidambar styraciflua) saplings, muscadine (Vitis rotundifolia), sawtooth blackberry (Rubus argutus), dogfennel (Eupatorium capillifolium), broom sedge (Andropogon virginicus), evening trumpetflower (Gelsemium sempervirens), Blackeyed Susan (Rudbeckia hirta), multiflora rose (Rosa multiflora) and greater bladder sedge (Carex intumescens). Areas of wooded land located within the survey area are dominated by tulip poplar (Liriodendron tulipifera), white oak (Quercus alba), blackjack oak (Quercus marilandica), mockernut hickory (Carya tomentosa), scarlet oak (Quercus coccinea), American beech (Fagus grandifolia) and red oak (Acer rubrum) trees, red maple (Acer rubrum), American holly (Ilex opaca), American beech (Fagus grandifolia), flowering dogwood (Cornus florida) eastern red cedar (Juniperus virginiana) saplings, multiflora rose (Rosa multiflora), hollyleaved barberry (Mahonia aquifolium), maple -leaf viburnum (Viburnum acerifolium), false nettle (Boehmeria cylindrica), Virginia creeper (Parthenocissus quinquefolia), red maple (Acer rubrum), oak saplings (Quercus sp.), muscadine (Vitis rotundifolia), partridgeberry (mitchella repens), honey suckle (Lonicera japonica), American hogpeanut (Amphicarpaea bracteata), spotted wintergreen (Chimaphila maculate), wild violet (Viola sororia) and greenbrier (Smilax rotundifolia). Species within the Aster family with analogous characteristics to Schweinitz's sunflower observed include Blackeyed Susan (Rudbeckia hirta) and small wooded sunflower (Helianthus microcephalus). Species within the Orchid family were not observed within the survey area. While suitable habitat for Schweinitz's sunflower and Small whorled pogonia was observed, no individuals or populations were identified during the survey. Based on the findings of the survey, we have made a determination of no effect for Schweinitz's sunflower and Small whorled pogonia. Closing We appreciate your assistance.
