Looking at the current approved impact table: Type of Impact Amount Approved (units) Permanent Amount Approved (units) Temporary Stream Site 1 0 (linear feet) 110 (linear feet) Site 2 — Kiesee Creek 0 (linear feet) 45 (linear feet) Open Waters Site OW1 0 (acres) 0.5 (acres) Site OW2 9.6 (acres) 0 (acres) Site OW3 0 (acres) 50.8 (acres) Site OW4 0.01 (acres) 0 (acres) Site OW5 — 1951 access connector road 0.22 (acres) 0 (acres) Site OW6 — Barge Access Rd 0 (acres) 0.49 (acres) Site OW7 — Excavation 0 (acres) 0.49 (acres) Site OW8 — Rock Ditch 0.70 (acres) 0 (acres) Site OW9 — Rock Vane 0.03 (acres) 0 (acres) I see that I think you are proposing that Site OW7 should be increased on 0.63 acres and to add a new site for the riprap apron (0.007 acres). But you say that the proposed limits of disturbance is to increase from 1.41 acres to 3.79 acres. First, I can't figure out how you got 1.41 acres and then I can't see how the two amounts above would increase that to 3.79 acres. Or is that a completely separate increase? And if so, of what? I don't see where anything in the previously approved table adds up to 1.41 acres. Help please. Duke Energy is proposing to increase the limits of disturbance near the existing North Carolina Wildlife Resources Commission's Cedar Cliff Access Area to allow for access road maintenance including driveway improvements and a construction turnaround area as well as an additional excavation area to remove excess sediment that has deposited into the reservoir. The proposed limits of disturbance below the 2,300 ft mean sea level full pond elevations is proposed to increase from 1.41 acres to 3.79 acres. The excavation area is proposed to increase from 0.49 acres to 0.63 acres. Lastly, approximately 306 square feet (0.007 acres) of rip rap apron is proposed to be installed below the existing pipe from Shook Cove Road to connect to the rip rap lined ditch to prevent scouring in the lake bottom during storm events (SHEET CCL-0104-021). All construction activities shall be performed and maintained in full compliance with G.S. Chapter 113A Article 4 (Sediment and Pollution Control Act of 1973). Sediment and erosion control measures shall not be installed in wetlands or waters with the exception of turbidity curtains. All sediment and erosion control devices shall be removed and the natural grade restored within two (2) months of the date that the Division of Energy, Mineral and Land Resources (DEMLR) has released the specific area within the project. [15A NCAC 02H .0501 and .0502] 9. An NPDES Construction Stormwater Permit (NCG010000) is required for construction projects that disturb one (1) or more acres of land. The NCG010000 Permit allows stormwater to be discharged during land disturbing construction activities as stipulated in the conditions of the permit. If the project is covered by this permit, full compliance with permit conditions including the erosion & sedimentation control plan, inspections and maintenance, self -monitoring, record keeping and reporting requirements is required. [15A NCAC 02H .0506(b)(5) and (c)(5)] 10. All work in or adjacent to streams shall be conducted so that the flowing stream does not come in contact with the disturbed area. Approved best management practices from the most current version of the NC Sediment and Erosion Control Manual, or the NC DOT Construction and Maintenance Activities Manual, such as sandbags, rock berms, cofferdams, and other diversion structures shall be used to minimize excavation in flowing water. [15A NCAC 02H .0506(b)(3) and (c)(3)] 11. If concrete is used during construction, then all necessary measures shall be taken to prevent direct contact between uncured or curing concrete and waters of the state. Water that inadvertently contacts uncured concrete shall not be discharged to waters of the state. Temporary culverts required for this project shall be installed in such a manner that the original stream profiles are not altered and to allow for aquatic life movement during low flows. Existing stream dimensions (including the cross section dimensions, pattern and longitudinal profile) must be maintained above and below locations of each culvert. 13. All temporary fill and culverts shall be removed and the impacted area returned to natural conditions, within 60 days of the determination that the temporary impact is no longer necessary. The impacted areas shall be restored to original grade, including the stream's original cross sectional dimensions, plan form pattern, and longitudinal bed and bed profile, and the site shall be stabilized with natural woody vegetation (except approved maintenance areas) and restored to prevent erosion. [15A NCAC 02H .0506(b)(2) and (c)(2)] 14. All temporary pipes/culverts/riprap pads etc, shall be installed in all streams as outlined in the most recent edition of the North Carolina Sediment and Erosion Control Planning and Design Manual so as not to restrict stream flow or cause dis-equilibrium. [15A NCAC 02H .0506(b)(2) and (c)(2)] 15. Any riprap required for proper culvert placement, stream stabilization, or restoration of temporarily disturbed areas shall be restricted to the area directly impacted by the approved construction activity. All riprap shall be buried and/or "keyed in" such that the original stream elevation and streambank contours are restored and maintained. Placement of riprap or other approved materials shall not result in de -stabilization of the stream bed or banks upstream or downstream of the area. [15A NCAC 02H .0506(b)(2)] 16. Any rip -rap used for stream or shoreline stabilization shall be of a size and density to prevent movement by wave, current action, or stream flows and shall consist of clean rock or masonry material free of debris or toxic pollutants. Rip -rap shall not be installed in the streambed except in specific areas required for velocity control and to ensure structural integrity of bank stabilization measures. [15A NCAC 02H .0506(b)(2)] 17. This Certification does not relieve the applicant of the responsibility to obtain all other required Federal, State, or Local approvals before proceeding with the project, including those required by, but not limited to Sediment and Erosion Control, Non -Discharge, Water Supply Watershed, and Trout Buffer regulations. 18. All mechanized equipment operated near surface waters shall be inspected and maintained regularly to prevent contamination of surface waters from fuels, lubricants, hydraulic fluids, or other toxic materials. Construction shall be staged in order to minimize the exposure of equipment to surface waters to the maximum extent practicable. Fueling, lubrication and general equipment maintenance shall not take place within 50 feet of a waterbody or wetlands to prevent contamination by fuels and oils. [15A NCAC 02H .0506(b)(3) and (c)(3) and 15A NCAC 02B .0211 (12)] 19. In accordance with 143-215.85(b), the applicant shall report any petroleum spill of 25 gallons or more; any spill regardless of amount that causes a sheen on surface waters; any petroleum spill regardless of amount occurring within 100 feet of surface waters; and any petroleum spill less than 25 gallons that cannot be cleaned up within 24 hours.
