Dear Mr. Richardson:
Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until
they are modified. Please note that this letter references DEMLR as the Division responsible for
issuance of the permit.
On August 23, 2019, the Wilmington Regional Office of DEMLR conducted a file review of the subject
project currently operating under Stormwater Management Permit Number SW8 981110 originally
issued to you on May 7,1999 and subsequently modified on February 14, 2000: DEMLR research
based on a review of the file, a review of the Brunswick County GIS website and a review of the
NCSOS website, revealed that the ownership of the property covered by this permit has changed.
The property was initially conveyed from you and your wife personally to Bermuda Gardens, LLC
on March 9,1999, during the review of the first permit application. You were the manager of
Bermuda Gardens, LLC until it was administratively dissolved by the NCSOS for failing to file
required annual reports for 2016 and 2017, and has not been reinstated. Bermuda Gardens, LLC
conveyed the property to EWT 39, LLC on September 18, 2015. Please note that per Section II.8 of
the permit, the permittee must modify the permit for any transfer of ownership. In addition, per
Section III.5 of the permit, you must submit a formal request to the Division to transfer the permit
and you must receive approval from the Division to transfer the permit to a new owner.
Please note that several options are now available for transferring the permit to EWT 39, LLC. Per
15A NCAC 02H.1045 (the 2017 stormwater rules) and G.S.143-214.7, permit transfer applications
shall be accepted by the Division under the following scenarios:
1. Upon the request of the current and proposed permittee, where both the current and
proposed permittee sign the transfer application.
2. Upon the request of a successor owner of the property on which the permitted activity is
occurring or will occur_ Specific submittal requirements are listed in G.S.143-214.7(c5).
The transfer application form is available on our website at:

submittal requirements for each type of transfer that is available.
It is your responsibility as the current permittee to complete, sign and submit the permit transfer
application form. Please submit a completed and signed transfer application to this Office before
September 28, 2019 along with the required documentation listed on the form. Any individual or
entity found to be in noncompliance with the provisions of a stormwater management permit or
the stormwater rules is subject to enforcement procedures as set forth in NCGS 143 Article 21.
Failure to provide the requested information, or to respond to this letter by the due date, may
initiate enforcement action including the assessment of civil penalties.

Please also note that EWT 39, LLC is currently operating without a permit. If the permittee does not
submit the transfer application under Option #1 above, then it will fall to the successor property
owner to either submit a request to have the existing permit transferred to them or to submit an
application for a new permit. The maximum density limits have changed during the intervening 20
years that Mr. Richardson held the permit. This means that a new permit application will be subject
to a 12% maximum density limit If EWT 39, LLC elects to accept the existing permit, the density
will be "grandfathered" to the currently permitted 25% maximum. It is to the advantage of EWT 39,
LLC to accept the transfer of the existing permit.

Inspection Summary:
The Division received a complaint regarding ownership of the property and a request for a copy of the permit. Research of
the file revealed the following compliance issues:
1. Per the Brunswick County GIS and the NCSOS, ownership of the property has been conveyed twice, each time
without benefit of notification to the Division to transfer the permit.
2. The project has not been certified. Per Schedule of Compliance Condition 11.13 of the permit, within 30 days of
completing the project, the permittee is responsible for certifying that the project has been constructed in accordance
with the approved plans.

NOTICE OF GROUNDS FOR ADMINISTRATIVE DISSOLUTION OF
Bermuda Gardens, LLC
I am writing to remind you that this business entity is delinquent in filing its 2016 and 2017 annual reports
with this office. Consequently, the business is not in compliance with the North Carolina Limited Liability
Act. The Secretary of State is obligated by N.C.G.S. 57D-6-06 to administratively dissolve a business
entity when the grounds for dissolution exist. Failure to file the annual report is one of the specified
grounds (reasons) for administrative dissolution.
This Notice is the first step of the dissolution process. In order to prevent administrative dissolution, the
business entity must file the appropriate annual report(s), or show to the Corporations Division of the
Secretary of State by November 30, 2017 that each ground determined does not actually exist.
Notice of Grounds are sent each October to limited liability companies that are behind in filing the annual
report. Your entity was delinquent in filing the 2016 annual report last year and was scheduled to receive a
Notice of Grounds in October 2016 Due to the damaging effects of Hurricane Matthew, however, it was
determined to not send delinquency notices to businesses in zip codes that FEMA identified as disaster
areas. Businesses in those specific zip codes were accorded a temporary reprieve of one year to file the
report if they chose to postpone filing. As of today, the 2016 annual report remains unfiled. In
addition, the 2017 was due April 15, 2017 and, as such, is now past due.
We understand that there may be some financial hardship in filing two $200 reports at once. In order to
reduce any related financial discomfort, we are mailing this Notice earlier than usual. Please keep in
mind, all outstanding reports must be filed to maintain your LLC's current/active status. For this
type of government fee, payment installments or payment plans are not an option. However, you may
file one report at a time any time before November 30, 2017.

report summarizes the findings of a recent inspection of the projecfs stormwater controls conducted on April 12,
2002 to determine compliance with Stormwater Permit Number SW8 981110 issued on February 14, 2000.
A summary of the findings and comments are noted under Section 4 of the report. Please inform this Office
in writing before June 15, 2002 of the specific actions that will be undertaken and the time frame required to correct

thhat the Division be kept apprised of any name changes to projects, since that is the main way
projects are tracked. I happened to make the connection from Bermuda Trace to Egret Crossing by
someone who wanted to look at the file for a project called Carolina Place. Your project is part of
the permitted Bermuda Trace Subdivision, which we have determined is now called Carolina Place.
