WATER QU UTf V&-TLAt" AND 8TORUWATER BRANCH We received your letter written on January 25, 2010 referencing DWQ Project # 05- 1798 and we have put together the additional information you requested at our meeting that we had on February 17, 2010 at your office with yourself and Ms. Amy Chapman. In response to Item #1 in your letter, there are several factors that prevent us from moving the "kiosk hub" outside of the buffer (131). These factors include: The Kiosk Hub is located within a unique setting as it will serve as a central point within the Town of Cary's trail system. From the Hub greenway users will be able to connect to other major trails, like the American Tobacco Trail, Umstead State Park, and the Raleigh Trail System. Additionally users will be able to connect to greenway trails that exist within Cary (see maps entitled "Future White Oak-Black Creek Greenway Corridor" and "Greenway'Hub' Informational Kiosk Project"). The circular design of the Kiosk Hub highlights the significance of the location for trail users. The kiosk that is centrally located within the circular design will provide trail system information to users and all mile markers used will start from this location. The proposed location of the Kiosk Hub will NOT require any tree removal (See document entitled "Black Creek Greenway Phase IV, Segment III Photos" to see photos of existing site conditions). Constructing the Kiosk Hub within the proposed location will require the least amount of demolition to the existing trail and disturbance to the surrounding area. Relocating the hub would require realignment of existing trails and put the hub within the exiting spillway that runs down to Bond Lake (see document entitled "Greenway System 'Hub' Project" to see spillway). The current location of the kiosk is approved by the Natural Resources Conservation Service who has authority over Bond Lake - a flood control structure. Initial design plans (see plan entitled "Kiosk Plan Initial Design") showed the Kiosk Hub over the sewer line in order to avoid buffer impacts. The Town of Cary Developmental Review Committee requested that the Kiosk Hub be moved outside of the 20' easement, which resulted in moving the Kiosk Hub further south, into the buffer making it not possible to avoid an impact to the buffer. In response to Item #2, we have provided an additional drawing that shows more clearly the Zone 2 impacts (see drawing entitled "Proposed Kiosk Hub"). It was also brought to our attention during a meeting we had on February 17th at the DWQ office that the proposed concrete headers are not considered a maintenance issue but a disturbance within Zone 1 of the buffer. The PCN form has been updated to address the concrete header impacts. We hope the additional information provided will clear up any questions relating to the location of the proposed Kiosk Hub and its buffer impacts. Greenway trails are allowed in the easements b/c they are maintained and easily repaired. The detail has been revised so that there is only asphalt over the sewerline. The kiosk has been offset so it is outside of the '20" easement. The double-barrel headwall is right on top of the sewer line. No structures are allowed on top of existing or proposed sewer lines. If this sewer line needs to be repaired then the Kiosk will be torn up. In lieu of indicating "alternatives" in the plan set, propose the fully-funded option as the project scope. Since no new utilities are necessary, you can handle reduced budget allocations as construction "sequencing" concerns rather than proposing several alternate scenarios. If you are not funded to construct "alternative 2" then simply construct "alternative 1" only or no additional parking. Then, if funding becomes available within the 5 years that the plan is valid, you can construct "alternative 2" without a new site plan. Show the existing utility lines in the area of work and the areas that would traditionally be required easements (10 feet either side of the line) on the landscape plan. Remove any vegetation proposed within the "easements". 1 .v • The utility lines were added as requested, but the area typically required for a utility easement still has plants shown within it. There should be no plant material within 10 feet of any water or sewer line (services are not considered utility lines for this purpose).
